1. Meeting Called to Order
The meeting was called to order by l~. Adolphson at 7:30 p.m.
2. Elect Chairman
Co~missioner Tracy nominated Commissioner Dreissen. Co~missioner Driessen
declined the nomination and then nominated Co~missioner Hinkle. Co~missioner
Busch moved to close the nominations. Co~missioner Kreuser seconded the
motion. Cownissioner Busch moved to elect Commissioner Hinkle as Chairman.
Co~missioner Tracy seconded the motion. Motion carried 4-0.

Commissioner Tracy read the minutes of the August 25 meeting. The minutes

5. Max A. Maue, Conditional Use Permit (Public Hearing)
~IT. ~~ue was present for this public hearing for a conditional use permit
to move a trailer house on his lot ~Thile constructing his home. lftr. Adolphson
stated that Ytr. r~ue has a building permit for a three-stall garage and
has the septic system in, but not the ~Tell, and has not applied for a
building permit for the house. ~~. Maue said this property is located at
19215 Tyler Street off of nrin Lakes Drive and County Road 13, and is 14
acres in Section 26. The COID~ission was unclear as to when he ~Tould begin
construction of the house. r~. Maue stated he would build the garage begin-
ning in October and live in the trailer until he could begin construction
on the house in the fall of 1981 or spring of 1982. He said he intends to
have the mobile home on the house site and then pull it off to ~he side and
still live in it while constructing his house. Commissioner Kreuser felt it
would be better to have the trailer off to the side right away and not on the
house site, and it sounded like a permanent situation to him. The public
portion was then opened: vlally Fox questioned the necessity of moving the
mobile home in now if construction of the house was not going to start until
next year. He recoID~ended to the Cow_mission they issue a conditional use
permit on a six-month renevTal basis only. The public portion was closed.
COID~issioner Hinkle felt if a six-month conditional use permit were granted,
nothing would be started. COID~issioner Tracy asked when he would move the
trailer on the property. ~~. Maue said around the first of October, as he
had to be out of his present residence then. Conmissioner Driessen asked
about the possibility of moving to a trailer court. lftr. ~~ue said he could
not afford to do that. CO~n~ISSIONER DRIESSEN MOVED TO DECLINE THE REQUEST

6. Harold Dobel, Conditional Use Permit
~rr. Dobel was present for this request for a c~nditional use permit for a
house trailer to be moved onto his farm for his grandparents to live in.
His property is located at County Road 35 in Section 30. The trailer is
presently located on his brother-in-law's farm vThich is being sold. tilS

7. JOD~ and Louise Kuester, Side Yard Variance
~tr. Kuester was present for his request for a side yard variance to attach
a garage to their house. This property is located at Jackson and 169. He
intends to attach a garage to the house, and the north1.rest corner \.rould be
between 7 feet and 8 feet from the line, and because of the property line,
the NE corner would be 17 feet. He said there is a row of pine trees on his
property that would act as a buffer, and the house to the north is for sale

8. Charles Christian, Final Hearing Davis Woods Addition
Jim Klein, a representative for Charles Christian, presented the final plat
on the addition. ~IT. Adolphson stated the old Co~mission reviewed the
preliminary plat. The streets remain the same as discussed before, and the
staff savT no problems with the streets. Cow~issioner Hinkle asked about the
connection of Pasqual Street with Rabbit Hills. This had been changed to
Queen and 1-Tould end in a "T". The COIr1J11ission felt there should be some
provision made for a connection between Davis Woods and Robbit Hills so
they are not landlocked. ~tr. Klein felt this should be included in the

9. GarY,Santwire, Preliminary Hearing for P.U.D.
Gary Santwire and Zack Johnson were present for this discussion. Zack Johnson
presented t1'TO dra1"ings \.ri th some changes made a.t the City Council meeting.
He said there \'Tould be no through street. connecting to Fa1.m Drive., The
Cow.mission asked about maintenance of this '\olithout a thru street., r1r. Johnson
said the problems created for maintenance would be offset by the avoidance
of extra traffic on Fa1fn Drive. The grade of the road was discussed, and
~tr. Johnson felt it might be a good time for this to be corrected. The
nQmber of d'\oTelling units was changed to 134. There would also be a larger
general retail area of about three acres in the commercial section. The
service road along 169 would be consistent with the zoning ordinances.
tIT. Adolphson said he could see problems with the present plan for the road,
so far as snow removal and drainage, as the ditch was not adequate for this.
~tr. Santwire stated he was \filling to do anything the City recoID~ended so far

as the road surface was concerned, but had only a 50 foot easement to work
with. ~tr. Johnson stated the grades of the roads were from 2.3% at one cuI
de sac to 1.1% to 1% at lowest end. l~. C. Hanson brought up his concern
regarding the amount of traffic that would be generated from the 134 dwellings
(approximately 130-200 cars), and his house being at the exit where all of the
traffic is directed. He said he has two little girls and is concerned for their
safety and his property. He suggested perhaps angling the road to the left.
r~. Santwire and ~1r. Johnson vTere not sure of the feasibility of that, but
tIT. Santwire suggested they meet to work out something. ~~. Johnson went on
to the drainage which ~rould drain into the existing ditch along the highway.
P~so, there vTould be a private lift station accessed to the benefiting four
co~mercial lots, but maintained by the City. ~tr. SantvTire stated he did not
vrant the neighboring property ovmer to think the drainage would be into the
pond on his property. The neighbor said he saw no problems with it. Commissioner
Driessen asked about the height of the tovmhouses. ttr. Johnson said they
~rould be about 18 feet and also the apartment houses would be 18 feet.CO~n~ISSIONER

Co~missioner Hinkle and ~tr. Adolphson discussed the possibility of holding a
\forkshop to acquaint the new members and reacquaint the old members with the
new ordinances. It was decided to meet on Tuesday, October 7 at 7:30 at the
City Hall.
