Introduction
The applicant is requesting to change the land use designation and zoning of a portion of a
parcel from P IPS (Public/Semi-Public) to HB (Highway Business) and R1c (Single Family Residential) to
C3 (Highway Commercial).
Discussion
These items are housekeeping issues and are being requested in conjunction with a request for a simple
plat. The existing boundary for the land use category and zoning district currendy follows a quarter
section line and bisects one of the proposed lots. If the existing zoning is not changed to reflect the new
lot lines, the one of the lots will have split zoning and land use.
The Planning Commission considered these items at their February 14th meeting. No one spoke at the
public hearing. The Commission recommended approval of the proposed land use amendment and zone
change.

Overview
The applicant is requesting that the land use designation of a portion of the subject property
be changed from PS (Public/Semi-Public) to HB (Highway Business) and the zoning be
changed from Rlc (Single Family Residential) to C3 (Highway Commercial).
The adjacent land use to the south and west is Parker Elementary school; the land use
designation is PS. The land use to the north and east is commercial; the land use designation
is HB. The adjacent zoning to the south and west is Rl c, to the north is PUD and to the east
is C3.
This is a housekeeping request. Currently, the zoning and land use boundaries splits one of
the lots of the proposed plat. The boundary currently follows a quarter section line. The
west half of the proposed lot 1 has land use designation ofPS and is zoned Rlc; the east half
has land use designation of HB and is zoned C3. In order to avoid having a parcel with two
different land use designations and zoning districts, the land use and zoning for the west half
of the proposed lot has to be changed so that it is consistent with the rest of the property.
Recommendation
Staff recommends that the Planning Commission recommend approval of the applicant's
request to change the land use designation and zoning to HB and C3.

A RESOLUTION AMENDING THE COMPREHENSIVE PLAN
TO CHANGE THE LAND USE FROM P /P-SP (PUBLIC/SEMI-PUBLIC) TO HB
(HIGHWAY BUSINESS)
Case No. LU 06-02
WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure
for amending the Comprehensive Plan, and
WHEREAS, the Planning Commission held a public hearing on Tuesday, February 14,
2006 and recommended approval regarding the Comprehensive Plan amendment request for the
property generally described as:
Exhibit A
and,
WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request
and finds the following:
1. The proposed amendment would eliminate a situation where a parcel has a split land
use designation.
2. The proposed amendment is appropriate for this site because the majority of the
property has a land use designation of HB.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River
that the Land Use Plan be amended to change the property as described above from P /P-SP
(Public/Semi-Public) to HB (Highway Business).
PASSED by the City Council of the City of Elk River this 21st day of February, 2006.

The City Council of the City of Elk River does hereby ordain as follows:
Section 1. The duly adopted Zoning Map of the City of Elk River is hereby
amended to rezone the properties described as:
Exhibit A
Section 2.
The rezoning is being approved based on the following fIndings:
1. The proposed C3 zoning is consistent with the proposed land use of Highway
Business.
2. The proposed zoning will eliminate a situation where a lot has split zoning.
3. The proposed C3 zoning is compatible with the zoning of the majority of the
parcel.
Section 3. That this Ordinance shall take effect and be in full force from and
after the date of its publication.
Passed and adopted this 2e day of Febmary, 2006, by the City Council ofthe City of
Elk River.
