1. Call Meeting to Order
The meeting ,.ras called to o~,der by Com.rnissioner Fox at 7: 33 p.m.

The minutes of the May 27, 1980, Planning Co~mission Meeting were read and
approved.
3. P_genda
There were no changes to the agenda.
4. Gerald Santerre, Set-Back Variance
Gerald Santerre was present for the public hearing requesting a set-back variance
from side street for an addition to his garage located on Concord and Mississippi
Road. The public hearing "ras then opened. 1\10 one ,.rished to speak on this
issue. The public hearing was then closed. ~tr. Santerre presented a petition
in favor of this proposal signed by his neighbors. He said the addition would
be 15 ' by 26' w'i th '\.rindo'\.rs on the street side and \.rould be added to the
existing garage. He said he needs the additional space to park a company
vehicle. Co~missioner Zabee asked what the side variance would be and if the
garage extends out. ~rr. Adolphson said the requirement is 32' and he has 25',
so it is a 7' variance and that the garage would be in line with the house.

5. Lloyd P~derson, Proposed Zone Change to 1-1
~tr. Lloyd Anderson was not present until later in the meeting. ~tr. Carroll
Welte, vrho plans to purchase the 3 acres located south of Highway #10 at the
intersection with Waco Street (on the west side) was present. He operates
Instantop, Inc., vrhich manufacture pickup covers. He said he would propose
to put up a pole building or whatever type of building that was required.
Co~missioner Fox asked if there was any reason he wanted that particular area
as it would require a service road access and that vrould not leave much to
build on. tIT. Welte stated he vTould want to maintain a highway location
becuase both retail and wholesale would be better, but that vias the only reason.
COID~issioner Lucas was opposed to changing the land to industrial. The
Commissioner recommended not to change the zoning.

6. Paul Carton, Proposed 1-2 Addition
~~. Carton was not present for this discussion. The proposed addition is a
four acre area located west of the NS \ Section Line of Section 28, north of
CS~B #1, east of BNR's branch line and south of I93rd Avenue. The Co~mission

7. Gary Santwire, Proposed P.U.D.
I</jy. Sant1.rire said this property is 30+ acres north and 'e'ast of Faith Fello\.rship
Church, east of Highway #169, and south of Elk Hills. ~~. Santwire presented
a letter he had \vritten to Faith Fellowship Church with their reply at the
bottom in favor of this proposal. He also presented drawings on his proposed
development. One outlot would be taken up with road and entrance gates, etc.,
the highway strip would be co~mercial, then multi-units and tovmhouses, and
behind} single family units adjacent to Elk Hills. Since the drawings vTere made
I>1r. Sant"\.rire \'Tould like to change to a fe1.r more single family and multiple
units and less to~mhouses. ~IT. Santwire vTould propose that the residential
roads would tie into those roads existing in Elk Hills, with no connections
to the multiple or commercial areas. COllmissioner Fox said that there would
be two streets adding four lots onto each street. ~IT. Santwire would also
propose a sign directory to get this traffic over to #13 and out as fast as
possible. He said he did not have all the ansvrers as to what should go into
this proposal, but liked the concept of planning the whole development at once
rather than changing zoning. Cow~issioner Fox said there would be some restrictions
as to the type of businesses allowed in the cOID~ercial area. lftr. Santwire said
fast food restaurants ~rould be a possibility and asked what the Commission
vTould like to see in that area. Commissioner Fox said he would not like to
see a string of McDonalds, Burger King, etc. or used car dealers. }rr. Santwire
said that Gene Kreuser (former o~mer) has retained, in their agreement, land
for a garden store. Coro~issioner Hinkle asked about neighbors objections to
sewer and vrater. }tr. Santwire said the reports so far were vague. There also
would be the possibility of having a lift station and/or connection with the
manhole on School Street. Co~missioner Zabee said he had no objections to the
P.U.D. concept itself. Commissioner Lucas was concerned about the cow~ercial
area within the P.U.D. and would like to see it limited. C01~~ISSIONER ZA~EE

8. Vicker's Riverglade Park, Informal Discussion
Larry Koshak presented a preliminary plan for only the City of Elk River. tie
said this plan is 53.56 acres, basically it is the plan presented before only
with Ramsey excluded. It has 12 - 2~ acres of single family lots and proposed
that the zoning be changed from A-I to R-l, and the 1 acre plus be changed
from A-I to C-3 with restriction as to type of businesses operated. The only
difference from the last plan is the road connected in with th~ largest section.
The developer would like to proceed vrith this part of the plan as Ramsey's
portioll is in the "critical rivers area" and at the present the requirement
for lots is 10 acres. Ramsey is going before the Enviromental Quality Board
but this may take a year to 18 months. Co~missioner Lucas asked about the

soil tests and ~IT. Adolphson had not seen them yet. ~tr. Koshak had the tests
there and had a circulation test rate of .8 per inch at a 24" depth. He said
it should be sufficient for a standard septic system. ~IT. Koshak stated the
grading in the residential area 1fould be minor, but cownercial would require
fill because of the slope of the land. Some of the roads would have a standard
grade of five percent. Commissioner Fox asked how many lots it could be sub-
divided into for future sewer and water. }tr. Koshak said about 48 lots and also
there was a change from 6 to 4 lots along the river. COID~issioner Fox asked
about coordinating where the house was to be built on the lot so that these
could be subdivided in the future.
9. Rick Foster, Proposed P.U.D.
~~. Foster presented a sketch of Ridgewood East 4th Addition to give the Co~mission
an idea of his proposal. The residential homes would all have private driveways
maintained privately. The P.U.D. is 17~ acres dividing into possibly 100 units.
Each home o~mership association would have 20 families, operated separately.
Commissioner Fox asked about storm sewer runoff. ~tr. Foster said he had done
some testing in the area. Co~missioner Driessen said it would be natural for
se1fer and water. Commissioner Zabee asked about the price range of such a
system. ~IT. Foster didn't know the cost. CO~TI~ISSIONER DRIESSEN MO\~D TO RECO~wmND

10. Informal Discussion with East Side Concerned Citizen's on P.U.D. '8
~IT. Hipp and Estelle Gunkel of the East Side Concerned Citizens appeared and
asked to get some answers to their questions about P.U.D. IS. urr. A~ton Hipp
asked the Co~mission to explain what a P.U.D. is and what stages the development
proceeded. If the co~mercial area could be developed right away before the
tovmhouses and apartments, then residential so there would be no buffer
between co~mercial and residential areas for several years. The Commission
stated that it could be dictated so that the cOID~ercial and to~mhouses had to
be put up at the same time. He also asked about what the procedures was for
getting a P.U.D. approved. P~so, if a person buying a house in a P.U.D. area
could expect that plan to stay the same and not change. Cow~issioner Fox said
he could not speak for future Co~missions or Councils. ~tt. Hipp asked if there
were any proposals before the Co~mission to develop his area. Commissioner Fox
said he knew of none. Mr. Hipp also asked about the procedure for notifying
residents of a proposed development. Est~lle Gunkel also had some questions on
the P.U.D. issue. She said she was not notified of this ordinance change. At
one meeting she asked Zack Johnson if there were any proposed changes for her
area, but was given a vague answer and two weeks later read in the paper, the
land was to be a P.U.D. She asked about if it has to have sevTer and water.
Ms. Gunkel also stated in the ordinance on Page 11, ft~ticle 7, it says a P.U.D.
should not adversel:l effect existing schools and she did not see h01'T that 1'ras
going to be possible. She was also concerned as 1vas ttr. Hipp about the time
plan on the construction of a development. Commissioner Fox said it was hard to
predict as to the completion time of a P.U.D. It could be done in two years or
take up to five years. She also wanted to know if it was possible to approve
the shopping center (citing George Dietz's proposal as an example) and not do
anything about developing the rest. Co~missioner Fox said in a P.U.D. the entire

area has to be planned out and presented to the Commission. Ms. Gunked also
wanted a clarification about the public hearing notice published in the news-
paper and if letters were sent out. Elaine ~nderson of the Sherburne County
Star News said she would be willing to put a public notice box on the front
page of the paper with a general description of the area. Ms. Gunkel also
wanted to know how the P.U.D. 's originated, if it was Zack Johnson's idea or
the Planning Co~mission or the City Council's idea. She was told it was a
joint effort of all parties involved. Also, she wanted to know if P.U.D. 's
could be changed to R-l and if it was easy to do. Co~missioner Fox said it
could be done. ~~. Hipp asked about School Street and if it was to be widened.
Mr. Adolphson said at some time in the future it would have to be, but that
the Planning Co~mission does not handle that.
11. Joe Bailey, Service Road through Proctor
~tr. Joe Bailey also appeared and stated he was selling his house and asked
about the possibility of a service road that was to go through Proctor and
along Highway #10. Cow~issioner Fox said he had not heard and the road
right of way was given to the City.
