SR 04-17-2006 City of Elk River REQUEST FOR COUNCIL ACTION Agenda Section Meeting Date En . eerin A ril17, 2006 Item Description Hi Wand Road Reconstruction Project Item Number Introduction At the April 3, 2006 City Council meeting a public hearing was held for the HigWand Road Reconstruction Project. After the hearing, the City Council ordered the project and the preparation of plans and specifications. In order to stay on the schedule laid outip. the feasibility study, there are additional actions the City Council is asked to consider. Discussion The schedule in the feasibility study recommended an assessment hearing be held on May 15, 2006. In order to establish that date for the assessment hearing, there are two resolutions the City Council will need to consider. The first determines the costs to be assessed and orders the preparation of the assessment roll. The second establishes.the date for the assessment hearing as May 15, 2006. As indicated at the public hearing, the proposed road section will be 32- 34 feet wide. The narrowed road with urban-style curb and gutter is an attempt to slow the speed of traffic and provide room for detached pedestrian facilities on both sides. The narrower road utilization MSA funds will require a "No Parking" resolution be adopted by the City. Financial Impact The feasibility study estimates the total project at $1,365,000. Approximately $305,500 is proposed to be assessed to the abutting property owners. The remaining $1,059,500 is proposed to be funded through a combination of Municipal State Aid funds, City Sewer Department funds, and Elk River Municipal Utility funds for the water portion. Council Action Motion by _ Second by _ Vote Follow Up S:\EngineerImprovProj\2006 Improvement Project~ \Highland Road\04 17 06 CC memo.doc RESOLUTION 06-_ A RESOLUTION FOR mE CITY OF ELK RIVER A RESOLUTION DETERMINING ASSESSED COST OF IMPROVEMENT AND ORDERING PREPARATION OF PROPOSED ASSESSMENT ROLL IN THE MATTER OF HIGHLAND ROAD IMPROVEMENT OF 2006 WHEREAS costs have been determined for the Highland Road improvement conSlstmg of a construction cost of $989,100, and expenses incurred or to be incurred by the City in the making of the improvement in the amount of $375,900, for a total cost of the improvement of $1,365,000. NOW, mEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. Based upon the City Assessment Policies, it is determined that the portion of this improvement to be paid by the City and not assessed to benefited properties is $1,059,500. 2. The portion of the cost to be assessed against benefited properties pursuant to the Elk River City Assessment Policies shall be $305,500. 3. The assessments shall be payable in equal annual installments and shall extend over a period of seven years, the first of the installments to be payable on or before the first Monday in January, 2007, with interest at the rate of 5.5% per annum from the date of the adoption of the assessment resolution. 4. The City Administrator with the assistance of the Project Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece, or parcel of land, without regard to cash valuation, as provided by law, and shall have available at the City Administrator's office a copy of the proposed assessment roll for public inspection. 5. Upon completion of the proposed assessment roll, the City Administrator shall notify the Council and schedule a public hearing upon the proposed assessment, causing notice of the hearing by publication and mail to be made at least two weeks prior to the hearing. Schmidt, City Oerk S:\EngineerhnprovProj\2006 hnprovement Projects \Highland Road\Res determ costs-order assess roll.doc RESOLUTION 06-_ A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ESTABLISHING THE DATE FOR THE ASSESSMENT HEARING FOR THE HIGHLAND ROAD IMPROVEMENT OF 2006 WHEREAS, by a resolution passed by the Council on April 14, 2006 the City derk was directed to prepare a proposed assessment roll of the cost of the Highland Road Improvement; and WHEREAS, the derk has notified the Council that such proposed assessment roll will be completed and filed in the Clerk's office for public inspection by the appropriate tnne. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. A hearing shall be held on the 15th day of May 2006, in the City Hall Council Chambers at 6:30 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City derk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and shall state in the notice the total cost of the improvement. The City derk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two prior to the hearings. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City of Elk River, except that no interest shall be charged in the entire assessment is paid within 30 days from the adoption of the assessment. The owner of any property may at any time thereafter pay to the City of Elk River the entire amount of the assessment remaining unpaid, with interest accrued to December 31st of the year in which such payment is made. Such payment must be made before November 15th or interest will be charged through December 31st of the succeeding year. Passed and adopted this 14th day of April 2006. Stephanie A. WHEREAS, TIllS RESOLUTION was passed this 17th day of April, 2006 by the City of Elk River in Sherburne County, Minnesota. The Municipal Cotporation shall hereinafter be called the "City", WITNESSETH: WHEREAS, the "City", has planned the improvement of Highland Road, State Aid Route No. 204- 13 7 -01 from County Highway 77 (proctor Street) to Jackson Road in the City of Elk River, Minnesota; and WHEREAS, the "City" will be expending Municipal Street Aid Funds on the improvements of this Street; and WHEREAS, this improvement does not provide adequate width for parking on both sides of the street; and approval of the proposed construction as a Municipal State Aid Street project must therefore be conditioned upon certain parking restrictions. NOW,1HEREFORE, IT IS HEREBY RESOLVED: That the "City" shall ban the parking of motor vehicles on both sides of Highland Road at all times, except adjacent to the City Park where an expanded parking lane will be constructed.
