REQUEST FOR PROPOSALS
HISTORIC CONTEXT STUDY AND RESOURCES SURVEY
PROTECT SCOPE
The City of Elk River, through its Heritage Preservation Commission (HPC), is seeking a.
qualified consultant to assist in preparing a historic context study of the city and a focused
historic resources survey (Phase 1) of its downtown area. Boundaries of the focused
resource survey area are shown on the attached Exhibit A. These defined limits of the
focused resource survey contain approximately 210 properties within an approximate 122
acre land area. This portion of the project will result in a comprehensive inventory and
report of historic sites within the focused study area relating to the historic contexts
identified for the city, as well as recommendations for the eligibility of properties based on
both the eight standards found in Section 900.10 (21) (C) of the Elk River Code of
Ordinances for rezoning to Heritage Preservation Overlay Zoning District (attached Exhibit
B) and the four criteria for determining eligibility for the National Register. Additionally, the
city is requesting a scope of work and budget to conduct a Phase 2 evaluation for up to ten
properties within the study area.
The consultant selected for the project will meet Secretary of Interior Professional
Qualification Standards (Federal Register, September 29,1983) and will utilize the Minnesota
State Historic Preservation Office document entitled Guidelines for SHPO
Architecture/History Projects (July 1991) as a guide in completing the project. All work to
be completed under this project will conform to the Secretary of Interior's Standards for
Archaeology and Historic Preservation (September 29,1983). Both City staff and volunteers
from the Heritage Preservation Commission will contribute to the project by assisting the
consultant with research and by reviewing drafts of the report.
The project will be carried out in conformance with the timeline as found on Exhibit C
In completing the project, the consultant will be required to:
A. Work with the HPC and city staff.
B. Prepare a historic context study of the city.
C. Conduct specific research design following the Secretary of Interior's Guidelines for
Identification (Federal Register, September 29, 1983). Develop survey forms.
D. Conduct a reconnaissance survey (Phase 1) of approximately 210 properties within a
defined approximate 122 acre survey area.
E. Conduct a Phase 2 evaluation for up to ten properties, at the discretion of the HPC.
R Prepare individual file folders for each site to include one to two (35 MM) black and
white photos, survey forms, location maps, and other site documentation. Forms for
each site shall be numbered according to the recommended SHPO numbering
system.
G. Assign survey properties to appropriate historic contexts.

H. Initiate and maintain a comprehensive filing system for the HPC, incorporating all
information collected on survey sites. This system shall be designed for expansion as
new information is collected or added.
I. Provide periodic written reports to, and meet with, the Heritage Preservation
Commission and Housing and Redevelopment Authority (HRA) for the City of Elk
River.
J. Submit a draft final report to the Heritage Preservation Commission for review. Said
report to include a minimum of the following:
• Project introduction
• Project objectives and methodology ..
• Description of project components
• Inventory list of all sites surveyed
• Development of historic contexts identifying significant themes in Elk River
History
• The assignment of survey sited to appropriate context(s)
K. Prepare a final narrative report (8 1/ " x 11" format), which conforms to the
Secretary of Interior Standards and Guidelines for reports identification results
(Federal Register, September 29, 1983, pages 44711 through 44723).
L. Provide file folders with labels and other supplies as required to complete the
project.
M. Provide electronic media in the format of choice.
N. Present final reports to the HRA.
The City will provide:
A. Project administration and supervision.
B. Elk River Heritage Preservation Commission participation.
C. Publicity and required hearing notices will be provided by Elk River Heritage
Preservation Commission, if required.
D. Sherburne County Historic Society assistance to advise consultant (where needed)
relative to survey and context work.
All proposals shall include the following information:
A. Resumes of key personnel who will participate in completing the project. It is
emphasized that at least one of these shall meet Secretary of Interior Professional
Qualification Standards.
B. A brief statement, which identifies key personnel experiences with and knowledge of
Secretary of Interior Planning Standards.
C. A preliminary outline explaining the proposed process to be followed in completing
the project and to what extent local support services will be used. Additionally, a
graphic flow chart reflecting the timing/completion of project elements shall be
included.
D. Hourly rate structure and description of scope of services, which can be provided for
$12,000.

The project will be financed by the City of Elk River.
Proposals by qualified persons to complete the survey project for the City of Elk River are
required to be at Elk River City Hall on or before November 15, 2001. Proposals are to be

The City of Elk River will consider all proposals received and will award a contract on the
basis of qualifications; quality of the proposals in relation to the identified needs expressed
by the City; proposed study approach; extent of local resource utilization; and proposed
project bid. The City of Elk River reserves the right to reject any and all proposals and to
award the contract to other than the lowest bidder, if in its discretion the interests of the city

C. Standards The Heritage Preservation Commission shall
recommend to the Planning Commission that an area, building
district, or object be rezoned to the Heritage Preservation
Site Overlay Zoning District upon determining that such
site meets one or more of the following criteria:
i. It has character, interest, or value as part of
the development, heritage or cultural characteristics
of the City of Elk River, State of Minnesota, or the
United States;
ii. Its location is the site of a significant
historic event;
iii. It has yielded, or is likely to yield,
information important in pre -history or history;
iv. It is associated with a person or persons who
significantly contributed to the culture and
development of the City;
V. It embodies distinctive characteristics of an
architectural style, period, form, or treatment;
vi. It represents the work of an architect or master
builder whose individual work has influenced the
development of the City of Elk River;
vii. It embodies elements of architectural design,
detail, materials, or craftsmanship which represent a
significant architectural innovation; or
viii. Its unique location or singular physical

CONSULTANT CONTRACT
Historic Contexts Study and Phase I and II Inventory
This agreement is made by and between the Elk River Housing and Redevelopment
Authority (referred to elsewhere in this document as the "HRA") and Carole Zellie of
Landscape Research (referred to as "consultant.")
WHEREAS, the work program includes the preparation of an historic contexts study and
Phase I and Phase II inventory forms for up to ten properties;
WHEREAS, Carole Zellie of Landscape Research is capable of providing the
professional assistance required and is willing to make those services available;
NOW THEREFORE, the parties hereto mutually agree as follows:
I. Scope of Services
The scope of services covered by the contract shall include the following:
The consultant will conduct research and prepare an historic contexts study and Phase I
and II inventory forms for up to ten properties for a total cost of $12,000. As described in
the attached proposal, the consultant will prepare drafts for review and submit them to the
HRA and Heritage Preservation Commission. The consultant will supply three copies of
the final report; subsequent printing is the responsibility of the HRA.
II. Time of Performance
The services of Carole Zellie of Landscape Research shall commence on the signing of
this agreement and shall be completed so that all final products are accepted by the HRA
by June 15, 2002.
III. Compensation and Method of Payment

Payment of the above shall be made to Carole Zellie of Landscape Research after
submission of an invoice to the HRA. Payment shall be made within 30 days. Invoices
shall specify the tasks performed and the work product completed.
If this contract is terminated under the provisions of articles VIII-IX below. Carole Zellie
of Landscape Research shall be compensated for all services performed and expenses
incurred up to the date of termination.
IV. Changes
The Elk River HRA may, from time to time, request changes in the scope of services to
be performed hereunder. Such changes, including any increase or decrease in the amount
of Carole Zellie of Landscape Research's compensation, which are mutually agreed by
and between the HRA and Carole Zellie of Landscape Research shall be incorporated
into written amendments to this agreement.
V. Compliance with Federal, State and Local Laws
Carole Zellie of Landscape Research shall comply with all federal and state laws and
regulations concerning equal opportunity, affirmative active and fair employment
opportunities. Carole Zellie of Landscape Research further agrees to comply with all
applicable regulations, laws, ordinances and codes to the State and local government and
policies, guidelines and any requirements of this federal grant program.
VI. Interest of the Consultant
The consultant covenants that it now has no personal interest, direct or indirect, in any
property of business of any kind, and shall not acquire any such interest which would
conflict in any manner or degree with the performance of services under this contract.
VII. Indemnification
Carole Zellie of Landscape Research agrees to indemnify, defend and hold harmless the
HRA and its agents, the City of Elk River, from and against all loss or expense (including
costs and attorney's fees) by reason of any claim or suit arising out of the acts or
omissions of Carole Zellie of Landscape Research, her employees, agents, or assigns; or
Carole Zellie of Landscape Research from liability imposed by law upon Carole Zellie of
Landscape Research or its agents or employees for damages because of bodily injury,
including death at any time resulting from, sustained by any person or persons or on any
account of damages to property, including loss of use thereof, whether caused by or
contributed to by Carole Zellie of Landscape Research or its agents or employees.
VIII. Termination of Contract for Cause
If, through any cause, Carole Zellie of Landscape Research shall fail to fulfill in timely
and proper manner its obligations under this contract, or if Carole Zellie of Landscape
Research shall violate any of the covenants, agreements or stipulations of the Agreement,
then the HRA shall thereupon have the right to terminate this contact by giving notice to
Carole Zellie of Landscape Research of such termination and specifying the effective

date of such termination. In such event, all finished or unfinished documents, data,
studies, reports, or other materials prepared by Carole Zellie of Landscape Research
under this contract shall at the option of the City of Elk River become the property of the
HRA and Carole Zellie of Landscape Research shall be entitled to receive just and
equitable compensation for any work satisfactorily completed hereunder.
IX. Termination to Contract for Convenience
The HRA or Carole Zellie of Landscape Research may terminate this agreement at any
time by giving at least twenty (20) days notice in writing to the other party. If the contract
is terminated as provided herein, Carole Zellie of Landscape Research will be paid for the
time and expenses incurred up to the termination date. If this contract is terminated due to
the fault of Carole Zellie of Landsca e Research, Article VII hereof relative to
termination shall apply.
X. Record of Audits
Carole Zellie of Landscape Research shall maintain records, adequate to identify and
account for all costs pertaining to this contract and such other records as may be deemed
necessary to assure proper accounting for all project funds. These records will be made
available for audit purposes to the City of Elk River or any authorized representative, and
will be retained for four (4) years after the expiration of this contract.
XI. Worker's Compensation
As between the City of Elk River and Carole Zellie of Landscape Research, this is
intended as and is an independent contract. Carole Zellie of Landscape Research and no
partner or employee of if Carole Zellie of Landscape Research shall, by reason of this
contract, become an employee of the City of Elk River.
XII. Equal Opportunity and Affirmative Action
In performance of services under this contract, if Carole Zellie of Landscape Research
agrees not to discriminate against any employee or applicant because of sex, race, color,
handicap, religion, national origin age or marital status to the person maintaining the
household, lawful source of income, age or ancestry. Carole Zellie of Landscape
Research will take affirmative action to ensure that applicants are employed, and that
employees are treated during employment without regard to their race, creed, sex, age,
color or national origin. Such action shall include, but not be limited to the following:
employment, upgrading, demotion or transfer; recruitment or recruitment advertising;
layoff or termination; rates of pay or other forms of compensation; and selection for
training, including apprenticeship. Carole Zellie of Landscape Research agrees to post in
conspicuous places, available to employees and applicants for employment, notices
setting forth the provisions of this non-discrimination clause.
XIII. Findings Property of Elk River Housing and Redevelopment Autority
All of the reports, information, data, etc. prepared or assembled by Carole Zellie of
Landscape Research under this contract are the property of the Elk River HRA and
Carole Zellie of Landscape Research agrees that they shall not be made available to any
individual or organization at any time without prior written approval.
XIV. Severability
It is mutually agreed that, in case any provision of the contract is determined by a Court
of law to be unconstitutional, illegal or unenforceable, it is the intention of the parties that
all other provisions of the contract remain in full force.
IN WITNESS THEREOF, parties hereto have caused this agreement to be executed the
year and date written below by their proper officers and representatives.

June 4t": Discussion of constructing a village hall. The question as to the economy of
erecting a building on the lot donated to the Village by Mr. Houlton for the purpose of the Fire
Apparatus was discussed favorably as the Village is paying about $500.00 yearly rent. It was
thought better to pay that much interest and erect a building more suitable for the village
purposes and combine library, council room and engine house. The matter will receive the early
attention of the council.
August 6`": Call for a special election to bond $7000 for the construction of a Library/Council
Room, Engine House and Jail.
August 10: Approved resolution to bond $7500 for erection of first Village Hall, election to
be September 1928.
September 10:

As the Mk River community continues to grow and develop, the role of historic
resources will continually be evaluated through environmental review activities
(conducted for transportation projects), housing improvement, and downtown
development. The proposed historic contexts study and downtown survey will provide
the city with comprehensive information about the history and significance of its
resources.
Historic Contexts
The proposed study will develop historic contexts for Elk River, providing a
comprehensive narrative and analysis of the development of the city from settlement to
the Ptv&E-.,lt. The contexts will describe Elk River's relationship to early Sherburne
County and the Mississippi ]liver, and its rural, suburban, and urban landscapes. It will
also analyze the. development of agriculture, commercial, and residential development.
Downtown Survey
The study will also conduct a limited Phase I survey of the downtown area. The final
details of the scope of this survey will be discussed with City staff before the project
commences.

projects. in Minnesota, we have had extensive experience with historical research and
planning projects throughout Hennepin, Ramsey, Washington, Dakota, and Rice
counties. We have successfully completed many preservation plans and context
studies, including those for the University of Minnesota, and cities such as Minneapolis,
Hastings, St. Cloud, Lanesboro, and Northfield. Our National Register work has
involved the development of historic contexts for various aspects of Minnesota
agriculture and historic landscapes.
Carole Zellie is an architcctural historian and urban planner. She founded Landscape
Research, now a three -person firm, in 1976 and has served as project director and
principal investigator for many of the firm's past projects. Ms. Zcllie holds degrees in
architectural history (B.A. ,' M.A. ) from the University of Minnesota and an M.S. in
historical geography from the University of Wisconsin -Madison. For the proposed
project Ms. Zellie will serve as Principal investigator.
In addition to the preparation of historic context studies and architectural and culttural
resource surveys and all aspect,, of the National Register and local designation studies,
Landscape Researe.1i also) wurks with couunw-diles to develop the research and
documentation phases of their projects. Preservation plans, guidelines for new desig1l
and rehabilitation, Jand use plans, procedures manuals, training programs, and a variety
of tours and other public education programs have resulted.
Our projects have conformed to the guidelines developed by the: ^>L cCTetary of the Interior
and have. been coordinated with the State Historic Preservation Office.
Work Program Overview
Tasks:

The consultant will review a variety of inventory data held by the Minnesota State
Historic. Prr servatkin Office, Elk River, and Sherburne County. This includes
archaeological inventories, cultural resource surveys, tend enviroiunental review

Published and unpublished research sources will lie analyzed. Sources include steate,
county, and local histories, archaeological reports, newt;papers, land use and other
historic maps, real estate records, photographs and historical views, and other archival
materials found in local collections and at the Minnesota Historical Society.
All previous architectural survey data will be reviewed in light of current. Deldwork. and
research. At the beginning of the project, the consultant will present a detailed research
plan to the client. The consultant will inform staff of progress to date during the first
month of the study, and first drafts of the study will be available for review and
revision prior to submission of the final report.

The consultant will work with city staff to develop goals and objectives for
preservation planning and recommendations for future survey and evaluation of
historic properties, sites, and landscapes.
The consultant will also work with staff to prepare for a final presentation_
Timeframe Summary
A final timeline will be developed after consultation with city staff. The project will
cornmence in December 2001 and be completed in approximately six months.
Budget
We propose a $12,000 budget to develop a research plan, conduct and analyze the
research and survey, and prepare the lustcrric: context drafts and final reports. The fee
