SR 03-20-2006 City of Elk River REQUEST FOR COUNCIL ACTION Agenda Section Meeting Date En . eerin March 20, 2006 Item Description 193rd Avenue Corridor Stu Introduction Item Number Introduction On June 20, 2005 the City Council adopted Resolution 05-67, initiating the corridor study on 193rd Avenue from 1H 169 to CSAH 13. Discussion City staff has done an initial review of issues involved in selecting a corridor for 193rd Avenue from 1H 169 to CSAH 13. Informational meetings were held on Tuesday, January 24, 2006 with residents in the area of the new 193rd Avenue corridor and on Wednesday, January 25,2006 with residents in and around the area of the existing 193rd Avenue corridor. On Monday, March 20, 2006, I will briefly show the City Council the same presentation that was presented at these informational meetings and be available to answer questions. Financial Impact As the City Council is aware, it appears that the City of Elk River will receive a Federal SAFTEA- LV Grant for construction of the 193rd Avenue corridor in the amount of approximately $950,000. (fhis will not be official until the Fall of 2006). This grant will be provided in fiscal year 2009 or 2010. It is estimated that this grant will cover approximately 70 - 80% of the construction of the roadway. The City will be responsible for the remaining 20 - 30% of the roadway construction and any sanitary sewer or watermain that may be constructed with the roadway. In addition, the City will be responsible for all land acquisition costs and all overhead costs associated with Federal documentation, plan and specification preparation, and construction administration. Randy and I would like to let you know what we are thinking in regards to this proposal. We are in favor of Corridor Number 1 that will run adjacent to our property on the north side. We feel that the hill we are on would buffer us somewhat from the traffic. We also feel that this corridor would be the least likely to interrupt our neighborhood as far as housing, etc. We feel a corridor that follows the high-wire line would also be less disruptive to vegetation and the neighborhood than the other corridors proposed. We also have put down roots on our property that go very deep. My husband has constructed arbors and pathways, a barn, a potting shed, patios and perennial gardens that have cost us a lot of time and energy and money. We love our place and hope to live there for many years to come God willing. We have also planted hundreds of shrubs and trees through the years for the wild life and to enhance our privacy. My wife and I operate a greenhouse and vegetable farm at 192 I 5 Tyler street where one of the proposed 4 alignments could possibly be routed. If this route is the one chosen it will of course force us to relocate our l?usiness and fmd a new home. We have lived here 10 years and have invested a lot of time and money getting our business started and to a point where its a sustainable operation. We have thousands of perennials planted on our property that we propagate from every year and have fine tuned our 7.5 acres into some great vegetable producing land. We understand the need for an east-west corridor through Elk River and that you have the power of Eminent Domain at your disposal. We believe that you have better routing options of 193rd rather than through our property. The cost of relocating a business, a homestead and years of income loss would not be a very economical option. Please consider our concerns when and if you expand 193rd. I know that this project will probably go forward as planned and we would like to see some concrete decisions made ASAP ,either way ,as to what's going to happen so we can plan for the future and move on with our lives. We would like to voice our concerns regarding the 4 options on the road that would affect our residence. At the informational meeting you presented the 4 road options, numbering them from 1 to 4, from the north to the south. Our concerns are as follows: 1. Options number 2 and 3 both straddle our property. If a new road was constructed on either side of our home, it would decrease the value of our home, bring more traffic and noise to our property, and possibly vandalism. 2. We would rather have the road go through our property, taking our home with it, than have another road next to our home. 3. We would like to move from our home in 5 years. We know what our home is worth today, however with a proposed road going through our neighborhood or possibly our home, this puts our property on hold. We are now in limbo on selling or improving our property. We would like answers on the proposed road as soon as possible. 4. We would like to recommend your proposed number 1 route for this road extension. This route makes the most sense due to several facts. The route would pass under existing power lines where the land is un-buildable. It is the straightest route which makes the road more desirable to travelers. There are no buildings or businesses in the way to be relocated. There are minimal trees in the way of the road and this route is the least disruptive to families in the area. 5. Any wetlands that may be encountered for the construction of this road are not worth more than a home or business. For the above reasons~ we encourage you to recommend the straightest route for this road. The proposed option number 1 makes the most sense. Summary Though I would agree there are very limited east/west routes connecting the east Elk River developments with Highway 169, I am not in favor ofa 193rd Ave Corridor. I don't believe the 193rd Ave route being proposed would address the east Elk River traffic issue. Even with the corridor being proposed, the majority of the additional east Elk River traffic will still travel Highway 13 to Main St to get on Highway 169. Thus, investment in a new highway could get more benefit elsewhere. Recommendation Investments in east Elk River roadways should be put into a north/south route (i.e. Cty 40) for the new developments. To truly minimize issues with traffic from the east into Elk River, traffic should be routed south to Highway 10. By human nature, traffic will not go northwest to get to the suburbs (southeast) (which would bethe case with a 193rd Ave corridor}. However, commuters will go south, then west on Highway 10, to get to Highway 169/101 (by going south first they will be making progress toward the suburbs). In addition, by investing in a north/south route for east Elk River traffic, it will be a good step in preparation for a potential Mississippi river crossing in Dayton (and it would demonstrate good vision and long-term planning). Justification: > It's not a good plan to route all of the new development traffic into Elk River from the east and then south through Elk River on 169. Why add more unnecessary traffic to an already congested section of 169. > Send the traffic south to Highway 10. It can then go east through Ramsey/Anoka or west to Highway 101/169. This would help avoid unnecessary through-traffic in Elk River. (They would still have a route into Elk River on Cty 13 if their destination was Elk River.) > Would help entice more home buyers to the east Elk River area as they would have a good route to the suburbs and wouldn't have to go northwest to get southeast. > Would be good planning for the future as there may be anpther south route across the Mississippi in Ramsey/Dayton some day. This route would feed well to such a crossing. 193rd Ave Corridor If a decision is still made to move forward with the 193rd Ave Corridor, I would recommend bringing it through to Tyler St and directing traffic south on Tyler to Highway 13. Justification: > Will address the current 197th Ave residential traffic issue by providing an east-west 2/21/2006 Page 2 of2 route to Highway 169 from Tyler 8t. ~ Tyler 8t. already exists. This would save unnecessary expense, it would be less disruptive to residents and businesses, it would minimize impact to woodlands and wetlands, and residents are already accustom to Tyler traffic. ~ East-west traffic from new developments will rarely use the 193rd corridor. They will still take highway 13 to main since very few will go northwest to get south. ~ Would allow for the option to bring it through (crossing Tyler 8t.) to highway 13 at a later date if deemed necessary. If the decision is still made to bring the 193rd Ave Corridor across Tyler heading eastward to Highway 13, I would recommend the option that has it connecting furthest to the south/west. This will minimize any safety concerns with traffic coming around the Trott Brook comer at excessive speeds and will allow enough distance for stopping. Even if the 193rd Ave Corridor is constructed, a north/south corridor (i.e. Cty 40) between the new east Elk River developments and Highway 10 is necessary and should be pursued immediately. Likewise, investment should be made into expanding the capacity of the Main 8t 1 169 intersection as soon as possible. The city of Elk River should be pro-active and find ways (i.e. funding options, etc.) to entice the state to fix the intersection as soon as possible. Thank you for your consideration. As a concerned citizen who lives on 193rd, I am concerned that not enough resources have been put in to studying the Elk Drive option as a viable corridor for linking 169 to the new development areas on the east side of Elk River. The shortest distance between two points is a straight line. From the east side of Elk River to 169 and the shopping centers the shortest distance is via Elk Drive. I think that to make a wise and truly good decision other options need to be evaluated(Elk Drive, 197th, etc...). Also, a traffic count should be performed on 193rd to determine the actual traffic volume. I don't believe that has been done yet. I live on t~e SW corner of 193rd & Baldwin St. Already we have a lot of traffic on Baldwin - people traveling Dodge-192nd-Baldwin-193rd as a shortcut to the northeast part of town. My biggest concern should 193rd be extended to CASH 13, is that there would be an exponential increase of on Baldwin between 192nd and 193rd. I would like to discuss with you ways that we could maybe alleviate the already heavy traffic on Baldwin and the future traffic that a 193rd extension might cause. I look forward to hearing from you. We definitely feel you havent done enough research into looking at other possibilities, mainly 197th. 1m not going to get into all the whys and what fores, but 197th makes a lot more sense over all. Please research 197th thoroughly as you have 193rd, before making any decisions. You have a lot more work to do before you go and alter a lot of peoples welfare and lifestyle. We have 3 boys Steven is 16, Joel is 9 and David is 6. We live at 19253 Tyler street in the valley section of your proposed plan of extending 193rd out to County 13. Please know that we are in agreement that we want what is best for our growing city and we understand that sacrifices sometimes have to be made for the betterment of the city. However, I have a plea to present to you. If I might have a few moments of your time I will explain our situation. We have spent the last 4-5 years in planning and negotiations with the city and contractors in order to make our house livable for David. The county has paid over $30,000 for an elevator to transport David who is wheel chair bound, so we can get him out side. As well as a garage so David would not have to go out into severe weather/cold or heat since his body cannot handle climate changes well. The county has also spent over $37,000 to renovate David's living area. He needed a bathroom that would fit a wheel chair, manual lift to get him off the floor, out of bed and into the shower chair, wheel chair or toilet. An accessible shower, therapy tub and a handicap accessible toilet were needed as well. The sink had to be made accessible as well as ventilation and heat. The hallway and doors have been widened as well to accommodate David's wheel chair In 1999 I gave birth to a very special child (his story is attached for you to peruse at your leisure) He was instantly diagnosed to die. At 13 weeks into my pregnancy the ultrasound showed that his head was resting on his back. We had to fight very hard for his life (the Ambulance and Police force can attest to the number of times they have visited us.) Please know that the area we live in has allowed us easy access to children's hospital along with all of David's 11 other doctors. The horses have been my mainstay of respite and now a part of 2 David's therapy. It is called Hippo-therapy. When he is on a horse, the sky is the limit for him. He gains balance, strength and independence, the knowledge of freedom to move. It allows him to be outside in an environment that encourages him to participate in life which in turn builds his drive to survive. If the road goes through our property, please allow us enough room for our horses as they play such an important role in the stability of our family and the growth of David's abilities. One plan, as I understand it, is to direct the extension on a straight line passing across the front of our home on a diagonal line. This would bifurcate our property and bring four lanes of traffic through our front and side yard faced by our wrap around porch. This would severely affect our property and disturb our family and home so we ask that this option not be considered. Considering the current traffic flows and the minimization of the impact on all neighbors, it seems that an extension of 193rd with a realignment down Tyler Street to Co Rd. 13 would have the least impact on all property owners. Most the houses on Tyler affected by this project are positioned to maximize their views to the West or in the direction of 193rd if extended more or less in a straight fashion. I anticipate that those living on Tyler Street would rather have the traffic on Tyler Street than running through their backyards on proposed 193rd. Please advise as to whether this is a consideration or not. I would also appreciate receiving diagrams of the possible alignments considered. At that time I voice my opinion and my protest against opening 193rd Avenue as a connection to CSAH 13. I will not be able to make the meeting on Wednesday, January 25,2005 because of prior commitments. Therefore, I am addressing this letter to you and Larry Farber. The effort to connect 193rd Avenue with CSAH 13 will result in an increased amount of traffic off of Highway 10. People that do not live in the vicinity and who travel to the lake during the summer months will soon realize the outlet between Highway 10 and Twin Lakes Road connecting with 193rd Avenue. The reason I purchased property and built a home in this area was because of the location, beauty, quietness and nature of the surrounding area. This proposal will eliminate all of that. As a result our property values will go down. I was told when I purchased my lot that eventually there would be an association created and that we would have grass and flowers along the middle boulevard on 193rd Avenue. I guess the city council lies about these things. The problem that I have with Mr. Farber is he never answers calls at home regarding this project and I will eventually meet Mr. Farber because I want to meet God someday. It seems that Mr. Farber knew according to him that in the early 1990's this street would be the connection for County Rd 13. I'm amazed at his foresight. In reality what the City Council of Elk River is planning to do is destroy a beautiful residential neighborhood by lying to its citizens about its intentions the result being traffic increasing in an insurmountable amount. Also, these same people are going to realize that Xavier Street, which connects to 189th Avenue, is also an outlet for them. Therefore, you will have a tremendous amount of traffic in a residential neighborhood with a lot of children present. I am vehemently opposed to this proposal as I'm sure everybody else in this neighborhood is also. First, we've lived in our house since September 1987, and together, we did most of the work to build the house ourselves. You can certainly understand, then, our initial reaction of shock and surprise to hear that ours is possibly one of four on our street, targeted for loss in favor of a new east/west corridor to connect County Rd 13 with Hwy 169. We thank Terry Mauer for meeting with us in our home, independent of the informational meetings that we were unable to attend. We have had several reactions to this information, starting with surprise and ending with more a state of uncertainty and many concerns. While we understand the need for a new east/west road, we first have one question: have all other options or alternatives been considered? Are there no other alternatives? Wasn't County Road 33 once considered for this future east/west corridor need, and if so, what happened to that option? We've considered the potential loss of our home. And we never considered moving. Despite the increased building all around us and the resulting heavy, speed-fraught traffic on Tyler Street (with the connection to 197th), we are satisfied with our location. Moreover, we have a significant emotional as well as monetary investment in this home and property. To replace what we have would be quite expensive to the city, if indeed the city intends to negotiate fairly in the final process. We would require an equivalent of 3.34 acres, as we have now, including mature trees, moving expenses, legal and financial costs associated with the purchase of a new property. We have children in this school district, (which includes one in high school) and we would require that we find comparable property within the school district. We know, too, that the impact of Option 1 on the proposed plan, places our neighbor into significant loss and potential hardship. So in favor of our neighbor's needs under Option 1, we do not support it. Following the power lines would seem the most logical; however, the loss it would impose on this family is too significant. We could, instead, see the connection up through the power lines but angled such that it would save the home and property under Option 1. The most logical option we support is Option 3. The property through which the new road would run is sizeable enough such that it would have the least impact to homeowners on either side. We would support the road next to us, provided we had some support with sound.,.barrier via landscaping, sidewalks for pedestrian traffic, (which is an issue today) and no impact to our own property. Obviously, we hesitate to fully support ANY of these options, given that these are only proposals. There are so many obstacles that could impact these options and the direction the road would take. If we support one of the options, and it suddenly changes, we may not support it anymore; and then, what options do we have? Should a road go past our house, any of our 5 homes, what do we lese -individually and collectively in property values? What compensation is given for lost property value? What traffic risks do we assume with traffic noise, safety for our children, traffic controls? What is the domino effect: are we suddenly then pushed for city sewer and water improvements as a result of the new road construction and potential development east of us? Are we imposed upon and assessed in the future for .additional or future road impr-ovements because we abut a new road? With so many questions and so much unknown in terms of the various ways these initial proposals could change, we cannot support anyone particular option. Our least favored option is one that negatively impacts our home and property in ANY way as well as the option that severely impacts the family under Option 1. Our most favored option is #3, provided it was planned and implemented in the best interests of those properties adjoining the new road. Should our property be targeted, we will enter into fair -negotiations, but it will not be without challenge. And that, above all, is what concerns us the most. We have tried to fight City Hall before, and we have learned how futile that can be. Finally, we ask that, in whatever direction you take with this, you make a expeditious decision. The more prolonged the decision-making, the more prolonged we are from making planned household or landscape improvements. None ofus on Tyler St. want to invest in improvements if they'll be destroyed or wasted. I will grant that this city is lacking in efficient East/W est Corridors and that as we continue to develop these corridors will be even more important, however, the way that this project was approached it seems that you as a City Council made an arbitrary decision th:;tt is based on little or no facts, has no data to suggests that this is the best area for the corridor. Additionally, your decision disregarded the Planning Commissions suggestions and the City's own comprehensive plan. Further, I feel that the long range implications of turning this area into a collector have not been adequately addressed or for that matter even looked at. I understand that when 193rd was originally laid out, on paper, it was looked at to be a though street, however, I doubt that it was looked at to tie into CASH 13 and find it hard to believe that any Council would choose to turn a residential street into a highway bypass. I would further suggest that the City Council that approved the first developments off 193rd were not thinking of this road as a major collector and if they were that they made a grievous error in the way they allowed the developer to orient the homes so that they have driveways that back onto 193rd. This error was perpetuated as further developments were allowed to impact 193rd and further complicated when the City Council allowed a developer to turn 193rd into a parkway. This is not to mention that fact that this solution, in reality, only provides East/West access to 169 not across the city, and will continue to degrade an intersection that, by the City's own recent study, is already close to failing. If the goal for the city is to identify and construct East/W est corridors to provide for the future expansion of the city, then it seems to be less then logical to look at just one site.
