RE: HERITAGE LANDING FEASffiILITY STUDY
Dear Council Members:
Attached is a copy of the feasibility study for the proposed Heritage Landing subdivision.
Although this is a rather straightforward plat, there are several more complex issues involved
with providing utility service to it. These issues include the following:
A.
Fresno Street Utility Alignment
The most desirable alignment from an engineering perspective to extend sanitary sewer
and water to Heritage Landing is down Fresno Street. This raises the issues of making
sanitary sewer and water available to the homes adjacent to Fresno Street, but deferring
any assessments similar to Orono Road with the 1992 Western Area Improvements. Also
similar to the 1992 project, if Fresno Street is disturbed for utility construction, it should
be replaced to the current City urban standard including storm drainage facilities to
eliminate the previous drainage problems in the area. These types of improvements wete
assessed to the existing residential lots along Orono Road in 1992.
We would recommend that an informational hearing be held with all the residents
affected by the Fresno Street alignment to discuss the proposed use of this alignment and
to inquire if there is any desire by the residents to look into City utilities throughout their
area.
B.
Fresno Street Assessments
If the precedent established by the previous City Council is followed, the properties
abutting Fresno Street would be assessed for street and storm drainage improvements but
not for sanitary sewer and water improvements. The sanitary sewer and water
improvements would only be assessed if a property owner chooses to hook up or utilities
are extended through the entire neighborhood.

If the City Council agrees with the Fresno Street alignment, there are three options of
financing which could be followed. These are:
1. Install sanitary sewer and watermain, patch street, but not construct storm sewer
at this time. No assessment to abutting property owners. In this case, the City
carries the costs until assessments are made in the future. This option would
have some construction costs duplication when and if permanent streets and storm
drainage improvements are constructed in the future.
2. Install the improvements and assess them all against the benefitting properties at
this time. This would be a change from the action of the previous City Council.
3.
Install the improvements and assess only the street and storm drainage portions
now. The City would carry the cost of the sanitary sewer and water
improvements until properties chose to hook up or utilities are extended through
the entire area. This option follows the action of the previous City Council.
Either option which includes assessments could be pursued concurrently with the
preparation of plans and specifications for the overall improvements. To pursue
assessments against properties abutting Fresno Street would require the City Council to
authorize an amendment to the existing Heritage Landing feasibility study and then
follow up with a public hearing. This would need to be accomplished prior to awarding
a contract to construct any improvements.
c. County Fairground Land Acquisition
Any alignment of utilities from Orono Road to Heritage Landing requires acquisition of
County Fairgrounds property. This issue has been raised with the County previously,
but this project will require the issue to be resolved. This land acquisition can be
pursued concurrently with the preparation of plans and specifications for Heritage
Landing. At a minimum, however, the City will need a right of entry for use of the
County property prior to awarding a construction contract. Failure to acquire this will
delay the Heritage Landing improvements.
D.
Moldenhauer Property
The improvements discussed in the feasibility study also impact the Moldenhauer
property to the east of Heritage Landing. 'The improvements proposed on the
Moldenhauer property are based on a site plan presented to the City. Coordination with

Attached are two resolutions for the City Council's consideration. The fIrst resolution orders
the preparation of an amendment to the Heritage Landing feasibility study to include assessments
against properties along Fresno Street. This action would be necessary if the City Council
desires to assess any of the improvements against properties abutting Fresno Street.
The second resolution orders the Heritage Landing improvement and the preparation of plans
and specifIcations. This resolution assumes the developers and Mr. Moldenhauer are prepared
to waive their rights to a public hearing. If plans and specifIcations are authorized, it should be
contingent on the developers placing an escrow account with the City to cover the cost.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ORDERING THE IMPROVEMENT AND
PREPARATION OF PLANS AND SPECIFICATIONS IN
THE MATTER OF THE HERITAGE LANDING IMPROVEMENT
OF 1993
WHEREAS, the affected property owners proposed to be assessed for the improvement have
waived their right to a public hearing; and
WHEREAS, the City Council has duly considered the Feasibility Report;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. The Heritage Landing improvement is hereby ordered as recommended in the Feasibility
Report dated February 1993.
2.
Maier Stewart & Associates, Inc., is hereby designated as Project Engineer for this
improvement. The Project Engineer is directed to prepare plans and specifications for
the making of the improvement and the solicitation of competitive bids.

A RESOLUTION OF THE CITY OF ELK RIVER
ORDERING A PRELIMINARY FEASffiILITY REPORT IN THE
MATTER OF THE FRESNO STREET IMPROVEMENT OF 1993
WHEREAS the City has determined that it should consider improving certain property by
constructing permanent streets and storm drainage (the improvement); and
WHEREAS Council must first secure a preliminary feasibility study in order to consider
making the improvement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
This matter shall be referred to Maier Stewart & Associates, Inc., who is requested to
provide to the City Council a report advising, in a preliminary way, whether the
proposed improvement is feasible and whether the improvement should thus be made as
proposed or in connection with some other improvement and the estimated cost of the
improvement as recommended.
