Overview
Coborns was issued a Conditional Use Permit (CUP) in which a deli/coffee use was allowed
in the southwest corner of the store. The need for this CUP request is the applicant is
requesting a drive lane to a drive-thru window, on the south end of the building, which
would change the approved plan of the original CUP.
Seating will be provided inside the store and the existing Caribou will remain open.
Analysis
The drive lane will be accessed off the main circulation lane from the main parking lot,
which lies directly in front of the building. It will exit onto a secondary drive lane in front of
the loading docks on the south side of the building. Only one of the two loading docks is
being proposed to be used. To prevent conflicts with the circulation, curbing, landscaping
and signage will be placed in front of the loading bay closest to the exit of the drive lane.
One menu board will be located approximately 3D-feet from the entrance of the proposed
drive lane. This will allow only two vehicles to stack prior to conflicts with main circulation
lane.
Also being requested is a 14 square foot sign on the main monument sign for the
development. This request meets what was approved with the development. Two
additional wall signs are being proposed on the west and south elevations of the building.
Each sign is proposed to be 37 square feet. Sign permits will be required for all signage prior
to them being installed.
Parking and Circulation
No additional parking is being proposed. During the staff site plan review meeting, the
major issues raised were the possible circulation conflicts with the main entrance as well as
conflicts with the drive-thru exit and loading docks. The need for a sidewalk from the exit
door was also stated which was added with the revised drawings.
The City Ordinance requires that stacking room for five (5) vehicles shall be provided.
Although the revised site plan indicates that five vehicles can stack in the drive lane, only
two vehicles will able to stack at the menu board prior to conflicts with main circulation
lane.

The revised plans also indicate that curbing, landscaping and signage will be added in front
of the loading bay closest to the exit of the drive lane. This will allow vehicles to exit the
drive-thru land even if a tractor trailer is parked at the other loading bay.
Standards for Issuance of a Conditional Use Permit (Section 30-654)
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed
location:
1. Will not endanger, i1'!Jure or detrimentallY affect the use and er!fqyment rif other properry in the
immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare rif the
neighborhood or the city.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderlY development and improvement rif surrounding vacant
properry.
4. Will be served adequatelY f?y and will not adverselY qffect essential public facilities and services
including streets, police and fire protection, drainage, refuse disposal, water and sewer !}stems, parks
and schools; and will not, in particular, create trqffic congestion or inteiference with trqffic on
acfjacent and neighboring public thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions rif operation that will
be detrimental to af!)! persons or properry because rif excessive trqffic, noise, smoke, fumes, glare,
odors, dust or vibrations.
6. Will not result in the destruction, loss or damage rif a natural, scenic or historic feature rif mqjor
importance.
7. Will fullY complY with all other requirements rif this Code, including af!)! applicable requirements
and standards for the issuance rif a license or permit to establish and operate the proposed use in the
city.
If denial of such a permit should occur, it shall accompany recommendations or
determinations by findings or a report stating how the proposed use does not comply with
the standards set forth in Section 30-654.
Plannin~ Commission Actions
Noone spoke at the public hearing.
The major issues discussed were the stacking room of cars in the drive lane and the sight
lines for customers exiting the drive lane with a tractor trailer parked in the loading bay. It
was agreed that the stacking room meets the ordinance requirements.
The Planning Commission recommended approval of the request with a 6-1 vote.

Recommendation
Staff and the Planning Commission recommend the City Council approve the request with
the following conditions:
1. All comments of the Fire Chief shall be addressed.
2. Two wall signs, as shown on the drawing A2.0 dated 3/27/2006, shall be
allowed and shall not exceed 40 square feet each.
3. Sign permits are required prior to the signs being installed.
4. The building shall meet all applicable building codes.
5. The building shall meet all applicable fire codes.

The site plan review committee met on Tuesday, April 54, 2006 and I would like to make the following
comments:
1. Request by Bill Matthews for a Conditional Use Permit for automobile sales,. located at

The Fire Department requests that Bill Matthews meet with Fire Inspector Cliff Anderson to
discuss possible building improvements to ensure that they meet the intent of the International Fire
Code.

3. Request by River of Life Church for an extension to an interim use permit for a portable
