Introduction
The request is to vacate a 10 foot drainage and utility easement around the entire perimeter of Outlot A,
Leon Lefebvre Addition. The parcel will be incorporated into the J abez plat and replatted as part of
Outlot A and Outlot B, J abez.
Discussion
The existing easements need to be vacated so that they do not encumber the future development of
Outlots A and B. The vacated easements will be replaced with new easements platted as part ofJabez.

VACATION ONLY WITHIN OUTLOT A, LEON LEFEBVRE ADDITION FOR
PURPOSES OF THE ELK RIVER FORD PROJECT AND REPLAT:
The 10.00 foot Drainage and Utility Easement lying within and abutting the entire
perimeter of OUTLOT A, LEON LEFEBVRE ADDITION, as dedicated on the recorded
plat thereof, City of Elk River, Sherburne County, Minnesota.
NOTE: Said vacation is intended to remove said existing 10.00 foot drainage and utility
easements over the entire outlot, with the new plat of "JABEZ" rededicating those 10.00
foot easements along 171 st Ave. NW, along Ulysses St., and along the most northerly line
of OUTLOT A. The westerly lines of OUTLOT A will be removed by the new plat. All
new lot lines will have the required drainage and utility easements dedicated at the time
of recording.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 06-0 I
WHEREAS, the property owner abutting the drainage, utility and sidewalk easements has
requested the City Council in a petition February 27, 2006 to vacate such
easements according to law; and,
WHEREAS, a public hearing was held on April 17, 2006, before the City Council at the
Elk River City Hall on such petition after due published and posted notice
had been given as well as personal notice to affected property owners on
April 6, 2006 and all persons interested were given an opportunity to be
heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve such
petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage and utility easements described as follows are hereby vacated:

entire perimeter of Outlot A, Leon Lefebvre Addition, as dedicated on the
recorded plat thereof, City of Elk River, Sherburne County, Minnesota
