PLANNING COr1MISSIO~ MEETING
January 30, 1978
- 7:30 P.M.
Members present: Commissioners Toth, Fredericksen, Lucas, Fox, Thompson, Nelson,
Zabee, and Building Inspector Jack Holmes.
Members absent: Commissioner Rootes.
The minutes of the November 28, 1977 regular meeting were reviewed as there were
no additions or corrections the minutes ~lere approved as printed.
The Commission appointed Larry Toth Chairman and Gordon Fredricksen as Vice
Chairman by a unanimous vote.
Mr. Madden representing Dungarvin Inc. met \~th the Commission requesting a
Conditional Use Permit to use the house located at 9607 201st Ave. N.E. Elk
River, tUnnesota as a resedence for 12 mentally retarded adults with a maximum
of 14 residents ldth 6 bedrooms.
1~1r. r.rladden made the follevling statements: There vlould be 120 sq ft. for every
2 residents. The present attached garage would be converted into a additional
bedroom. Adequate insurance vlould be provided. Two to three staff members
would be on duty at all times.- A letter requesti:qg the State Board of Health
approval will be provided and all necessaIjT State or Federal "licenses that
maybe required. Home has 2t baths. They have chosen this site verses the
populated city area because it was felt that since these individuals are limited
handicapped and a rural area such as this would be safer. Staff members consist
of morning maintenance, cook, program director, ~3 aids, and a resddent couple.
Motion was made by Commissioner Lucas and seconded by Commissioner Zabee, and
recommended to the City Cou-~cil that a Conditional Use Permit be granted to
Dungarvin Inc. \~dth provisions be that and Engineering study be made for an
adequate disposal system. If the system be inadequate that an Engineering
plan be implemented before occupan~ of the residents, and further more, the
proper sevlage, ,drc:ina3e mu~t sat~sfy all, applicable. Motion unanimously carried

Neil Hoeft met ~dth the Commission requesting a zoning change from A-l (Agriculture)
to B-1 (H~~ Business). - -. --
Motion was made by Commissioner Fox a~d seconded by Commissioner Fredricksen to
recommend to the council to approve Neil Hoeft t s zoning change from Ao;)l (Agriculture)
to :B-:al (Hwy Business). Motion unanimously carried by a vote of 6-0.
Norm Leider was not present therefore the Commission recommended that a formal
zoning change be submitted to the City Clerke
Bob Moore met with the Co~~ssion requesting set back variances. The Commission
stated that a formal variance request must first be applied for and to include
a plat and construction plans.
Dave Anderson representing Sherburne County Sheriff's Office met lvith the Com-
mission requesting a variance to construct a temporary 12 X 18 ft. building to
be used for records and deputy clerks officee Mr. Anderson stated that this
'-18S a requirement by the State Department. The Commission stated that since
this was a variance of an unusual nature and incord "lith the zfOning ordinance
that the Board o~ Adjustments would have to revie~j this matter.
Tom Koehler met tiith the Commission requesting the construction of a 9 hole
golf course consisting of 23 residential lots. Since this a aariance to the
zoning ordinaces a formal request woUld be required.

A petition was submitted to the Commission requesting a rezoning change from an
R-.3 to R-l for Meadow Park Addition no action. was taken since a public hearing
would be required along vtlth a formal request.
Moved by Commissioner Fredricksen and seconded by Commissioner Zabee that th~
recommend to the City Council that a 90 day moratorium be set for all plating
t~rithin new city limits. Motion unanimously carried by a vote of 6-=0. .
Mov~d by Commissioner Zabee and seconded by Commissioner Fox that ",Ie continue
using the present old city zoning ordinances and county zoning 9rdinances
until the new consolidation ordinance have been prepared and approved. Motion
unanimouSly carried by a vote of 6-0.

Neil Larson'met with the' Comrnission!requesting the construction of a 12 unit
apartment building on Main Street which is presently zoned R-3Which meets the
zoning requirements, however the garages '\"1ould have to be moved as a variance
would be required. No action l-laS taken at this time until Mr. Larson presents
a revised plan.
