Introduction
The applicant is requesting a General Planning Permit to conduct firework sales from a 30' x 40' sales
tent located in the eobarn's parking lot, 19425 E,rallS Street.
Discussion
The applicant requests a General Planning Permit to erect a sales tent to conduct fue\vork sales in dle
parking lot. It will be used from June 23, 2006 duough July 4, 2006. The hours of operation \vill be froin
11 a.m. - 9 p.m. and possibly could be open later tlle few days prior to July 4.
The proposed location is in dle parking lot, straigllt out and sligllrly SOUdl from the main entrance to tIle
store. It appears that in this location tlle tent will not disrupt traffic flow nor "rill it create any parking
problems. The applicant will also keep a 20' metal storage container onsite to store tile fire\vorks for
security reasons.
Tllere is also a temporary greenllouse in dlls parking lot located to the nordl of this proposed use. TIle
zoning code does not prohibit t\Vo general planning permits for tlle same property.

The City Council appro\re the applicant's request for a General Planning Permit to conduct fire\~vork sales
from a 30' x 40' sales tent widl dle following condition:
1. No electrical services shall be across any drive or walking surface.
2. If traffic becomes a problem around the temporary site, the sales area shall be
delineated with a barrier to restrict traffic.
3. The sales tent shall be maintained free of debris and kept in an orderly condition.
4. The location of the tent is consistent with the submitted site plan and meets all fire
codes.

5. The tent shall be removed within one week of the end of the sales period and the site
be returned to its previous condition.
6. Overnight parking of recreational and/ or business related vehicles is prohibited.
7. No overnight occupancy of the tent shall be allowed.

Pinnacle Distributing will be assisting a non-profit groiJp with a fund raiser this summer.
The club will be operating a retail fireworks tent located at Coborns, 19425 Evans Street
NW, Elk River, MN 55330. The tent will operate starting Friday, June 23, 2006 with the
last day of sales being Tuesday, July 4, 2006. Hours of operation will be from 11 :00
am to 9:00 pm each day. At the group's discretion, they may stay open until midnight
on July 3rd and July 4th if traffic warrants it.

A 30' x 40' tent and a twenty foot metal storage container will occupy approximately I
seven parking stalls. The metal container will be directly next to the curb/median on the
west side of the parking lot next to the tent as directed by CObOIlJ'~7'manager. The tent
will be located in the same area as last season. The container will be used to secure
the fireworks inventory should the charity choose not to stay overnight in the tent. The
container will be locked on site if the charity chooses not to spend the night.
Safety Plan Procedures:
Two fire extinguishers will be in the tent; one at each of the two exits. They will be
elevated to a height of approximately four feet and will not be set on the ground.
We will be conducting regional sales and training meetings for all of the
Coborns/Cashwise charity groups/staff that will be operating fireworks tents on their
properties. Each tent will have a uprocedures" manual to refer to as well as a listing of
emergency contact numbers.

All products being sold is 1.4g Minnesota legal product. Our company and non profit
groups follow the National Fire protection Agency regulations and guidelines.
T ant:
The tent we are using is a clearspan gable tent. This style of tent is staked directly
below the side wall and has no exposed stakes. There will be no ropes extending from
the tent and no stakes protruding out of the parking lot around the extended perimeter
of the tent. This will substantially reduce the liability risk compared to tents of other
designs. You can walk along the perimeter of this tent as it was a building
