1. Meeting Called to Order
The meeting was called to order at 8:12 p.m. by Commissioner Fox.
2. Agenda
There were no changes to the agenda.
3. Consideration of NevT Zoning Ordinance and New Zoning l~ps
r~. Robert Middaugh and Vtr. Zack Johnson were present for this discussion. ftt.
~liddaugh highlighted the changes set forth in a three page memorandum dated
June 25, 1980.
Page 1, #2 - COID~issioner Lucas asked what was to prevent someone from putting
a mobile home on a 4City lot and what happens if the ovmer loses his job and
and do we throw him out in six months. ~~. Middaugh said it would have to be
a conditional use, temporary trailers, not longer than six months and not living
quarters. COID~issioner Lucas asked if we should not be stricter rather than
have to hassle things out later. Co~missioner Rootes co~mented that he would
not like to have things tied dOvm too much, a special condition being for a
specific ordinance should be more elastic. Co~missioner Fox said it would be
basically for sales offices not as residential or as a temporary when building
a house. COID~issioner Lucas said he had known houses to be under construction
for three years. Co~missioner Fox said that would be revievTed in six months
and the building site inspected and if no progress \fas being made, then the
permit would not be renewed. r~. Adolphson stated he gets quite a n~mber of
calls in regard to mobile homes.
Page 1 - ~~. Middaugh stated the rest of the uses were left out for one reason
or another. Commissioner Lucas asked if it was intended to develope trailer
campgrounds in RIA and RIB. ttr. Johnson stated that in these areas primarily,
the zones were for existing campgrounds. COID~issioner Lucas asked why the
camps were not considered as conditional use. ~~. Johnson said that was up to
the City. He also felt RIA was more appropriate and local residents might
object. In RIB area, COID~issioner Fox stated this was basically river frontage
on most of them. ~~. Middaugh said the trailer park should fit in with the
surrounding neighborhoods. COI~~ISSIONER LUCAS MOVED TO STRIKE THE RIB.
CO~@~ISSIONER TRACY SECONDED THE MOTION. MOTION PftBSED 4-0.
Commissioner Hinkle had a question on feedlots, conditional use. tie felt if
someone wanted to invest in one, he would vmnt to have more of a cOID_mitment
than two years, perhaps six years, but could also see the City wanting to keep
a handle on it's operation.
~IT. Middaugh stated on other uses, an application for a day care center was
made that has more than ten children. ~~. Johnson suggested it be made a condition-
al use in the R3, R4, and C2 zones. Commissioner Fox asked about any state

ordinance regarding day care or preschool center in that they can set up where
they please. lf~. Johnson stated he was only aware of ten or less permitted in
a single family zone. lIT. Adolphson stated this would be a preschool center
operating from 9:00 a.ill. to 3:00 p.m. with as many as 20 children. COID~issioner
Fox suggested the ten or fewer children day care centers could go into Rl, and
over ten children go into R2, R3, and Cl, with a conditional use permit.
Commissioner Lucas stated that as the City grows we are going to n:eed more
preschool centers. CO~IT~ISSIONER LUCAS MOVED TO RECO~$illND ADDINT THE DAY CARE
CEN~ERS FOR TEN OR MORE CHILDREN BE ZONED R3, R4, AS CONDITiONAL USE. CO~~lSS-

Page 1, Item #5 - Cow~issioner Lucas asked what was meant by horticultural use.
~rr. Middaugh and ~tr. Johnson explained this.
Page 2, Item #9 - ~tr. Middaugh explained this and there 1fas no discussion on this
item.
Page 2, Item #11 - COllmissioner Fox asked if it was desirable to have automobiles
only service on the highway, no truck stops permitted. I~. Johnson suggested
replacing automobiles with motor vehicles or eliminating it completely, which
\fould then allow trucks, sno~~obiles, etc. Co~missioner Fox stated going back
to vehicle service stations. Commissioner Rootes suggested all motor vehicle
service stations.
Page 2, Item #12 - Co~missioner Lucas asked if there should be a size limitation
on the warehouse as a 100,000 square foot building could be put there. t~.
Johnson explained that had already been determined previously.
Page 2, Item #19 - Commissioner Lucas did not see how anyone was going to single
out a building area. Cow~issioner Fox cited the land ~There his house is built
would not be considered buildable and asked that if an adequate sewage system area
could be proved before a building permit could be issued. He also stated he
vTould like to keep A-1 zones as five acres and subdivide in the future. COID~is-
sioner Hinkle felt that there is not enough land to go around and five acres seems
like too much land for some. Commissioner Lucas asked about providing adequate
fire and police protection for these areas if they were 2~ acres. Co~missioner
Fox stated that the 2~ acre buildable lots would not benefit the farmer.
Co~missioner Lucas was concerned about discriminating against the ovmer with the
larger lots, as he would not be willing to pay the same price per acre as the one
who has 2~ acres. Commissioner Tracy and COID~issioner Hinkle liked the concept
of defining buildable areas. COID~issioner Fox expressed his concern about ~That
would happen to unbuildable areas. ~IT. Johnson explained that the land would
be ovmed by someone. Co~missioner Fox stated he could see no reason to change
do~m to 2~ acres, but it might be eliminating some people by the 5 acre.
COID_missioner Rootes stated we are here to protect the public not to cater to the
developers. COID_missioner Hinkle mentioned a neighbor who has 8 acres and only
vmnts to have 2~ acres and that there would be no way she could see the land
with a 5 acre restriction. CO~n~ISSIONER LUCAS MOVED THAT THE PLM~NING CO~~~ISSION
RECO~~~ND Tti~ DELETION OF ITE~ffi 19 ft~D 20 TO THE CITY COu~CIL.
Co~missioner Fox saw problems with the buildable on R-l and said we should go with
the five acres and forget the buildable portion. Cow~issioner Rootes agreed.
~tr. ~tiddaugh cited problems in the Coon Rapids area with large acreage and that
some people could not afford to keep it up. A~so, perhaps the buildable site
should be something that is determined in the building standards. CO~~4ISSIONER
TRACY SECONDED THE MOTION. MOTION PASSED 3-2, COl~1ISSIONERS HI~~LE A~D ROOTES
OPPOSED, COr@~ISSIONER TRACY, LUCAS, P~~D FOX ~~RE IN FAVOR OF THE MOTION.

Maps 7 and Be.

~fup 7 - Commissioner Lucas stated from the study there was not enough demand
for co~mercial along the highway strip. Com~issioner Fox agreed. ~tr. Johnson
said they were looking to the future and should be ready for it. Also, it
1vould leave the R-l until later. r~yor Madsen stated the State of ~linnesota
would fund a half million dollars on the sewer. Co~missioner Fox stated why
not consider the entire area now as a PUD. ~~yor ~fudsen said there are four
or five o~mers and they may not be ready to plan the whole area. Commissioner
Rootes said it could be zoned PUD, ending on County Road #30, and include
the whole area all the way to the lake. Co~missioner Tracy said he would like
to see it PUD. Co~missioner Lucas said we could start the PUD, 1330 feet (\ mile)
from the drawn line to 1330 feet (~mile) north of County Road #30, and leave
the rest as R-1B. ~tr. Johnson stated one Oviller does not have the 20 acres
required. Commissioner Fox said it was done in other areas. ~tr. Johnson said
that will have to be changed. COID~issioner Fox said perhaps we should see how
the present PUDs vTork out before designating more. ~tr. rfiddaugh commented
on that there might be undue stress on forcing people to buy 20 acres in order
to develop the PUD. t~yor Madsen suggested that the staff take this matter
up with the attorneys. t~. Johnson said he would get back to the Planning
COnLrnission \.Ti th revised maps.
~~p 8e - lf~yor ~~dsen said that it also does not meet the 20 acre test.
Commissioner Fox was concerned about industrial on two sides. I~. Gary Santwire
had a question on the co~mercial, ~ way to Third street. This area is already
zoned C, so he assumed 532 and 534, on Third street being in co~rnercial zone can
be zoned.

Item #1 - Commissioner Rootes asked if offices would be allowed in I-I areas.
Co~rnissioner Fox stated that Instant Tops only desired a highway location, not a
particular area. COID~issioner Lucas stated property might not be available on
the eastern end of Highway #10 or it might be too expensive. Commissioner Fox
