04-28-1980 PC MIN ELK RIVER PLANNING COMMISSION ~ffiETING HELD AT THE ELK RIVER PUBLIC LIBRARY APRIL 28, 1980 Members Present: Commissioners Fox, Hinkle, Driessen, Tracy, and Lucas. Also Present: Herbert S. Adolphson, Community Development Director 1. Call Meeting to Order The meeting was called to order by Commissioner Fox at 7:35 p.m. 2. Minutes The minutes of the March 24, 1980 Planning Commission meeting were read and approved. 3. Agenda There were no changes to the agenda. 4. Robert Tacheny, Jr., Conditional Use Permit Robert Tacheny was present to discuss his request for a conditional use permit to operate a small business in his garage in School view Addition. Mr. Tacheny stated this small business would involve repairing glass windows and screens and also he would carry mirrors. He said he has agreements with Coast to Coast and Standard Lumber for pickup and would probably do 80 percent of the work out of these stores. Mr. Tacheny said he had talked to his neighbors in a 500 foot area and received no objections and submitted a list of 20 neighbors in favor of the business. Commissioner Lucas asked him if it was to be a part-time business and.Mr. Tacheny stated that it was and that he would be going to the stores about three times a week, plus whatever additional customers he picked up through advertising. Commissioner Tracy asked if he intended to have a sign in his yard and Mr. Tacheny said he did not intend to. Commissioner Driessen said it should be a quiet operation. The public portion was then opened. No one wished to speak for or against this proposal. The public portion was then closed. CO~~fISSIONER LUCAS MOVED APPROVAL OF THE CONDITIONAL USE PERMIT WITH A TWO YEAR RENEWAL CONDITION. COMMISSIONER TRACY SECONDED THE MOTION. MOTION PASSED 4-0. 5. Timothy P. Corpe, Rear Yard Variance Timothy Corpe was present to discuss his request for a rear yard variance for an accessory building in his backyard. Mr. Carpe said he would put up a garage type building, 22x22, frame structure, lap siding, and six feet from the rear lot line. He said he would use this building to store his boat and snowmobiles. Mr. Adolphson stated the only condition would be that there be no openings such as windows on the backside. Mr. Corpe Page 2 April 28, 1980 said there would no't be. Commissioner Fox as.ked if he had discussed this with his neighbors and he said there were no objections. The public portion was then opened. Richard Vagts, a neighbor to the east said he has no objections to the proposed building. The public portion was then closed. COMMISSIONER HINKLE MOVED APPROVAL OF A REAR YARD VARIANCE DOWN TO SIX FEET FROM THE REAR YARD LINE. COMMISSION LUCAS AND DRIESSEN SECONDED THE MOTION. MOTION PASSED 4-0. 6. G.M. Investment - Jack Menkveld, Conditional Use Permit Jack Menkveld was not present to discuss this request for a condtional use permit for a used car/truck business. The public portion of the hearing was then opened. Alice Quist stated she was not in favor of this proposal. She stated the Mr. Menkveld was known for applying for one thing and then operating something else. She also said he was suppose to have moved off the Ar-Mon property years ago, and gotten rid of the pigs; now the pigs are back and he is building some log buildings on the property south of Highway #lO. She also stated the used car lot next to there was neat and clean and nothing but used cars. The public portion was then closed. Commissioner Tracy asked Mr. Adolphson about a number of letters sent to Menkveld dating back to November 1979. Mr. Adolphson said the City was trying to get Mr. Menkveld to clean up the property and that Mr. Menkveld finally came in and made the application for the conditional use permit and nothing has been done since a March 7, 1980 letter regarding cleanup. Commissioner Fox stated there has been no compliance on Mr. Menkveld1s part. Mr. Adolphson stated if he does not comply, it will be turned over to the City Attorney. He also stated that the City had written to Hardrives, Inc. of St. Cloud regarding their contract with the Ar-Mon Properties for construction, site grading, streets and drainage. COMMISSIONER DRIESSEN MOVED THAT THE REQUEST FOR THE CONDITIONAL USE PERMIT BE DENIED. CO}frfISSIONER LUCAS SECONDED THE MOTION. MOTION PASSED 4-0. 7. David Hauan's Discussion David Hauan brought up his objections to being shut down when H & S was leveling a hill on his property. He said he questioned the Commission's policies and that it was half done when he was shut do\vn and it now presents an eyesore. The Commission said that he has to go through the proper channels and get a license, as it is considered mining, and also a conditional use permit. Commissioner Fox stated that these rules and regulations were set up for the benefit of the entire community. 8. Adjournment The meeting was adjourned at 8:10 p.m. ~~ . Herbert S.
