Background/Discussion The applicant is requesting a Conditional Use Permit (CUP) to construct an addition to the existing religious institution (church) located at 21695 Elk Lake Road NW. The property, which spans approximately 30 acres, is zoned R I a — Single Family Residential, where churches require a CUP. The current proposed addition (Phase 2) will be approximately 4,800 square feet. Site work for Phase 2 will also include preparations for a future 38,000-square-foot addition (Phase 3), including the construction of a 20-foot-wide gravel fire road around the east side of the building. Planning Commission During the public hearing, a resident asked who would be responsible for paying for the upgrade of 217th Avenue when/if it is constructed, and whether it would take land from adjacent properties. All construction costs would be at the church's expense and the road would be contained in existing right-of-way and/or prescriptive easements. The same would be true if the city initiates a 217th Avenue improvement project. Staff have not received any comments since the commission meeting. The Planning Commission had no questions or concerns and unanimously recommended approval. The property currently has a single access point on Elk Lake Road and 287 parking stalls, with plans to expand the parking capacity by 34 additional stalls in the future. According to the 2020 Minnesota State Fire Code (Section 503.1.2), a fire code official can require more than one fire apparatus access road if a single road could be blocked by vehicle congestion, terrain, climate, or other factors. Consequently, any further additions beyond Phase 2 will require the property to provide access onto 217th Avenue and pave the street to city standards from Elk Lake Road to the second access point. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort convenience or general welfare of the neighborhood or the city. As this religious institution has been operating for over 20 years, and the proposed additions will not introduce alternative uses on the parcel, the use will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. Staff do not see a need to impose specific conditions to satisfy this standard. 2. Will be consistent with the comprehensive plan. The property is guided as Public/Semi Public and includes local government uses, municipal facilities, community service providers, schools, and places of worship and assembly such as City Hall, fire stations, churches, and Elk River's public schools. Coordination with schools and service providers is key to ensure these essential facilities have capacity and/or are in areas that can support growth and development as it occurs. The use is consistent with the Comprehensive Plan. Staff do not see a need to impose specific conditions to satisfy this standard. 3. Will not impede the normal and orderly development and improvement of surrounding vacant property. The area is currently developed with large lot single family homes and as there are no vacant lots, the proposed use will not affect development of the surrounding area. Staff do not see a need to impose specific conditions to satisfy this standard. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. Phase 02 includes a new addition on the north side of the existing building as well as the Site work that is associated for the future additions. The Master Plamning of this project awns to construct new additions to the current building, addressing the church's growth needs in three distinct areas: o A new dedicated multipurpose space for clnildren's actixities, allowing for the existing space to be utilized for additional classrooms. o A new space tailored to the growing attendance of youth. o A new, worship center, lobby, and administrative space to serve the entire congregation. This expansion aligns with the Elk River Comprehensive Plan, wh ich designates this area as one of targeted and projected growth areas for the city-. The Future Land Use flap indicates a projection of new traditional single-family homes within just a few miles of the church location. The design of the expansion is designed to complement the existing chtrch's aesthetics while utilizing materials that are efficient, low -maintenance, and durable. Subject to the terms and conditions set forth herein, the City of Elk River hereby grants a Conditional Use Permit ("Permit") requested by River of Life Church for the following use: Conditional Use Permit to allow expansion of an existing religious use at 21695 Elk Lake Road NW Property. The Permit is for the following described property ("Subject Property") in the City of Elk River, Sherburne County, Minnesota: LOT 1, BLOCK 1, RIVER OF LIFE, Sherburne County, Minnesota Owner. Owner of the Subject Property at time of the approval of the Permit: River of Life Church, owner Conditions. The Permit is issued subject to the following conditions: 1. Any addition, of any size, after Phase 2 will require the property to provide access to 217th Avenue with an upgrade of the gravel street to city standards from Elk Lake Road to the second approved location of the second access. 2. A 20-foot-wide fire department access road shall be installed along the east side of the building, connecting the northern and southwestern parking areas. The location and layout shall be approved by the Fire Department. Termination of Permit. The Permit shall remain in effect only for so long as the conditions set for the herein are complied with. The City may revoke the Permit following a public hearing for violation of the terms and/or conditions set forth in the Permit. Lapse. If within two (2) years of the issuance of the Permit the proposed work described in a conditional use permit has not been substantially completed, the permit shall expire and become void, except that the council may, following recommendation of the planning commission, extend the permit for an additional period determined by the council on the receipt of a request for a permit extension prior to its expiration. A conditional Page 113 of 381 use permit authorizes only the use specified in the permit and shall expire if, for any reason, the authorized use ceases for more than six (6) months. Criminal Penalty. Both the owner and any occupant of the Subject Property are responsible for compliance with the permit. Violation of the terms of the Permit is a criminal misdemeanor. Recording.
