Resolution 26-17
A Resolution of the City Council of the City of Elk River Authorizing
Payment for Depreciated Property Loss Claims
WHEREAS, on July 18, 2025, the TH 169 sanitary sewer lift station failed, causing a
sewer backup in several homes along Yale Street NW in Elk River; and
WHEREAS, the Council met with homeowners: Matt Stueber, 17107 Yale St NW: Steven
& Brenda Helle 17131 Yale St NW; Penny Sawdy, 17139 Yale St NW; and Ken & Beatrice
Saba, 17147 Yale St NW on August 20, 2025, regarding the claim submittal process; and
WHEREAS, on January 20, 2026, the Council directed staff to reimburse the four
affected households for their claim depreciation.
WHEREAS, The city has received a release of claims and will reimburse the following
property owners for the depreciation on their property claims found by the League of
Minnesota Cities Insurance Trust:
Matt Stueber - $989.00
Steven & Brenda Helle - $13,255.00
Penny Sawdy - $1,630.94
Ken & Batrice Saba - $3,366.00
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota, as follows: The total depreciated claim amounts to $19,240.94, which will be
paid through the Wastewater Fund.
Passed and adopted this 2nd day of March 2026.
