SR 02-21-2006 City of Elk River REQUEST FOR COUNCIL ACTION Agenda Section Meeting Date Consent Pebrua 21,2006 Item Description Adopt a Resolution to Approve a Premises Permit for Elk's Quarterback Club Item Number 3.5.* Prepared by oan Schmidt, Ci Clerk Reviewed by Introduction The Elk's Quarterback Club has requested to renew its premises permit to conduct charitable gambling at Time Out Sports Bar. The permit will run for two years from August 1, 2006 until July 31, 2008. Discussion The City's ordinance requires that 75% of the lawful purpose expenditures must be spent within the City's trade area. The trade area for Elk River includes the cities of Elk River, Ramsey, Otsego, Rogers, and Zimmerman. The attached chart shows that the amount of expenditures spent in the trade area during the years 2004 and 2005 exceeded the required 75%. FinanciallmDact If the Elk's Quarterback Club is not allowed a Premises Permit, the trade area would not receive 75% of the lawful purpose expenditures. Attachments . Resolution . Council Action Motion by _ Second by _ Vote Follow Up RESOLUTION 06- A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION APPROVING PREMISES PERMIT FOR THE ELK'S QUARTERBACK CLUB WHEREAS, The Elk's Quarterback Club has made application to the State Gambling Control Board for a Premises Permit Renewal; and WHEREAS, the Premises Permit will allow charitable gambling on the premises of Time Out Sports Bar located at 19232 Evans Street in the City of Elk River for the period of August 1, 2006 to July 31, 2008; and WHEREAS, The Elk's Quarterback Club has met the city's requirement of spending 75 percent of its lawful expenditures within the city's trade area during the past two years; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota that a Premises Permit be granted to The Elk's Quarterback Club to allow charitable gambling operations at Time Out Sports Bar located at 19232 Evans Street in the City of Elk River, Minnesota. Passed and adopted this 21 st day of February 2006.
