Adopt, by motion, Resolution 24-65 dissolving the Sherburne County Municipal Recycling Board.
Background/Discussion
The City of Elk River entered into a Joint Powers Agreement with the other cities within Sherburne County
to manage certain assets for use at compost sites.
There have been no equipment additions or a need for the joint powers board. The City of Becker initiated
the process to dissolve the board and dispense with equipment.
Financial Impact
The city will receive a share of the return for the piece of equipment that will be sold.

RESOLUTION 24-65
A RESOLUTION APPROVING THE DISSOLUTION
OF THE SHERBURNE COUNTY MUNICIPAL RECYCLING BOARD
WHEREAS, the City of Elk River is part of the Sherburne County Municipal Recycling Board
(hereinafter referred to as the “Recycling Board”); and,
WHEREAS, the Recycling Board is comprised of the Cities of Becker, Big Lake, Elk River,
and Zimmerman; and,
WHEREAS, the Recycling Board has been in existence since 1999, organized for the
purposes of directing and controlling the acquisition and use of shared municipal equipment and
tools; and,
WHEREAS, the Recycling Board is formed under a Joint Powers Agreement made between
the member cities of the Recycling Board pursuant to the authority conferred on the parties to
the Agreement under Minnesota Statutes Section 471.59; and,
WHEREAS, the Recycling Board, and the activities that it was created to acquire, and use
no longer exist, as the member cities can accomplish the purposes of the Recycling Board, if or
as required, on their own; and,
WHEREAS, the Recycling Board met on October 23, 2024, to consider the city of Becker’s
Resolution 24-72, requesting the Recycling Board recommend to the member cities that the
Recycling Board and Joint Powers Agreement be dissolved and terminated.
NOW THEREFORE, THE CITY OF BECKER HEREBY APPROVES AND AGREES TO THE FOLLOWING:
1. The recommendation of the Recycling Board through their Resolution 24-01, that the JPA
Agreement and Sherburne County Municipal Recycling Board be terminated and dissolved.
2. The disposal of any property owned by the Board and the proceeds be disbursed to the
member cities pursuant to the Joint Powers Agreement.
