SUBJECT: CIP WORK SESSION
A Capital Improvement Program (CIP) Work Session is scheduled
for 6:00 p.m. on Monday, February 15, 1993, at the Elk River
City Hall Conference Room. City Council and staff should feel
free to come dressed casually for this meeting and pizzas will
be provided for dinner. If individuals do not favor pizza, and
would prefer something different on the order of a subway,
please notify me and such provisions can be made.

At the last CIP Work Session on 1/18/93, the City Council
reviewed past, ongoing, and annual capital improvement projects
and the financing for these projects. This historical
information is important in order to understand what has been
happening in Elk River, and why the statement that "limited
funds are available for 1993 capital improvements" is
generally accepted by myself, John, and Roger. John and Roger
have been on the Council the past few years and have seen the
amount of monies spent on past projects.
Under ideal conditions, this 2/15/93 CIP meeting should start
off where the last meeting in January ended. If this is true,
then the City Council will review the list of "known" 1993-97
projects (based on the 1990 CIP). Following this step, the
City Council would then add to this list of 1993-97 projects,
delete projects from this list, and discuss the long range or
nonprogrammed (pending) projects.
Once all projects are reviewed, the City Council needs to begin
prioritizing the projects. Whether or not the Council needs
rough cost estimates from the engineer, or whether or not the
Council needs to know the availability of funds before
establishing priorities, is strictly up to the Council as to
what process it wants to go through in order to establish
priorities.
As time allows, the Finance Director and myself will be happy
to review the CIP finances with the City Council. It is a
concern that due to the length of the agenda and some of the
special capital imp~ovements that need to be reviewed, we may
not get to the finaqc~s at this meeting. If this is the case,
a special meeting d~te will need to be established by the City
Council to continue the CIP Council discussions.

While I hope to not get too hung up discussing specific
projects, some projects do need to be reviewed by the City
Council. These projects include the following:
- The WWTP expansion update (see attachments)
- The East Highway 10 Feasibility Study (see attachment)
- The Jackson Avenue/Highway 169 Feasibility Study (see
attachment)
- The Elk Park Center Traffic Study and EAW that has
previously been distributed (these topics may not need to
be discussed at this 2/15/ meeting.)
Action is necessary on the County Road 1 project (see
attachment)
- Discussion needs to take place on the Lake Orono dredging
proposal (Homeowners Association meeting is scheduled for
2/18/93)
- The City Council needs to review the City owned property
along Highway 169 (approximately 5 acres directly north of
the MnDOT garage) as the City has received a request to
sell this land.
In addition to the above projects,

Staff is prepared to discuss each of the above projects in any
amount of detail that is desired by the City Council. However,
if a few of the items listed above each generates a half hour
or more of discussion, then it is likely that we will not make
much progress on the CIP as originally proposed.

RE: CSAH 1 IMPROVEMENTS
Dear Mr. Klaers:
Last week, we had an opportunity to discuss the upgrade of CSAH 1 further to the north and
west with Russ Matchinsky, Sherburne County Engineer. Mr. Matchinsky agreed that the
road should be improved from the point where the 1991 project terminated past the new school
and industrial park to approximately County Road 32. He indicated his funding sources were
committed for 1993, but he may have funding available in 1994.
He also indicated it may help if the City were willing to front end the costs to design the
project in 1993 for 1994 construction. We understood the County would then reimburse the
City in 1994 when funding was available. Along these lines, Maier Stewart & Associates
would be prepared to enter into an agreement with either the City or the County whereby we
would perform the design work on CSAH 1 in 1993 and hold any billing until early 1994
when funding is available.
We have prepared the attached resolution for the City Council's consideration. The resolution
requests the upgrade of CSAH 1 in 1994 and indicates the City is willing to advance the cost
of the project design in 1993.

A RESOLUTION REQUESTING SHERBURNE COUNTY PROGRAM
THE UPGRADING OF COUNTY STATE AID HIGHWAY 1 (CSAH 1)
FROM THE INTERSECTION WITH COUNTY ROAD 77 TO THE
INTERSECTION WITH COUNTY ROAD 32 FOR 1994
WHEREAS, the City of Elk River is experiencing rapid growth along the CSAH 1 corridor
including the new elementary school, development in the industrial park, and
proposed single faml1y development; and
WHEREAS, the entire area surrounding and adjacent to the CSAH 1 corridor is within the
City of Elk River's urban service area; and
WHEREAS, the volume of traffic on CSAH 1 continues to increase;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. The City requests that Sherburne County consider the upgrade of CSAH 1 to a four lane
facility from the intersection with County Road 77 (proctor Avenue) to the intersection
of County Road 32.
2. The City requests that this upgrade be programmed to be constructed in 1994.
3. The City of Elk River is willing to enter into an agreement with the County to perform
the project design in 1993 with reimbursement from the County in 1994 when funding
is available.

Dear Mr. Martin:
On behalf of Mayor Jim Tralle, I would like to acknowledge
receipt of your November 20, 1992, letter regarding the
potential purchase by UPA of some of the old City Hall
property. The City was pleased to have received a written
proposal from UPA following our discussions this past summer.
In response to the six items listed in your November 20, 1992,
~ letter, the following comments are offered.
1. The City will need to retain a public easement across the
western part of UPA Drive so that the public that uses the
"park and ride" has access from Main Street through the
driveway that goes down the hill into the parking area
(item #3).
2. The City will agree to some type of restrictive covenants
on the balance of the property not acquired by UPA, but
the City needs to preserve the right to use the retained
property in a governmental or a quasi governmental manner
or by a nonprofit organization (item #5).
By this, I mean it may be possible that a Chamber of
Commerce building gets located on this property or, in the
future, some type of City government or school building
may be located on this property.
3.
The City cannot agree to any provision that would restrict
the authority or power of a future City Council to
regulate the access from UPA Drive to Main Street (item
#4) .

It is difficult to imagine a situation that could arise
where the City Council would find it necessary to use its
authority to restrict access from UPA Drive to Main
Street, but that power rests solely with the City Council

and the current City Council cannot restrict what a future .
City Council may do in that regard.
Overall, the City understands the desire for UPA to only
purchase the part of the old City Hall property that is
designated "UPA Drive." The City is happy to absorb the
landscaping and maintenance responsibilities on the retained
property and will work with MnDOT to continue the current park
and ride operation.
In general, the proposal you submitted to the City to purchase
only "UPA Drive" is acceptable with the above noted concerns.
If these revisions are acceptable to UPA, the

Dear Mayor Tralle:
As you know, United Power Association (UP A) and City staff have been discussing the
City's interest in selling the old Elk: River City Hall property (the "Property") to UP A.
UPA's interest in this property is to preserve the required future use of UPA Drive for
access to UP A's office and plant site.
As a result of these discussions, UP A makes the following proposal:
1. UP A agrees to purchase that portion of the Property which is designated "UP A
Drive" on the City's property survey. UP A's interest is in the existing improved
road area (approximately the northerly 40 feet of Lots 1, 2, 3, 4 and 5, Block 8,
Village of Elk: River) providing access to UPA's plant and office site, and
adequate adjoining area upon which to store plowed snow. The exact description
of the area to be acquired shall be mutually agreed upon by the parties.
2. The City, by appropriate action, shall vacate UP A Drive as a public street or road
on or before the closing of the transaction.
3. Contemporaneously with the vacation of UPA Drive as a public street or road,
UP A shall grant an easement to the City upon the vacated street for access to its
well and filtration plant.
4. The City agrees not to eliminate or restrict access from UP A Drive to Main
Street.
5. The City shall place restrictive and protective covenants on the balance of the
Property not acquired by UP A, for the benefit of UP A and its plant and office
site, providing that no use of nor improvements thereto shall be made other than a
parking lot, lighting, non-commercial signs~ and landscaping.
6. The consideration for the foregoing transaction shall be the sum of $175,000 paid
by UPA to the City.

The foregoing proposal is subject to the satisfaction of the condition precedent that all of
the terms and conditions with regard to the transactions shall be stated in a definitive
agreement mutually satisfactory to the City and UPA.
If the proposal is acceptable to the governing body, UPA is prepared to promptly enter
into discussions to work out all of the necessary legal details.
UP A is grateful for the opportunity to acquire and control UP A. Drive access to its plant

I am writing this letter in support of the proposed Hwy 169 mall
development project. At stake is the present and future economic security of the
City of Elk River and it's citizens. Both sides of this issue must be addressed
calmly, intelligently, unselfishly, and most importantly, it must be addressed
without delay. A growing economy is vi tal to the social and educational
development of this city. Our children deserve to grow up in an environment
which promotes and offers only the best in economic. educational, and social
opportunities.
A strong economy comes from a strong tax base. Our city, like many other
cities our size, has many needs and limited resources. In the recent past we
have seen the need to build a new elementary school. a new government center. and
a new police station to name a few examples. The money for these and other
programs must come from somewhere. Without the help from stores such as Cub
Foods. Walmart. and Menards. the money will have to come from increased property
taxes. I'm sure that I am not alone when I say the property taxes in Elk River
are already too high. I think the choice is clear. The most effective way to
infuse a large amount of money into the tax base is to encourage retail stores
to build here and thus pay taxes here.
My friends. family. and co-workers who live or work in Elk River and
surrounding communities, tell me they do not shop much locally. What an
inconvenience to have to drive to Coon Rapids for shopping when that money could
easily be spent in Elk River. With the addition of Cub. Walmart, and Menards.
Elk River would not only keep its citizens shopping locally. but would also
benefit from shoppers from surrounding cities and townships.
In the future, Elk River will see much growth as the Twin City area expands
north. especially after the Hwy 101 upgrade. It makes good economic sense to
prepare for this growth by providing good shopping opportunities. The monetary
gain is only part of the benefit. Each new business provides employment
opportunities for both adults and teenagers.
In closing. a strong and growing economy in Elk River is essential for
everyone. The ci ty counci I and city planners cannot afford to let this
opportunity slip away. The proposed mall project can be a major step toward a
brighter future for Elk River. The time to act is now! Let's all work together
for the benefit of the city, reach a consensus, and allow Elk River to grow in
a way that benefits everyone.

together to resolve any differences, be attentive to all parties concerns, and
