OCTOBER 23, 2024 MEETING MINUTES
The meeting of the Sherburne County Municipal Recycling Board of Director's meeting was
called to order at 4:00 P.M. The followingwere present: John Dietz, Ell< River Mayor; Paul
Knier, Big Lake Mayor; Nicl<Stay, Zimmerman Mayor; Tracy Bertram, Becker Mayor; Cal
Portner, Elk River City Administrator; Hanna Klimmek, Big Lake City Administrator; Randy
Piasecki, Zimmerman City Administrator; and Greg Lerud, Becker City Administrator.
Motion by Knier, second by Bertram to appoint Dietz as Board Chair, all voted in favor.
Motion by Stay, second by Bertram to name Knier as Vice -Chair, all voted in favor.
Lerud presented said that the Board was formed through a Joint Powers Agreement before
the time when the county was involved in setting up brush dumps, and it was a way for the
four municipalities to purchase and share equipment to operate their own sites. To his
knowledge, Lerud said it appears that the Board never met after forming, and with the
County now involved in coordinating and providingfinancingfor brush dumps, this
organization was no longer needed.
Lerud presented a letter from the Becker City Attorney regarding the process for dissolution
of the board, and the meetingtoday was to considerthe city of Becker's request to dissolve
the Joint Powers Agreement.
Piasecki said that the only piece of equipment purchased by the Board was a skid steer and
it was presently housed at the City of Zimmerman. Piasecki said that the skid steer could
be put up for auction and the proceeds distributed to member cities. The Board members
agreed that there would be an equal distribution of sale proceeds to the cities.
After a brief discussion, Board member Stay offered Resolution 24-01 and moved for its
adoption, second by Knier.
RESOLUTION 24-01
A RESOLUTION RECOMMENDING THE TERMINATION OFTHE SHERBURNE COUNTY
MUNICIPAL RECYCLING BOARD
WHEREAS, in 1999 the cities of Becker, Big Lake, Elk River and Zimmerman entered into
a Joint Powers Agreement (JPA) establishing the "Sherburne County
Municipal Recycling Board" (Board); and,
WHEREAS, the purpose of the Agreement was to establish a Board of Directors to direct
and control the acquisition and use of shared municipal equipment and
tools; and,
WHEREAS, the JPA provided a process to Terminate the Agreement; and,
WHEREAS, the City of Becker has provided Resolution 24-72 that formally requests the
JPA be terminated and dissolved; and
NOW, THEREFORE BE IT RESOLVED, pursuant to the provisions of the JPA, the Board of
Directors of the Sherburne County Municipal Recycling Board finds that the
purposes and needs for entering into the JPA and establishing the Board no
longer exist.
BE IT FURTHER RESOLVED, that the Board recommends the following:
1. That each initial party's city council pass a Resolution terminating the Board as a
body and the JPA agreement within 60 days of the date of this Resolution.
2. If all cities consent to the termination, that this Board meet again within 60 days of
the passage of this Resolution to formally terminate the Agreement and take the
steps necessary to dispose of any personal property and distribute any proceeds or
monies, if any, in proportion to the total contributions made by the initial members
over the duration of this Agreement.
All members voted in favor.
Lerud said that each member city's city council will have to meet within 60 days to act on
this request to dissolve. Assuming all cities did so, it was hoped that a final meeting could
be held by the end of the year to dissolve the JPA.
With no other business a motion to adjourn was made by Bertram, second by Knier, all
voted in favor and the meeting adjourned at 4:25 P.M.
