BACKGROUND/ DISCUSSION:
At the November 12, 2024, utilities commission meeting, a portion of the meeting was closed
pursuant to Minn. Stat. § 13D.05, subd. 3(b) for a confidential attorney -client privileged
discussion regarding settlement of potential claims against RJM Construction arising from
Contract No. A133, for the field services building project.
• Commissioners present: Chair John Dietz, Vice Chair Mary Stewart, Matt Westgaard,
Paul Bell, Nick Zerwas
• Also present: General Manager Mark Hanson, Operations Director Tom Geiser, Finance
Manager Melissa Karpinski, Governance & Communications Manager Tony Mauren,
ERMU Attorney Jared Shepherd
The Commission received information on the RJM Construction Contract No. A133, Field
Services Building Project Dispute Settlement which was included in the November 2024
commission meeting packet. After discussing the information with staff and legal counsel, the
Commission motioned to reopen the meeting to the public and then voted to approve the
project closeout agreement in open session.
