Prepared by S. Harlicker Reviewed by S. Clark Introduction The applicant is requesting to subdivide two existing lots into 3 lots and an outlot. The two lots were originally plated as Lots 1 and 2, Block 2, Kingdom Estates. There is a single family residence on each of existing lots. The properties are zoned Ria which require 2.5 acre minimum lot size. Discussion The proposed plat will result in one developable lot, one outlot which can be platted as a developable lot in the future and two lots with existing residences. No new street right-of-way is required, each lot will have access from Olson Street. Each lot complies with the dimensional requirements of the Ria zoning district. The lot line between Lots 2 and 3 should be adjusted so that the garage and septic system on lot 3 complies with the setback requirements. MEMORANDUM TO: Mayor and City Council FROM: Scott Harlicker, Senior Planner~ DATE: February 21, 2006 SUBJECT: Case No. P 06-04 Simple Plat for Kingdom Estates 3rd Addition Request The applicant is requesting a simple plat for Kingdom Estates 3rd Addition location 10511 and 10499 209th Avenue Zonin~1 land Use Ria (Single Family Residential) / RR (Rural Residential) Overview The subject properties consist of two lots totaling 14.65 acres. The two lots were platted as part of Kingdom Estates. The properties have frontage on Olson Street in the Kingdom Estates subdivision. There are existing homes located on each of the two lots. The property is located within the Shoreline Management area for Eagle Lake. The proposed plat complies with the requirements of the Shoreline Management Ordinance. Analysis The proposed lots comply with the. dimensional requirements of the Ria zoning district for lot area and width. The proposed plat would create 3 lots and an oudot. Lot 1 will be 2.5 acres and is currendy vacant except for a storage building. The storage building will have to be removed. Lot 2 is 3.83 acres and contains the original farmstead, a house and two out Planning Department Mission: the orderly development of a livable and sustainable E.lk River community. City Council / AS 05-04 October 17, 2005 Page 2 buildings. Lot 3 is 5.81 acres and contains a single family house. Outlot A is 2.5 acres and can be platted in the future as a buildable lot. Lot Layout The existing residence and septic field on lot 3 encroaches into the side yard setback requirement. The garage is setback 16.8 feet from the side property line; the required setback is 20 feet from the property. The existing septic system for the house on lot 3 abuts the property line; the required setback is 10 feet. The lot line between lots 2 and 3 should be adjusted so that the setback requirements are met. Grading. Drainage and Utilities Grading, drainage and utility issues are addressed in the City Engineer's memo. Park and Recreation It is recommended that the Council accept cash for the one new lot to meet the park dedication requirements. Park dedication for Outlot A will be collected at the time the outlot is platted as a lot. Recommendation Staff recommends that the City Council approve the request with the following conditions: 1. Park dedication fee in the amount of $2,940 for one lot shall be paid prior to releasing the subdivision for recording. Park dedication for Outlot A shall be paid at the time it is platted and at the rate applicable at the time it is platted. 2. Surface water management fee in the amount of $84.65 for one lot shall be paid prior to releasing the subdivision for recording. 3. The shed on lot 1 shall be removed within one year of recording the plat unless a building permit is issued for the lot. 4. All comments of the City Engineer shall be addressed. 5. The lot line between lots 2 and 3 shall be adjusted so that the garage on lot 3 is setback a minimum of 20 feet and the drainfield on lot 3 is setback 10 feet. Based on our review, we would offer the following comments: 1. The plat of Kingdom Estates 3rd Addition replats Lots 1 and 2, Block 2 of Kingdom Estates into Lots 1,2 and 3, Block 1 and Oudot A. Lots 2 and 3 contain the existing homes, with Lot 1 being newly created buildable lot. 2. The proposed primary and secondary septic areas are shown on a sloped area. Prior to the issuance of a building permit, a determination should be made relative to their ability to support a septic system. Once the septic system area is identified, it should be protected prior to any construction on the site. 3. There is an existing shed on the property. It is our understanding that the intent is to remove the shed. It should be noted as such on the plan sheet. 4. There is an existing wedand that is partially in all three lots. The original Kingdom Estates Addition had a drainage and utility easement around the wedand. The same boundary is shown on Kingdom Estates 3rd Addition, but is only noted as survey line. It should be clearly identified as a drainage and utility easement. 5. The submittal for Kingdom Estates 3rd Addition still shows some of the original silt fence required for the original street construction. It is our understanding that it is the developer's intent to create a buildable lot at some time in the future, but to allow this area to remain an outlot until such time that they wish to sell it as a buildable lot.
