Provide staff with direction to formally begin the Conditional Use Permit (CUP) revocation process or to
provide additional time for recording the plat of Aggregate Commercial Sixth Final Plat.
Background/Discussion
In July 2018, Elk River Extreme Motor Park (ERX) received approval for CUP 18-10, and shortly after that, it
expanded their track beyond the approved CUP boundaries and onto an adjacent property. As a result, they
were required to apply for a CUP amendment, a plat, and an easement vacation to incorporate the expanded
track into their approved permit area. ERX received approval of the amendment, plat, and vacation in 2022
but has continued operating the facility since 2018 without a recorded CUP amendment or plat as the
conditions of approval have not been satisfied — notably, the recording of the plat.
ERX submitted their plat for signatures in early February and picked it up a few weeks later. On March 21,
2025, staff reached out to inquire about the status of its recording but received no response. A follow-up
inquiry was made a week later on March 28, 2025, and noted that if the plat was not recorded, staff would
discuss possible revocation with the City Council on April 7, 2025. Without a response, a third attempt was
made on April 2, 2025, noting that a lack of response would result in a discussion with the City Council for
possible revocation. ERX did not respond to this final communication, nor did they notify staff that the plat
had been recorded. The plat is required to be recorded before the CUP can be recorded.
Staff are seeking direction on revocation or additional time to complete the required recordings.
