Overview
In December of 2004, the City Council approved an Ordinance Amendment which
increased the number of agricultural animals, to no more than twice currently allowed,
provided there is an approved manure management plan following the Minnesota Pollution
Control Agency Technical Guidelines for Manure Management and Applications and a
Conditional Use Permit (CUP).
The applicant is requesting a CUP to have 15 horses on a 10-acre site. They are proposing
an 8-acre pasture area on the western 2/3 of the property. This 8-acre area could allow for
up to 16 horses with a CUP. There is a one acre manure management site proposed to be
located in the northeast portion of the site with additional land area within the 8-acre pasture
area. The applicant has stated that approximately 60% of the manure will be spread in the
pastures and they keep the animals off of it for approximately 3-weeks to allow the manure
to break down and work into the soil.
They have put together a manure management plan which does meet Minnesota Pollution
Control Agency Technical Guidelines for Manure Management and Applications.
The City ordinance requires that all agricultural animals shall be provided a shelter under
roof appropriately size to accommodate the specific animal in a humane manner. The
applicant has provided two 12x24 shelter for the horses.
The applicant's narrative (with this CUP) discusses the desire to build and operate a riding
arena also. Since the time of the application submittal, it was realized that the size of the
property was reduced from 10-acres to approximately 9.8-acres. This was due to the fact
that Sherburne County obtained additional right-of-way along the eastern portion of the site
for their County Road 13 project. The applicant will be applying for a variance to the
allowable Accessory Structure size. At 10-acres, they could build an 8,000 sqft building.
Once they are in the 5 to 10-acre size, they can only build a 4,000 sqft building.
Standards for Issuance of a Conditional Use Permit (Section 30-654)
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed
location:
1. Will not endanger, i,!jure or detrimentallY c:iffect the use and e'!Jqyment of other propertY in the
immediate vicinity or the public health, sq[ety, morals, comfort, convenience or general welfare of the
neighborhood or the city.
2. Will be consistent with the comprehensive plan.

3. Will not impede the normal and orderlY development and improvement of surrounding vacant
proper!J.
4. Will be seroed adequatelY f?y and will not adverselY affect essential public facilities and services
including streets, police and fire protection, drainage, refuse disposal, water and sewer rystems, parks
and schools; and will not, in particular, create trqffic congestion or inteiference with trqffic on
a4Jacent and neighboringpublic thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will
be detrimental to a'!Y persons or proper!J because of excessive trqffic, noise, smoke, fumes, glare,
odors, dust or vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of mqjor
importance.
7. Will fullY complY with all other requirements of this Code, including a'!Y applicable requirements
and standards for the issuance of a license or permit to establish and operate the proposed use in the
city.
If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or
a report stating how the proposed use does not comply with the standards set forth in Section 30-654.
Planning Commission Actions
Two residents spoke with their concern with the amount of manure possibly produce and
the effect it would have on nearby drainage ditches. Also question was the requirement for
shelter for animals outside.
The Planning Commission felt there were enough conditions in the CUP to restrict the
effects of manure on the site for long periods of time.
The Planning Commission recommended approval of the request with a 5-1 vote.
Recommendation
Staff and the Planning Commission recommend the City Council approve the request with
the following conditions:
1. All comments of the Environmental Administrator shall be addressed.
2. No more than 15 horses shall be allowed on the property.
3. One-half acre of fenced pasture land per horse shall be provided and
indicated on a site plan to be submitted to the City of Elk River.
4. No more than 15 horses at a time shall be pastured.
5. Manure shall be stockpiled on an impervious surface, covered, with side walls
as to contain liquid and prevent ron off.
6. Manure shall not be stockpiled outdoors for more than 7 days.
7. All manure (solid or liquid) shall be disposed of off-site in accordance with
MPCA regulations.
8. If the City finds that the manure and other waste materials create a nuisance
by attracting flies, other insects, rodents, or by creating offensive odors, the
City may order that the manure and other waste materials be removed on a
more frequent schedule.

We are requesting a conditional use permit, which allows us to keep and maintain up to 15 horses on
our 10 acre property which is located at 9630 213th Avenue NW, Elk River. We are also looking to build
an indoor riding arena, which is within city guidelines for maximum of 8000 sq. ft. in attached/detached
accessory buildings- our total with the new building would be 7200 sq. ft. The property currently has a
30'x40' pole building and we are looking at building an additional 60'x100' pole building as an indoor
riding arena (please see appendix A). We have a manure management plan which will meet county
and state requirements (please see appendix B). My wife and I currently provide private riding lessons
to several children, including several handicapped children in accordance with the North American
Riding for the Handicapped Association (NARHA).

My wife Kyleen and I have dedicated a large portion of our lives to children and children with
disabilities. My wife as a care provider for children with disabilities and I as a Police Officer and DARE
officer in Central Minnesota. My wife and I have been working with several physically challenged
children in the Andover and Elk River area. We have discussed in length with numerous people who
have children that would qualify under NARHA guidelines and would greatly benefit from therapeutic
riding. We have received commitments from several of these families to utilize the services that we will
be providing.
My wife and I are firm believers in the 4-H program and the wonderful things it brings to the community;
in addition to therapeutic riding, our stable will be used for various 4-H equestrian programs, classes
and training. We have three children; all of them participate and are very interested in our horses and
these programs. They are a 16 year old daughter, a 12 year old son, and a 6 year old daughter. They
are all willing to participate and assist in any way possible with these programs; in fact my oldest
daughter is interested in becoming certified by NARHA to instruct these children.
At the present time there are only four certified NARHA stables in the Minneapolis-St. Paul region that
provide therapeutic riding for these children. Hoofbeats and Heartbeat's program in Otsego is
consistently full and has an extensive waiting list, which shows the great need for additional programs
of this type. Hoofbeats and Heartbeats was opened by Linda and Greg Kreuser in 2001. Many past
volunteers that have helped make these programs a success are past Governor Jesse Ventura and his
wife Terry. They believed in the program so strongly, that they even donated Jesse's horse to the
program, in addition to time and financial resources. Many local organizations believe so strongly in the
programs that KARE 11 TV even setup a fund raiser to get the word out about the programs and
services offered.
An indoor arena will allow us to offer these services year round to children with disabilities. With
Minnesota weather, an indoor riding and learning area is a requirement to provide year round services.
This will allow us to start programs and not have to stop or go idle during the winter months. It is very
difficult to build muscle tone, self confidence, and independence with a large break in the middle of
training; as the muscles need to be kept in use on a regular basis. The proposed size of the facility is a
60' x 100' riding arena, which will be located on the property.
I am including additional background information on NARHA for your convenience and consideration.

facilitated therapy and activity programs in the United States and Canada. Currently, more than 650
NARHA program centers serve some 30,000 individuals with disabilities. Each year, dozens of new
centers initiate new programs and thousands of individuals profit from these beneficial activities.
Since 1969, NARHA has ensured that therapeutic riding is both safe for, and accessible to, those in
need. In that time the field of therapeutic riding has expanded along with the numbers of individuals
profiting from involvement with horses. Today NARHA represents a growing number of equine assisted
therapies and activities, including recreational riding for individuals with disabilities, hippotherapy,
equine assisted psychotherapy, driving, vaulting, competition and other therapeutic and educational
interactions with horses.
NARHA is proud to provide opportunities for people with varying ability levels to challenge themselves
physically and emotionally and to set goals to improve their quality of life via the horse. Training
professionals to support and facilitate this process, educating the public about the positive impact of the
human/animal bond and setting national standards for safe and effective equine facilitated therapy/
activities will continue to dictate our growth.
More than 30,000 individuals with disabilities are served each year through NARHA programs. The
American Occupational Therapy Association and the American Physical Therapy Association as a
valuable adjunct to traditional forms of therapy recognize equine Facilitated Therapy and Activities.
NARHA is also the accrediting organization for Easter Seals' camps with equine activities. Other
organizations participating in NARHA programs include the Muscular Dystrophy Association, Multiple
Sclerosis Society, Special Olympics, Spina Bifida Association and United Cerebral Palsy.

The riders, clients, therapists, instructors and volunteers involved in NARHA recognize the profound
significance of equine facilitated therapy and activities. Over 670 NARHA centers around the nation
and in Canada facilitate the personal growth and newfound wellness offered through the various
interactions with horses in the equestrian environment.
Therapeutic riding has been used since the early 1950s in Europe as a tool for improving the lives of
individuals with physical disabilities. NARHA was founded in 1969 to promote and support therapeutic
riding in the United States and Canada.
Individuals with almost any cognitive, physical and/or emotional disability can benefit from therapeutic
riding, driving, vaulting, competition or other purposeful, safe and supervised interaction with equines.
Because horseback riding gently and rhythmically moves the rider's body in a manner similar to a
human gait, riders with physical disabilities often show improvement in flexibility, balance and muscle
strength.
For individuals with mental or emotional disabilities, the unique relationship formed with the horse can
lead to increased confidence, patience and self-esteem. Local, State, National and even International
Competition often is the logical progression for individuals with disabilities who have mastered
equestrian skills and seek to further challenge themselves.
The sense of independence and acceptance found through these activities with the horse benefits all.
