Adopt, by motion, Resolution 25-06 approving the final plat of Norrgard Wooded Acres with the following Conditions: 1. Park Dedication Fees shall be paid for two dwelling units at the rate applicable when the subdivision is released for recording. 2. A 30-foot trail easement within the front yards of the parcels along Jarvis Street shall be prepared by the applicant and recorded along with the final plat. Background/Discussion The property is zoned as Single-Family Residential (R1a), requiring minimum lot sizes of 2.5 acres. The applicant seeks approval for a preliminary and final plat to subdivide their 55.07-acre property into three parcels. Lot 3 will comprise 50.07 acres, while Lots 1 and 2 will be 2.5 acres each. Access to Lots 1 and 2 will be provided via Jarvis Street. The proposed plat complies with all dimensional requirements. Planning Commission The commission inquired about wetlands but expressed no concerns regarding the proposed plat. No public comments were made during the public hearing. Following discussion, the commission unanimously recommended approval of the preliminary plat. Parks and Recreation Commission The Commission recommended that Park Dedication for Norrgard Wooded Acres be paid in cash at the applicable rate at the time of recording, based on two dwelling units. Although there are currently no plans to construct the trail, the Commission also recommended a 30-foot trail easement within the front yards of the parcels along Jarvis to facilitate potential future trail construction. The preferred location for trails is entirely within the right-of-way (ROW). Staff has attached two trail section Page 115 of 155 exhibits of two recently constructed rural trails: one located fully within the ROW and another five feet outside the ROW. Following the Planning Commission meeting, the applicant raised questions regarding the necessity of the proposed easement and the likelihood of a trail ever being constructed. In reviewing the attached trail sections, an easement may be required to fully construct a trail along the west side of Jarvis Street. However, as trails are generally constructed close to the roadway, 30 feet may be too large. If the Council supports the trail easement request, a smaller easement of 15 feet should accommodate the trail and areas needed for grading to meet existing grades. The trail has not been designed, but staff feels this should provide the necessary space to build the identified trail in the future. Financial Impact None Mission/Policy/Goal Responsibly grow. Background/Discussion The property is zoned Single Family Residential (R1a) with minimum lot sizes of 2 ½ acres. The property was previously platted as Glens Ridge. The applicant has requested approval of a preliminary and final plat to subdivide their 55-acre property into three parcels. Lots 1 and 2 will be 2.50 acres and Lot 3 will be 50.07 acres in size. Access to lots 1 and 2 will be from Jarvis Street and Lot 3 has access to Cleveland Street and Jarvis Street. Two parcels are eligible for park dedication. Parks and Recreation Commission The Parks and Recreation Commission, at their December 11, 2024, meeting is expected to recommend park dedication be paid in cash, at the applicable rate at the time of recording, for two dwelling units. Their recommendation will be included with staff’s recommendation regarding the final plat for the City Council. Applicable Regulations City ordinance section 30-375 outlines the required findings for approval of a plat. 1. The proposed subdivision is consistent with the zoning regulations (article VI of this chapter) and conforms in all respects with all requirements of this Code, including the zoning regulations and this article. The proposed subdivision is consistent with all zoning regulations. The lot size and lot width meet the ordinance requirements. 2. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans, including, but not limited to, the city's comprehensive development plan. The Comprehensive Plan guides the property for Rural Residential which consists of large lot single- family homes. This is the predominant residential type in the north of the city beyond the Urban Service Area. This land use primarily consists of planned residential subdivisions and lots located directly on arterial roadways. This land use supports large lot residential development and allows agricultural operations as an accessory use where appropriate. The subdivision is consistent with all applicable plans. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. Wetlands have been delineated in accordance with state regulations and the required setbacks are included in easements per sec 30-xxx of city code. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities, and improvements otherwise required in this article. The proposed subdivision will not cause substantial environmental damage. Although trees may be removed, the subdivision will not cause substantial environmental damage. 6. The proposed subdivision will not conflict with easements of record or with easements established by the judgment of a court.
