BOARD OF COMMISSIONERS
ELK RIVER MUNICIPAL UTILITIES
A RESOLUTION APPROVING ACQUISITION OF REAL PROPERTY
FROM THE CITY OF ELK RIVER
WHEREAS, the City of Elk River ("City") is the fee owner of the real property located at in the City
of Elk River, County of Sherburne, State of Minnesota, which is legally described as follows:
Lot 1, Block 1, Natures Edge Business Center Third Addition
(PID: 75-00915-0105) (the "Property");
WHEREAS, the City Council of the City of Elk River adopted Resolution No. 24-11, approving the
conveyance of the Property to Elk River Municipal Utilities, a Minnesota municipal utility
("ERMU"), for use as a substation;
WHEREAS, ERMU wishes to accept the Property for this purpose and use;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE BOARD OF COMMISSIONERS OF ELK RIVER
MUNICIPAL UTILITIES, BASED UPON THE FOREGOING RECITALS INCORPORATED HEREIN, AS
FOLLOWS:
1. The acquisition of the Property by ERMU from the City of Elk River by Quit Claim Deed is
approved.
2. ERMU will cooperate with the City of Elk River in the execution and recording of the Quit
Claim Deed and any other documents necessary to the completion of the conveyance, if
a ny.
3. The Chair of the ERMU Board of Commissioners and the ERMU General Manager are
authorized to execute any documents necessary to the completion of the conveyance, if
a ny.
