Adolphson, COID~unity Development Director 1. Meeting Called to Order The meeting was called to order by Co~missioner Fox at 8:00 p.m. 2. Minutes The minutes of the June 28, 1980 Planning Commission meeting and the July 14, 1980 special meeting were read and approved. 3. Agenda Item #7 - Continuation of the July 14 meeting on zoning ordinances and maps was added. 4. Barbara Bjorklund, Conditional Use Permit to Operate a Preschool Center Barbara Bjorklund vias present for this public hearing. She said this would be located in Peterson's Addition. At full capacity there could be 20 children at a morning and afternoon session operating four days per week, from approximately 9:15 to 12:00 and 1:00 to 3:45. This would be concurrent with the normal school year. She said she might want to extend to additional classes in the afternoon if interest was such. Commissioner Lucas asked if there was 20 maximQm at each session. ~trs. Bjorklund said there could be 20 children per session with a total of 40 children per week. The public portion was then opened. Elaine Larson asked about the qualifications of ttrs. Bjorklund. She said she is a certified elementary teacher with kindergarten instruction and would be licensed by the state which is pending. She would also have to have a child care assistant working with her so there would be the required 1-10 ratio per child. ~~s. Bjorklund also presented a petition signed by her neighbors in favor of this preschool center. The public portion was then closed. Co~missioner Lucas asked if this involved remodeling of her house. ~trs. Bjorklund stated she has an unfinished walkout basement that they intended to finish. ~tr. Adolphson stated he had been out there and given her the requirements to bring it up to code. Co~missioner Lucas asked about a fenced yard. She said she was not sure when it vffiS required by the state, but said this is a very structured type of situation and unlike a day care, the children vTould not be outside playing for extended periods of time. The Co~mission asked about the traffic situation so far as dropping off and picking up the children. She said they are located on five acres approximately 250 feet off of Ogden Street. She also said the children vTould be mostly four year aIds and some three year olds and would be following the school year. Larry Koshak, Preliminary Plat Hearing ttr. Koshak was present for this hearing. He presented a preliminary plat of 53 acres, currently zoned Al and is requesting it be changed to C3 and Rl. The C3 co~mercial is 19.1 acres with lot sizes of 1 plus acres along and adjacent Page 2 July 28, 1980 to US High"toJay 10. The residential is 34. 5 acres "t.ri th 12 single family lots - 2~ acres in size. He said the project has approximately 364 feet of bitu..11linous paved streets \.rith a loop system connect.j~ng' to__adjacent 40 some acres in Ramsey. Ramsey at present cannot make any planning because of the Metro Council problem, but he felt that the Elk River portion being platted would help them with the Metro Council. Also, he would request that if they were able to bring in Ramsey before final plat they would eliminate Adams Street looped from 153 and 156 along east boundary line. He said drainage would be into the river with a permit required from the Corps of Engineers. The co~mercial would drain into the existing ditch, which would be upgraded, and then to the river. He said little grading would have to be done to improve the residential lots, but the commercial would need grading to make buildable areas. The street grades all met the maximum grade. There would be t1.ro accesses -- one existing, Adams Street to High't.ray 10 and t't'TO accesses to Cleveland then to Highway 10. The soils tests taken showed perculation tests on Lot 3 Block 4 a rate of .8 min. per inch measured in 24 inch fine sand rising. The test proved soil was adequate for conventional drainfield and septic system. Co~missioner Fox then opened the public portion. Bob ~liddaugh asked what I~. Koshak had in mind for the C3 use. tIT. Koshak talked about covenenting to same type of use that Ramsey would, but it probably would be dry industrial sites. lftr. ruddaugh asked if Ramsey had already zoned their portion. ~tr. Koshak said the Metro Council wants to zone it all residential with no co~mercial. ttr. ~tiddaugh also told him that the C3 area would be .zoned I-I. Commissioner Fox asked if ~IT. Koshak sa~T any problems with it being so zoned, and ~rr. Koshak said he saw no problems as he was interested mostly in small retail, convenience stores vTith no high water usage. Cow~issioner Lucas asked if this would generate enough traffic to provide enough business for the com..rnercial as some of it "\.]"ould not be seen from the highway. ~tro Adolphson reco~mended the streets in the commercial be completed as city-ty~e streets with curb and gutter including the north part of Clevelando The remaining streets could be the rural type section. 1tr. Koshak stated he had not intended to pave Cleveland and asked about what to do about the o~mership as half was o~med by others. The Planning Commission said that ~Tould have to be taken care of by the City Council. COID~issioner Fox felt it should be blacktopped as it vrill be a multiple use street and would benefit the people and the cOID_munity. r~. Z. Johnson felt Cleveland should be paved and an assessment hearing held as to the financing of it. lftr. Adolphson indicated an outlot off of Ad~ms street that should be eliminated because it would just be something extra to be maintained by the City. He said ~~. Koshak should also provide for the southern street easements now so that in the future subdivisions can be made with no houses built in the way. Continuation of July 14 meeting discussing zoning ordinances and zoning maps. ~~. Zack Johnson presented his revised maps. He said the first questions were about the PUD on the east side of to~m and problems created covering more than one o1.mership. He recommended extending the PUD east across High'\.ray 169 Page 3 July 28, 1980 to the east section line of Sec. 34 and south to Fifth Avenue. The south part of the PUD, west of Highvmy 169, be returned to previous plan under R4 zoning. Commissioner Fox asked if there were any problems with Fourth Street in that ~ is in the C2 and ~ is in R4. ~~. Johnson saw no problem. Commissioner Driessen asked about Lot 360 on Holt and thought that the ovmers there might acquire that property and we would be splitting zoning there. V~. Johson stated it would be split from along back property line and it has to be split someplace there. ~tr. and ~trs. ~nton Hipp (of the East Side Citizens Group) asked about PUDs and why 20 acres. Vtr. Middaugh explained this to them. ~~. Hipp said that he felt a developer would not be interested in talking to a neighborhood group after it had all been platted. He also felt that there was less control and that they had less say as to what went on so far as public hearings. The procedure was again explained to him by lfrr. ~tiddaugh and the Planning Cowmission. Court House ftxea - ~tr. Johnson suggested that in terms of land use the southern 200 acres should be planned for single f~mily lots with RIB zoning. The Court House has 20 acres which falls into C2 zoning. He discussed the possibility and probability of increased activity at the Court House at full development with the number of jobs created and suggested the 20 acres on the west side of the Court House be zoned C3. Also, any development along Highway 10 on the west should be required to face on a service road. South of Highway 10 and east of the Court House should be higher density land use, PUD with 40 acres toward the fairgrounds. He also felt a developer should be restricted until ade~uate services can be provided and some of the problems worked out in that area. ~rr. Middaugh indicated on the Zoning Map, Custom Motors Salvage Yard and suggested changing it to RIB so that this could not be expanded and also so that other industries \'Tould not have a "foot in the door" in that area. He also said Custom Motors would be able to continue its operation, but would not be able to expand. Commissioner Driessen expressed his concern about the zoning change where his house is located and if it were destroyed would he be able to rebuild. COID~issioner Fox suggested it would have to go through a zone change before he could rebuild. Paul Carton discussed the four acres he would like added to the I-1 zone. This property is located north of Co. Road 1, east of the railroad tracks. He asked about building permits for there and also felt that the area should conform with that near it. Commissioner Fox felt that changing this to I-I with the 5\.ramp bet1'Teen it and the residential area vTould prov-ide a good buf:fer zone. ~~. Carton said he could not see anyone wanting to put a house on that property. ~tro Middaugh said there should be a clarification on conditional use for C-3 inv-ol ving light manufacturing as to \.rhether it \,ras sale and manufacturing ; it should require both sales and retail including manufacturing as it would be both. Commissioner Fox recoID~ended the language should be changed. Commissioner Lucas said he did not like the vTord manufacturing as it could be twisted around to mean something else. Quist asked about the co~mercial on the west end of Highway #10 as to hOvT far it extended and vrhat areas it included. r~. Adolphson explained this to her satisfaction. Languages-recommended changes. Page 9 - Item 900.106A, add the words R-3 district, Items Band C; R-2 district, Items Band C. It em 7A - the same as B multiple family dwellings containing at least five dwelling units. Page 11 - Item 12-B III - add the words under unified control or o~mership. Memorandum to Planning Commission on July 11, 1980. Item 4-Trailer parks delete the reference to RI-B. Add day care for 10 children to R-3, R-4, C-2 zones, conditional use fpr more than 10 children. Item 11 - Change definition to motor vehicle service stations to include trucks. Items 19 & 20 reco~mended both items be delected, original language remain and delete buildable. Page 3 - Substitute new language that was stated in memorandQm dated July 11, 1980 Item 24 - ~~. Middaugh explained two changes in building permit and threes changes in conditional use permits. Language on unified ovmership of all single o~mership on PUD. Co~missioners Lucas and Tracy saw no problems. Commissioner Driessen did not see much difference from one family and two family dwellings. Conmissioner Fox suggest. ed R-2B and C, and R-2C. lftr. Johnson reco~mended dropping the tvTO family R-2 from the R-4 district Item A, would read: Uses permitted in the R-3 district, Items B & C and R-2 district, Item C. Discussion on Change from 5 acres to 2~ acre: City COQDcilman Hank Duitsman was there to discuss this matter. Conmissioner Fox vms concerned about providing adequate services to these areas if developed before, Page 5 July 28, 1980 the City could provide adequate police and fire protection. CounciLman Duitsman and ~rr. ~fiddaugh felt vTe were elminating too many people from developing in the area and Councilman Duitsman stated he felt we would have adequate services for those areas. Commissioner Fox stated the Planning Commission was here in the interest of the people and felt the development should be closer to the City. Commissioner Tracy felt we should protect the people (farmers) who want to hang onto their land. Commissioner Fox also stated that these changes should have been discussed 18 months ago and nobody seemed to be interested then, and also felt there were lots of other 2~ acres areas available.
