The meeting was called to order by Corr~issioner Fox at 7:40 p.m.

The minutes from the October 22 t 1979 meeting 1".~ere read and approved.

Jim Rolow's proposal for highway i:10 South, was added to the agenda. The
agenda was approved.
4. 2rentwood Addition FreliminaIJ7 Plat
Dennis Anderson and Jim Klein presented the preliminar~y plat for the Brentwood
Addition. F-profile of 10\\7911 Street extension to the northeas~~, sho1\led it to
be impracticable. The staff thought that some of the vertical c~rves should
be lengthened to give better sight dist~~ce and safety. Also, some of the
grades should be reducec. The developer is thi~~i~~ of tOvITL~ouses or multi-
unit dvJellings for Blo-ck. Ll, along DeS. HighvJay 7i169. II'his \:~ould provide
cheaper units and cash for the rest of the development. The public hearing
was then opened. Les 1~cGray, Vice President of Barton's wanted the Commissioners
be aware that 3arton's pit is north of this development on ooth sides of
County Road ~'33. Also, that they have land rights to the north edge of
3rentwood Addition. Derillis Anderson said that Jackson and Norfolk Streets
end at the north edge, tov:ard 3arton's holdings. Lot sizes averages 2t acres.
They have a State Transportation Department letter in regards to sound barriers.
There would be approximately 190' of woods. The public hearing was then
closed. 1'here are two street hook-ups 1~;i th hidgelJOod East 3rd F-ddi tion streets,
one with Proctor Street and 2 ~ith Us Highway ~:169 that would be in line with
the Hyland Hills outlet cross overs. The drainage easements are not on the
plat as yet, but should not present any problems. Also, the power-lines do
not present any great problems. Several lots will have some dwelling site

3. Qhild Care Center's Conditional Use Permit
Sandra Picha 1.;ith;"Jolm Gries, lav;y-er, Bill Taft, and Philip l:arkel :presented
her plan for the Child Care Center at 403 Kain Street. She is licensed for
22 children and could expand in time to 40 children. The existing building
is 2 stories and the addition would be one sto~., ~;ith 1200 square feet. The
children would range from 2i to 5 years of age. The operating hours would
be from 6 a.m. to 6 p.m. The arrival time from 6 to 10 a.m., and the pic}~p
time would be from 3 to 6 p.m. The loading area would be in the center of

Peg~r Bode who lives across the street on 323 Main, coesn't want peop~e
using her driveway to turn in. Dorris ~nderson said the hill en Freeport

Commissioner Fox said a conditional use permit can be revolked by the City
Council. Sandra Picha said there would be a teacher for eve~r 10 children.

of the existing building would be used together with the new constructiono

suggested that a survey be made of the lot and also told the developer that
a violation of a conditional use permit, could cause a mometar~y loss in her
dev-elopment. Commissioners Zabee and L,ucas s1.:tggested that the backing of
cars be eliminated in the area 't'lhere unload.ing and loading of the children is
done. The playground area is t~~ce the size required by the State. Also,
State~~d County Officials have looked at the plan. There will be 5 employees

Joe Shiely, third Vice President of J.L. Shiely Company appeared for the
conditional use permit to 9:i:tract gravel in Section 9, 16, 21~ T331'J, F~26\'-J.
'The Shiely Company has ovmed t\10 farms for tv~o ~lears. 'l'his is 300 acres and the~t
plan to purchase 600 acres for the O'Hare International 3aa~ for gravel operations.
They have been operating on a County gravel permit but now need a new City
Permit for their present operations and the new area. They will expand their
operation over a 5 year operaGlon. The public hearing was opened 0 Jim Julik

St. Paul Sand & Gravel operated without a permit. J.t. Shiely said 300 to 400
gallons per minute is needed for recycling vJater. The present well is 500'
deep. Ridgewood wells are 250 to 300 feet with some deeper. Paul Si?ger
asked what is the plant that you are building? Joe Shiely stated that this is
to house the support equipment. The golf course manager was concerned for the
wash water and debris coming off the pit area depositing on the golf course, as
it did aefore several z{ears ago. Joe Shiel::l said that '-later control pOl1cls vJill
be built to contain ru~~off water. The question was asked about operations near
the City of Shakopee. Joe Shiely answered that the City will have a hearing
on water permits and they (Shiely Co.) have a permit to use 2.5 billion gallons at
Shclcopee, but they only use 1.8 billion gallons. The persent operation will
only move several hth~dred feet ~outh from the presen~ operation. They will not
extract gravel from the south i mile. It will go~est on Hipsag farm and

Neil Larson and Lavid 3arnier presented plans for remodeling 3arney's Cafe.
Also, Neil Larson had plans for a two stO~l addition to the old Elliott Paint
Building. ~he conoepts are good.
