Call Meeting to Order Chairman Tracy called the meeting to order at 7:40 p.m. 2. Agenda COMMISSIONER PEARCE MOVED TO APPROVE THE AGENDA FOR THE JUNE 28, 1982 PLANNING COMMISSION MEETING. COMMISSIONER GUNKEL SECONDED THE MOTION. THE MOTION PASSED 5-0. 3. Minutes COMMISSIONER PEARCE MOVED TO APPROVE THE MINUTES OF THE MAY 24, 1982 PLANNING COM- MISSION MEETING AS PUBLISHED. COMMISSIONER GUNKEL SECONDED THE MOTION. THE MOTION PASSED 5-0. 4. Consider Barthel PUD Preliminary Plat and Conditional Use Permit Chairman Tracy indicated that the Planning Commission has dealt with this request at past Planning Commission meetings. At the June 21, 1982 City Council meeting, the City Council referred this request back to the Planning Commission for one final look. The City Council will deal with this request at their July 12th, 1982 City Council meeting. Chairman Tracy discussed the City Administrator's memo to the Planning Commission of July 25th, 1982. Chairman Tracy further indicated that he would allow the Barthel people to address the Planning Commission. Chairman Tracy also indicated that the public would be allowed to address the Planning Commission and the Barthel people regarding any questions they had concerning this request. Robert Middaugh, the City Administrator, indicated that Barthel had a new proposal to present to the Planning Commission at tonight's meeting that could possibly answer some of the concerns and questions staff had regarding their previous proposala The City Administrator further asked the Planning Commission if the Barthel group could present their proposal first before he discussed his memo. Marlin Hutchinson, Barthel, indicated that Barthel did have a new proposal to present tonight. Before Mr. Hutchinson gave the particulars of the new proposal, he indica- ted that he would go through some of the various studies Barthel had done by their people and explain again where Barthel came up with some of the figures in their studies regarding the size of shopping center being proposed. Planning Commission Minutes June 28, 1982 Page 1'010 Ms. Laura Manske, Barthel, discussed the new proposal they were presenting to- night. Ms. Manske indicated that they are reducing the size of the shopping center. Barthel did three things: 1) They removed another anchor tennant, leaving only two anchor tennants (a drug store and a grocery store). 2) They have removed the mall. They n01;v have 1;\That is called a "strip center". 3) They are also trying to negotiate with the lando\vuer to try to arrive at some kind of arrangement so Barthel can defer some of the cost of the center. Ms. Manske indicated that they have reduced the size of the center to 51,000 square feet. Ms. Manske discussed the purpose of the shopping center. This type of shop- ping center is called a neighborhood shopping center, the smallest kind of shopping center. Some types of stores anticipated in the center are gift, card, insurance, eyewear, shoe repair, etc... Ms. Manske also indicated that the site is placed on 42 acres with expansion possible. Ms. Manske indicated that the 51,000 square feet is based on the development costs but the Barthel people would like the Planning Com- mission to consider approving up to 55,000 square feet. Commissioner Pearce asked Ms. Manske what Barthel would consider for Phase 2 for the PUD. Ms. Manske indicated that possible mall expansion but that it would depend on market demand. The City Administrator asked Ms. Manske if Barthel was proposing 51,000 square feet or 55,000 square feet. Ms. Manske indicated to the City Administrator that 55,000 square feet is the amount Barthel would like to have the Planning Commission consider tonight. Chairman Tracy asked if the public had any questions for Barthel regarding their new proposal. Rob VanValkenbu~indicated that he understood that studies, done by Zack Johnson and Associates, allowed for 44 or 45,000 square feet of shopping center and he questioned the size of the center and the need for future development. Mr. VanValkenburg further indicated to Mr. Ken Barthel a question regarding the do\vntown development - If the do\vuto\Vll got some type of redevelopment going in the dO\Vllto\Vll area, would Barthel be willing to wait a year before progressing with the shopping center? Mr. Barthel indicated to Mr. VanValkenburg that that would not be possible because of options that have to be met. Discussion followed regarding the conditional use permit and the conditions on s~ch a permit. The City Administrator indicated to the Planning Commission that tonight they are looking at a new proposal and they should review this against the ordinance. The Planning Commission should consider this in relationship to the HRA study and the Comprehensive Plan. The City Administrator further indicated that the Planning Com- mission should look at Exhibits A and B that are included in their packets for to- nights meeting. The City Administrator also indicated to the Planning Commission that they should look at the storm sewer and water capacities, etc. The City Administra- tor indicated that questions regarding technical questions about the center, includ- ing internal security and maintenance of the facility should be looked at. Planning Commission Minutes June 28, 1982 Page Three Discussion followed regarding the managing of the proposed shopping center. Ms. Manske indicated to the Planning Commission that Caldwell would be managing the center. The City Administrator indicated that the Planning Commission should also look at the standards for a conditional use permit. There are still some questions about standard 2, 5, and 6 that need to be looked at. Standards I, 3, and 4 seem to be answered in the new proposal. Zack Johnson referred to his memo that was included in the Planning Commission pack- ets. Mr. Johnson felt that the traffic flow was okay. The major problem is with the circulating pattern of traffic. Mr. Johnson indicated that there was limited access to Sites A and F, with only one point of access to Site F and only one point of access to Site A. Another major concern Mr. Johnson indicated was the absence of an access to Highway 169. Mr. Johnson indicated that the Minnesota Department of Transportation told him a year ago that there would be no access to Highway 169 at that point. Mr. Johnson indicated that the main point of entry into the shopping center is through Parcel I. Mr. Johnson indicated that he felt this was inadequate, and that possibly Barthel should restudy this problem. Mr. Johnson also indicated that ped- ~~trian c~rculation through the center is very limited, and he still feels that the sidewalk if very critical. Mr. Johnson further indicated that he felt that the only weaknesses in the new proposal were in Sites A, Band C regarding landscaping. Mr. Johnson further indicated that there was good buffering on the west side. Mr. John- son also indicated that he had some question regarding the subdividing of Parcels H and J, and why those should be separate lots. In conclusion, Mr. Johnson stated that the basic land use concept is consistent with the City's adopted Generalized Land Use Plan with the exception of having too much land area designated to commercial use. It is recommended that an area of high den- sity residential be developed on a portion of Parcels E and F. There would seem to be several possibilities for these areas to be mixed use through the inclusion of limited convenience retail and/or office uses. Chairman Tracy indicated that the Planning Commission should come up with some kind of recommendation to give to the City Council for their meeting on July 12th, 1982. Commissioner Pearce indicated that before making a motion, he would like to make some preliminary remarks. Commissioner Pearce indicated that he has found very little opposition to this shopping center concept; it should be built. Commissioner Pearce indicated that it was a question of timing to be effective. Commissioner Pearce also felt that the spirit of competition would dictate the timing and size of the center. Commissioner Pearce further indicated that the motion he was going to make tonight was very thought out. Before the motion was voted upon, Commissioner Gunkel expressed her desire that the sidewalk on Eighth Street be removed from the proposal. Commissioner Gunkel felt that this was a personal request, and she further indicated that only the people on Holt and Gates Avenue could use this sidewalk and these were the people that were opposed to it. Chairman Tracy indicated that he had looked at the area where the sidewalk will go and he indicated that he could "live \vith it or \vithout it". Chairman Tracy further indicated that Commissioner Pearce's motion referred to memos, one specifically of June 25, 1982, regarding the six conditions of a conditional use permit. Chairman Tracy asked the City Administrator if this was sufficient enought of a motion for the City Council to look at. The City Administrator indicated to Chairman Tracy that this was sufficient. Chairman Tracy then asked Commissioner Pearce to re-read the motion so that everyone understood what was being presented. Planning Commission Minutes June 28, 1982 Page Five Commissioner Pearce indicated that the Planning Commission is recommending that the conditional use permit and the preliminary plat be delayed until all the questions can be answered. Chairman Tracy indicated that all the items fit into the six standards for a con- ditional use permit. COMMISSIONER GUNKEL MADE AN AMENDMENT TO THE MOTION TO EXCLUDE THE EIGHTH STREET SIDEWALK FROM THE BARTHEL PUD. COMMISSIONER PEARCE SECONDED THE MOTION. THE MOTION PASSED 3-l-l, CO~IISSIONER KREUSER ABSTAINING AND COMMISIONER PEARCE VOTING NO. THE MOTION AS AMENDED PASSED 5-0. 5) Consider Preliminary Plat Approval - Ted Lundgren Rick Foster was present to present the request for preliminary plat approval by Ted Lundgren, Princeton, MN. Mr. Foster indicated that this area was rezoned at the last City Council meeting. There will be 14 to\vuhouse units in this area. Discussion followed regarding the drainage for the to\vuhouses. Rick Foster indi- cated that there were three driveways into the townhouses. Rick Foster further indicated that this was an arterial road and that there was sufficient off-street parking. Rick Foster also indicated that each unit would have its O\VTI garage. Chairman Tracy opened the public hearing. There was no discussion or comments from the public present. COMMISSIONER GUNKEL MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE PRELIMI- NARY PLAT FOR THE FIRST PHASE OF THE AREA ZONED R-3 \fHICH BORDERS ON HIGHLAND ROAD, BY MR. TED LUNDGREN. THE MOTION WAS SECONDED BY COMMISSIONER KREUSER. THE MOTION PASSED 5-0. 6) Consider Concept for Townhouses - Neil Larson Mr. Neil Larson presented his concept for to\vuhouses for an area bordered on the north by 191st Lane and on the east by Jackson Avenue. Mr. Larson indicated that this was a platted area and it was zoned R-2. Mr. Larson further indicated that the concept consisted of zero-lot lines for twin homes with the lot lines down the center of the property. Rick Breezee indicated that this area was zoned R-2. In an R-2 zone, lots are 60 feet wide. With a zero lot line concept, the lot line is do\vu the center, making each lot 30 feet wide. Rick Breezee further indicated that Mr. Larson would request are-plat of the area because when this was originally platted, zero lot lines were not incor- porated. Commissioner Pearce asked Mr. Larson if the general idea was to build homes with a common wall. Mr. Larson indicated there would be two of everything in regard to the building it- self. Each building would be o\vuer/occupied. Planning Commission Minutes June 28, 1982 Page Six Commissioner Gunkel indicated this concept would blend in well with the Brutger's Co. project that is close by the area involved. Rick Breezee indicated this concept would not change the density units for the City. Rick Breezee further indicated that all of the setbacks that are required in a R-2 zone must be met except for the interior common wall. Commissioner Kreuser asked Mr. Larson if these homes \Vere all "tied" together. Mr. Larson indicated they were not. It was the general consensus of the Planning Commission that they were in favor of this concept and could see no problem with it. This was a concept presentation and no motion was needed at this time. 7) Consider Conditional Use Permit - Kevin Gerlach Kevin Gerlach indicated that he was requesting a conditional use permit to locate a mobile home approximately 14' x 70' in size, on a piece of property oivned by his father. Kevin Gerlach further indicated that he was getting married in the fall and would be working on his father's farm. His father is unable to farm at this time. Kevin Gerlach indicated that because his father is unable to farm, he will be doing the farming for him. Rick Breezee indicated that Mr. Gerlach had been informed by someone at the County that he could have a mobile home on a farm. Chairman Tracy indicated that the City ordinance states that a person could have a mobile home on property for six months while constructing a home. Commissioner Kreuser asked Mr. Gerlach how many acers i\Tere involved in the farming operation. Kevin Gerlach indicated that there were 80 acres involved with the farm- in operation. Commissioner Pearce asked Mr. Gerlach if there was a house on the property at this time. Mr. Gerlach indicated that his brother lived in a house next to the property where the trailer will be placed. Discussion followed where it was indicated that the Planning Commission could make an amendment to the City ordinance regarding mobile homes on farm land. It was in- dicated that this particular request would not be able to meet the six standards of a conditional use permit. Chairman Tracy indicated that standard #2 would be a pro- blem. Commissioner Gunkel asked Mr. Gerlach how close was the nearest house to where the trailer would be place. Mr. Gerlach indicated that there were 2~ acres between the house and the trailer. Discussion followed regarding the possiblity of putting a foundation under the trailer with the wheels removed. Rick Breezee indicated a distinction would have to be made between modular housing and a trailer. Planning Commission Minutes June 28, 1982 Page Seven Zack Johnson indicated that if the unit remains moveable, then it is considered a mobile home. Zack Johnson also cautioned the Planning Commission on making the definition of a mobile home to include an architechtural review. MOTION BY COMMISSIONER PEARCE TO RECOMMEND TO THE CITY COUNCIL DENIAL OF THE CONDITIONAL USE PERMIT REQUEST FOR A MOBILE HOME LOCATED AT 21680 MEADm?VALE ROAD IN THAT IT DOES NOT FIT INTO THE CITY CODE. THE MOTION WAS SECONDED BY COMMISSIONER GUNKEL. THE MOTION PASSED 3-2, COMMISSIONER KREUSER AND FREDERICKSEN ABSTAINING. 8) Consider Zone Change Request - Chip Martin Chip Martin was present to present his request for a zone change from 1-2 to C-3 for his property kno\vu as Martin's Plaza on Highway 10 and the adjacent area. Commissioner Pearce indicated that the Planning Commission should look at rezoning more than Mr. Martin's property, possibly including the residential property around his property. Commissioner Pearce also felt that it wasn't right to rezone this prope.rty \vithout the people kno\ving about it. Chairman Tracy indicated that if this area was rezoned, it would put the feed mill and the homeowners in a nonconforming position. Commissioner Gunkel asked Rick Breezee why this would include more than Mr. Martin's area. Rick Breezee indicat~d"that st~ff had looked at the whole "set upt., and that the HRA suggested looking at the \vhole area. Chairman Tracy indicated that this area is a very narrow strip of property. If the Planning Commission was to approve a change from 1-2 to ~-3, and if Mr. Martin wanted to build on this narrow strip, the Planning Commission would also be saying "yes" to a variance. Chip Martin indicated that the way the land is zoned currently, it could never be sold. Mr. Martin further indicated that he plans to continue to use this area as a retail area. Mr. Martin also indicated that he had rebuilt his area known as Martin Plaza in 1976 after a fire and at that time it was zoned retail. Commissioner Pearce indicated that questions about future uses, at this time, were hypothetical. Commissioner Gunkel asked if this was a zone change and if it was, would a public hearing be held? Rick Breezee indicated that the City Council holds the public hearing, not the Planning Commission. Commissioner Pearce asked Mr. Martin if this was zoned C-3, would he modify his buildings there? Commissioner Pearce also inquired if Mr. Martin could ask for a conditional use permit when the property is zoned 1-2. Zack Johnson indicated to Commissioner Pearce that Mr. Martin could not ask for a conditional use permit. Discussion followed regarding the sewer and water for the property. MOTION BY COMMISSIONER GUNKEL TO RECO}WffiND TO THE CITY COUNCIL DENIAL OF THE Planning Commission Minutes June 28, 1982 Page Eight ZONE CHANGE REGUEST BY MR. CHIP MARTIN FROM 1-2 TO C-3. CO}lliISSIONER PEARCE SECONDED THE MOTION. THE MOTION PASSED 5-0. 9) Consider Zone Change Request - Clarence Cook Mr. Tony Trimble, attorney representing Mr. and Mrs. Cook, presented the request for a zone change from R-lc to R-3. Mr. Trimble indicated that the property in question is on the corner of 5th Street and Line. Mr. Trimble also indicated that the area is currently surrounded by zones of M-R. The Cooks are asking for the northern portion of their property to be rezoned to R-3, a piece of 1.1 acres, to construct townhouses. Mr. Rick Breezee stated that the M-R was on the land use map and not the zoning map. The zoning map shows the area as single family residential. Discussion followed regarding the setbacks and the proper use of the land in question. Mr. Trimble indicated that Parcel A, B, and C would be one lot. Mr. Trimble indicated what type of construction that would occur on this piece of property - to\vuhouses. COMMISSIONER PEARCE MADE A MOTION TO RECOMMEND TO THE CITY COUNCIL DENIAL OF THE ZONE CHANGE REQUEST BY MR. AND MRS. CLARENCE COOK, 429 LINE, ON THE BASIS THAT THE CITY PLANNER HAS INDICATED THAT THERE IS ENOUGH R-3 ZONED IN THE CITY OF ELK RIVER. COMMISSIONER KREUSER SECONDED THE MOTION. THE MOTION PASSED 5-0. Commissioner Gunkel indicated that she would like to work something out regarding C-3 zones at the next workshop. Mr. Tony Trimble indicated that they have one parcel R-lc right in the midst of a residential are~. Mr. Trimble further indicated that the single parcel owned by the Cooks was zoned R-lc and as it is zoned presently, it was of no use to the Cooks. Zack Johnson asked Mr. Trimble if he was saying that the Cooks could not develop it as R-lc? Mr. Trimble indicated to Mr. Johnson that it could only be developed as single family houses, the way it is zoned now. Zack Johnson asked Mr. Trimble why the Cooks couldn't put single family houses on this property. Mr. Trimble indicated he didn't understand the logic of doing that. Zack Johnson indicated that the entire block was zoned R-lc. MOTION BY COMMISSIONER JOHN PEARCE TO RECOMMEND TO THE CITY COUNCIL DENIAL OF THE ZONE CHANGE REQUEST BY MR. AND MRS. CLARENCE COOK, 429 LINE. THE MOTION WAS SECONDED BY COMMISSIONER ESTELLE GUNKEL. THE MOTION PASSED 5-0. 10) Consider Conditional Use Permit Request - Jan McLean Commissioner Gunkel asked Ms. McLean what the building was that would house the styling shop? Planning Commission Minutes June 28, 1982 Page Nine Ms. McLean indicated that the proposed styling shop would go do~~stairs from the chiropractor's office at 209 Main Street. Commissioner Gunkel asked Ms. McLean what would be involved as far as remodeling would be concerned? Ms. McLean indicated that there would be a public restroom put in downstairs, insulating of the area and remodeling inside would also have to be done. Chairman Tracy indicated that item #4 of the Conditional Use Standards was a question that would need to be answered. Commissioner Pearce asked Rick Breezee why this type of operation needed a conditional use permit. Rick Breezee indicated that this was in a C-3 zone and the only way a beauty shop or a barber shop can operate in this zone was through a conditional use permit. MOTION BY COMMISSIONER FREDERICKSON TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE CONDITIONAL USE PERMIT REQUEST BY MS. JAN MCLEAN FOR A BEAUTY SHOP TO BE OPERATED OUT OF 209 MAIN STREET. THIS CONDITIONAL USE PERMIT WOULD BE REVIEWED IN TWO YEARS. THE MOTION WAS SECONDED BY COMMISSIONER GUNKEL. THE MOTION PASSED 5-0. 11) Consider Conditional Use Permit Request - William Gass Mr. William Gass was present to explain his request for a conditional use permit for gunsmithing as a home occupation. Mr. Gass explained that this was not a store; only a repair type of business and this would be run on an appointment only basis. Commissioner Pearce asked Mr. Gass if this was a single person type of operation. Mr. Gass indicated that it was. Chairman Tracy indicated that Standards 1, 2, 5, and 6 were okay, Standard 3 was by appointment only with weekends until 5:00 p.m., and Standard 4 was only one person involved. Mr. Gass indicated that there would be no selling of ammunition and that testing of the guns would be done. at the Gun Club, not at his residence. Also there would be no storage of any ammunition. MOTION BY COMMISSIONER GUNKEL TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE CONDITIONAL USE PERMIT FOR A HOME OCCUPATION OF GUNSMITHING FOR MR. WILLIA}f GABS, 14021 VICTORIA LANE FOR A PERIOD OF TWO YEARS. THE MOTION WAS SECONDED BY COMMISSIONER KREUSER. THE MOTION PASSED 5-0. 12) Consider Conditional Use Permit Request - Brutger's Company Rick Breezee indicated to the Planning Commission that a tent trailer was already on the site where Brutger's Co. is doing construction of the townhomes. Mr. Breezee further indicated that the Brutger's Company wanted this trailer because of recent theft and vandalism, and union difficulties. This trailer would be for security reasons only. Planning Commission Minutes June 28, 1982 Page Ten COMMISSIONER GUNKEL MADE A MOTION TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE CONDITIONAL USE PERMIT FOR BRUTGER'S COMPANY FOR A TRAILER AT THEIR BUILD- ING SITE FOR A PERIOD OF 6 MONTHS. THE MOTION WAS SECONDED BY COMMISSIONER PEARCE. THE MOTION PASSED 5-0. 13) Consider Language for Reviewal of Conditional Use Permits Rick Breezee and the City Administrator figured that the amount of staff time involved with reviewal of conditional use permits amounts to $50.00. The City would mail out notices to the surrounding homeo\vners with-in 150 feet, but would not publicize that a conditional use permit was up for reviewal. Chairman Tracy indicated that he had no problem with the $50 fee. Chairman Tracy further indicated that he was not convinced that conditional use permit reviewals have to come back to the Planning Commission. Chairman Tracy also indicated that if there was no negative feedback from the mailings, the re- viewal could be done by the staff. If the feedback is negative, then another $100 should be charged and a public hearing held at the City Council level. It was the general consensus of the Planning Commission that the method suggested by Chairman Tracy was favorable. It was the feeling of Commissioner Gunkel that the Planning Commission would like updates on the conditional use permits. MOTION BY COMMISSIONER PEARCE TO RECOMMEND TO THE CITY COUNCIL TO CHARGE A $50 FEE FOR THE INITIAL REVIEWAL OF A CONDITIONAL USE PER}1IT. IF A PUBLIC HEARING IS NEEDED AT THE CITY COUNCIL LEVEL, ANOTHER $100 \vILL BE CHARGED. IF THERE WAS NO FEEDBACK FROM SURROUNDING HOMEO~VNERS, STAFF WOULD HAVE THE CAPACITY TO APPROVE THE CONDITIONAL USE PERMIT. COMMISSIONER KREUSER SECONDED THE MOTION. THE MOTION PASSED 5-0. 14) Consider zone change for area west of Jackson and North of Railroad Tracks Zack Johnson showed the Planning Commission a map of the area involved in the possible zone change. If would include the area 1/2 block west of Jackson to be changed to C-4. Discussion followed regarding the change. Rick Breezee indicated that notices would be sent to surrounding homeo\vuers when a public hearing was held at the City Council; this would be done only if the area involved is under 5 acres. Zack Johnson indicated that this change would give more industrial zoning to the area that is involved. No motion was called for at this time.
