SR 05-15-2006 City of Elk River REQUEST FOR COUNCIL ACTION Agenda Section Meeting Date En . eerin Ma 15,2006 Item Description 2006 Bituminous Overlay Improvement - Additional Areas Item Number Introduction At last Monday's City Council workshop, the Council discussed the potential of adding the Naples Street/186th Avenue neighborhood to the 2006 Bituminous Overlay Project. In addition, the Street Department (Phil Hals and Mark Thompson) have inquired about adding 191 % Avenue west of Jackson Street to the project. This area is just north of Schoolview First Addition, which is part of the proposed 2006 Bituminous Overlay. Discussion Adding either or both of these areas to the 2006 Bituminous Overlay Improvement would not have an adverse effect on the proposed assessment rate. The lots in these two areas are of a similar size or smaller, than the areas covered in the original feasibility study. Therefore, the additional cost would easily be covered by the addition of assessable units in these two areas. In the Naples Street/186th avenue area the project would simply provide a bituminous mat on an existing gravel road. The City Street Department would corne in and match in the driveways and shoulder areas with additional gravel after the paving is complete. If the City Council would like to add these two areas to the 2006 Bituminous Overlay Improvement, this report will act as an amendment to the approved feasibility study for the purposes of adding these two areas to the project. Financial Impact As with typical overlay projects, only the cost of the bituminous overlay is assessed. Any preparatory work or repair work of gravel shoulders and/or gravel driveways after the bituminous overlay is accomplished by the City's Street Department. This is the City contribution towards the bituminous overlay project in an effort to keep the assessment to the benefited properties as low as possible. Attachments . The Gty Council will consider the 2006 Bitwninous Overlay Amendment improvements as described in the Feasibility Report and the assessment of the property abutting this proposed improvement for all or a portion of the cost of the improvement pursuant to Minnesota Statutes, Section 429, at an estimated total cost for the improvement of $194,700. 2. NOW, THEREFORE, BE IT RESOLVED by the Gty Council of the Gty of Elk River, Minnesota: 1. Based upon the City Assessment Policies, it is determined that the portion of this improvement to be paid by the Gty and not assessed to benefited properties is $-0-. 2. The portion of the cost to be assessed against benefited properties pursuant to the Elk River Gty Assessment Policies shall be $194,700. 3. The assessments shall be payable in equal annual installments and shall extend over a period of five years, the first of the installments to be payable on or before the first Monday in January, 2007, with interest at the rate of 5.50% per annum from the date of the adoption of the assessment resolution. 4. The Gty Administrator with the assistance of the Project Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece, or parcel of land, without regard to cash valuation, as provided by law, and shall have available at the Gty Administrator's office a copy of the proposed assessment roll for public inspection. 5. Upon completion of the proposed assessment roll, the City Administrator shall notify the Council and schedule a public hearing upon the proposed assessment, causing notice of the hearing by publication and mail to be made at least two weeks prior to the hearing. A hearing shall be held on the 19th day of June, 2006, in the City Hall at 6:30 p.rn. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and shall state in the notice the total cost of the improvement. The City derk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two prior to the hearings. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City of Elk River, except that no interest shall be charged in the entire assessment is paid within 30 days from the adoption of the assessment. The owner of any property may at any time thereafter pay to the City of Elk River the entire amount of the assessment remaining unpaid, with interest accrued to December 31 st of the year in which such payment is made. The City Council has expressed some concern regarding the fact that those property owners in favor of sewer and water and street improvements and those against appear to be unchanged from several years ago. The City Council is also concerned about the estimated cost of the improvements and the affect that an assessment may have on property owners, even if the City were to subsidize a portion of the cost. Therefore, the City Council took no action relative to the presented feasibility study. However, at last Monday's meeting, the City Council had a general discussion about whether or not your neighborhood of Naples Street and 186th Avenue should be included in the 2006 Street Overlay Improvement. Inclusion in this project would get a bituminous surface of 24 - 28 feet wide on the existing gravel roads in your area. There would be no concrete curb and gutter installed nor would there be any significant changes to the drainage. It would simply eliminate the gravel road and the washboard effect and dust that is associated with that gravel. The proposal for typical overlay projects is that assessments are on a per unit basis. This year we are anticipating those assessments to be $2,300 - $2,500 per unit. The City Council will be continuing this discussion at the Monday, May 15th City Council meeting. If you are included in this project, you will receive a further notice inviting you to a public hearing/assessment hearing in mid-June. I would be extremely pleased if the Council would include the overlay project with the 2006 Overlay Project. In light of the SO/50 acceptance of a full sewer and water upgrade, I can sympathize with those who would endure hardships. An overlay would certainly give an ugraded appearance of the neighborhood and eliminate the dust caused by the gravel road. The summer southerly breezes have never allowed us to open windows because of the road dust. I certainly appreciate yours and John's efforts and look forward to the paving rigs soon. There may not be the votes to proceed with a sewer and water project because of the SO/50 split of the neighborhood that hasn't changed in several years. John actually made motion to not hire an appraiser but to add your area to the 2006 Overlay Project. The motion got tabled to next week with City Council direction that I should send a letter to all property owners telling them of the Council's proposed action. I'd like to hear from you what you think of this idea and what others may think. An overlay of the streets without curb and gutter would likely run $2300-2500 per parcel.
