Adopt, by motion, Resolution 24-33 detailing the proposed variance of Dodge Avenue NW (MSA Route 118),
5th Street NW (MSA Route 117), and Line Avenue NW (MSA Route 136).
Background/Discussion
As part of the city's frontage/backage road project scheduled for 2025, 5th Street is set to be realigned to run
continuously from Dodge Avenue to Line Avenue. This includes implementing a new cul-de-sac on Line
Avenue just north of 184th Circle. Because these segments are part of the city's State Aid routes, they must
conform to all State Aid road requirements unless otherwise approved by MnDOT State Aid Operations.
Due to right-of-way restrictions and to keep the curve consistent with the rest of Dodge Avenue, staff
recommends requesting a variance from State Aid rules to allow a 25 MPH curve at the intersection of Dodge
Avenue NW and 5th Street NW in lieu of a 30 MPH curve. Part of the variance application includes the need
for a formal resolution passed by the City Council.
Financial Impact
If the variance request is approved, it is estimated to save approximately $195,000 in right-of-way and pond
relocation costs.

RESOLUTION NO. 24-33
A Resolution Requesting a Variance from Standard for State Aid Operation for
Project No. S.A.P. 204-117-002, S.A.P. 204-118-002, S.A.P. 204-136-002.
WHEREAS, the City of Elk River is preparing plans for the reconstruction of Dodge
Avenue NW (MSA Route 118), 51' Street NW (MSA Route 117), and Line Avenue NW
(MSA Route 136) from 600' North of 51 Street NW to 100' South of Xavier Circle; and
WHEREAS, Minnesota Rules for State Aid Operation 8820.9936 (Minimum Design
Standards, Urban; New or Reconstruction Projects) requires the horizontal alignment to
be designed to a minimum speed of 30 miles per hour; and
WHEREAS, the reasons for this variance request are to keep this curve consistent with
the two curves to the North on Dodge Avenue which are already designed for 25 miles
per hour. This variance would also minimize the amount of right-of-way that needs to be
purchased on the NE corner of Dodge Avenue NW and 5t' Street NW.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ELK
RIVER, MINNESOTA AS FOLLOWS; that
1. The City Council does hereby request a variance from the Minnesota Department
of Transportation State Aid Operations Rules Chapter 8820.9936 Minimum
Design Standards, Urban; New or Reconstruction Projects to allow a 25 MPH
curve at the intersection of Dodge Avenue NW and 51' Street NW in lieu of a 30
MPH curve, and
2. The City Council hereby indemnifies, saves and hold harmless the State of
Minnesota and its agents and employees of and from claims, demands, actions, or
causes of action arising out of or by reason of (project descriptions) in accordance
with Minnesota Rules 8820.9936 and further agrees to defend at their sole cost
and expense any action or proceeding commenced for the purpose of asserting
any claim arising as a result of the granting this variance.

I. RESOLUTION
Variance Request — Requesting variance for 25 MPH horizontal curves instead of 30 MPH
horizontal curves as required by State Aid Rule 8820.9936 — to be acted on by the Elk River City
Council prior to the variance committee meeting.
Parking Restrictions on State Aid Routes - Establishing Parking Restrictions on Particular Municipal
State Aid Routes— to be acted on by the Elk River City Council in a future meeting.
II. LOCATION MAP AND TYPICAL SECTION
See Figure 1 for existing and proposed typical sections. Existing roadway section is a 32'-42' wide
urban roadway. Proposed section is a 32-ft urban roadway. See Figure 2 for proposed variance
request design. Figures 3 and 4 show potential designs that would stay within the parameters of
8820.9936 but would include additional cost.
III. ADJACENT LAND USES
Land uses along Dodge Avenue NW include Various restaurants and buisnesses including but not
limited to an auto shop, tattoo shop, buffet, and veterinary clinic. Land use along 51h Street NW
include apartments, residential homes, and buisnesses including a mortgage broker and tailor.
IV. MOTORIST, PEDESTRIAN, VEHICLES AND COMMERCIAL NEEDS
The proposed conditions would turn an existing stop condition with conflict points into a
continuous curve improving the safety of the intersection. With all options the city intends to add
a sidewalk on the north side of the road increasing pedestrian safety and access to the larger
sidewalk network.
V. EFFECTS OF DESIGNING IN ACCORDANCE WITH RULE AND WITHOUT
A. With the rule (30 MPH Curve)
1. Need for acquiring additional right-of-way from two properties.
2. Relocation of pond due to 30 MPH curve requirements.
3. Existing 25 MPH curve outside project limits to the north will remain in place
restricting speeds.

would simply match that constraint.

VI. DEFINE CRITICAL DESIGN ELEMENT
Critical element is the horizontal curve, which provides for a design speed curve of 25 MPH (182'
Radius) with 2% crown, in lieu of the 30 MPH (300' Radius) minimum design speed curve.
VII. ESTIMATED ADDITIONAL COSTS
A. 30 MPH Curve
The additional cost for the 30 MPH curve would include relocation of a pond due to the
horizontal design requirements for the 30 MPH curves. This option would also have the
added cost of right-of-way acquisition for two properties. The total additional cost over the
requested variance would be $195,140
B. 30 MPH Super Elevated Curve
The additional cost for the 30 MPH super elevated curve would also include the relocation
of a pond due to the design requirements for the 30 MPH curves. This option would also
have added cost of right-of-way acquisition for two properties. The total additional cost over
the requested variance woul be $240,650

There is no history of accidents at this location.

X. LEGAL, POSTED SPEED

XI. FUTURE IMPROVEMENTS
No future improvements are anticipated at this time.
XII. SAFETY, MITIGATION
Roadway to be signed with 25 MPH advisory and curve signs along with no parking signs,
consistent with the MMUTCD Manual, if variance is granted. All options would eliminate a stop
condition turning the intersection into a continuous curve improving the safety of said
intersection. Sidewalk will also be added through the project area to improve pedestrian safety.
XIII. PERTINENT FACTORS
The existing curves to the north are 25 MPH curves and have had no recorded accidents. The
proposed improvement would be to add another 25 MPH curve at the intersection of Dodge
Avenue and 51h Street along with eliminating a stop condition improving the safety of the
intersection.
