SUBJECT: EASEMENT VACATION REQUEST BY
RICHARD FOSTER/PUBLIC HEARING
CASE NO. EV 93-001
When Hillside Estates First Addition was developed, it was
decided that a possible collector street (identified by the
City's Growth Management Plan in the approximate location of
193rd Avenue east of Highway 169) should be constructed through
this plat. This necessitated a realignment of 193rd Avenue and
Dodge Street to sqq~re up that intersection. This new alignment
resulted in right-of-way that is no longer needed and new
right-of-way that is needed.
Because of long cumbersome legal descriptions to describe that
portion of 193rd Avenue that should be vacated, the applicant
is requesting an entire stretch of 193rd Avenue be vacated and
new easements rededicated. The portion of 193rd proposed to be
vacated is shown on the first map attached to this memo.

attached to this memo.

This map shows the realignment of 193rd Avenue
and Dodge Street to square that intersection.
This map shows that portion of the new road
alignment dedicated through the plat of Hillside
Estates.
This map shows that portion of the new
right-of-way to be dedicated through the plat of
CherryHil1 Bluffs.
This portion of 193rd Avenue will need to
rededicated through an easement from Dale and
Linda Specht, vendors of a contract for deed and
Richard and Anita Foster, vendees of that
contract for deed. This easement will be
replaced by permanent dedication when this
property is platted. This portion of
right~of-way also should be 50 feet wide from the
center line of the road because it is adjacent to
commercial property.
This map shows that portion of 193rd Avenue that
will need to be dedicated through an easement (50

Hagen, vendees of a contract for deed and Gary
and Karen Archambault and Daniel and Teresa
Diebel, vendors of that contract for deed. This
easement would also be replaced when the property
is platted resulting in a permanent dedication.

This map shows the new alignment of 193rd Avenue
and Dodge Street with all the easement and
right-of-way dedications in place.
Staff is recommending approval of vacating
right-of-way as proposed by the applicant with
stipulations:
that portion of
the following
1. The plat of CherryHill Bluffs is recorded prior to
the easement vacation being recorded.
2. Other required easements are obtained for 193rd
Avenue prior to the vacation being recorded. Further,
these easements are 50 ft in width from center line.
3. City Attorney's review of legal descriptions and
title work.
A resolution is attached reflecting approval of this easement
vacation.
The last issue with this easement vacation is that Mr. Foster
is requesting the $150.00 fee be waived. Mr. Foster contends
the City is already rece1v1ng benefit with the new road
alignments being dedicated and the vacation should also be part
of the City's responsibility. Staff is holding Mr. Foster's
check for this fee until a determination is made by the City
Council.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING A ROAD EASEMENT
WHEREAS, a majority of the property owners abutting the road
easement have requested the City Council in a petition
dated February 4, 1993, to vacate such easement
according to law; and,
WHEREAS, a public hearing was held on March 1, 1993, before the
City Council at the Elk River Public Library on such
petition after due published and posted notice had
been given as well as personal notice to affected
property owners on February 19, 1993, and all persons
interested were given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the
City to approve such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby
granted and the road easement described as follows is
hereby vacated:

centerline:

Commencing at the Northeast corner of said West Half of the Southeast Quarter; thence
on an assumed bearing of South 0 degrees 25 minutes 06 seconds West, along the East
line of said West Half of the Southeast Quarter for a distance of 272.04 feet to the
actual Point of Beginning of the centerline to be hereby described; thence South 89

along a tangential curve concave to the northeast having a radius of 126.25 feet and
a central angle of 58 degrees 00 minutes 151 seconds for a distance of 127.83 fe.et;

distance of 150.69 feet; thence northwesterly along a tangential curve concave to the
