REQUESTED ACTION:
The applicant, Larry Leitschuh, 9110-83rd Avenue N, Brooklyn
Park, MN, is requesting a conditional use permit to operate a
health facility (aerobic studio) in the Elk River Mall. The
proposed owner of the facility is Janelle Swanson of Monticello.

SURROUNDING ZONING/LAND USE:

The property surrounding the Elk River Mall is zoned PUD,
planned unit developm~nt, in all directions. The underlying
land use is HB, Highway Business, to the north, east, and
south, however, to the west it is MR, Medium Density
Residential.
CITY SERVICES:
This site is served by City sewer and water.
LEGAL DESCRIPTION:
Lot 4, Block 2, Elk River Plaza. The attached map shows the
general location of the Elk River Mall.
BACKGROUND:

Janelle Swanson is interested in locating a health facility in
the Elk River Mall at 692 Freeport Avenue. The facility would
primarily be used for aerobic exercise classes which would
accommodate 10-30 students at a time. The proposed site of the
health facility was previously occupied by a Hallmark store as
well as the Carpet Tunnel store. According to the Elk River
Plaza PUD agreement, commercial recreational uses such as this
are considered a conditional use, therefore, a conditional use
permit is required.

The proposed site for the health facility is approximately
3,500 square feet. The applicant has indicated the health
facility would primarily be used for aerobic classes. The
plans supplied by the applicant do not show saunas, showers,
whirlpools, etc., however, there are separate mens and womens
changing rooms and lavatory facilities. A copy of the proposed
site plan is attached for your review. The site plan shows a
new sound wall will be placed along the perimeter of the site.
This will help to alleviate staff's concerns regarding the
effect of such a use on neighboring tenants in the mall.
The proposed hours of operation are 8 a.m. to 8 p.m. Staff
feels this is appropriate for this type of use as well as its
location.
Because the facility is located within a shopping center, the
parking requirement is computed for the entire mall, therefore,
parking does not need to be addressed with this request.
Staff feels this request meets the seven standards for a
conditional use permit as outlined in Section 900.42. Further,
the use will not be detrimental to adjacent and surrounding
tenants within the mall and the use is compatible with the
shopping center uses.
RECOMMENDATION:
Staff is recommending approval of the conditional use permit
request to operate a health facility (aerobic studio) in the
Elk River Mall. At the December 22, 1992, meeting the Elk
River Planning Commission reviewed this request and also
recommended approval subject to the following stipulation:
