TO: MAYOR AND CITY COUNCIL FROM: STEPHEN ROHLF, B & Z ADMINISTRATOR DATE: MARCH 10, 1993 5~ SUBJECT: PETITION FOR EXTENSION OF TRUNK SEWER AND WATER TO THE VIRGINIA BARNIER PROPERTY Staff is in receipt of a petition from Virgina Barnier, property owner, and Dennis Backes, developer, to have the City consider an extension of trunk sewer and water lines from their present location north of Meadowva1e School, westerly to facilitate the platting of Mrs. Barnier's property. There is a map attached to this memo showing this proposed extension. . If the City Council accepts this petition, the City Engineer will prepare a feasibility study. Typically, a feasibility study is not prepared until the City Council has considered preliminary plat so there is some assurance lot design is not changed by Council action. In this case, Mr. Backes is proposing to do the public improvements internal to the plat without City funding. The City project petitioned for only includes the extension of trunk sewer and water lines to Mrs. Barnier's property. Staff feels this petition is not premature and the Council can act on it. If this petition is accepted, staff would hope to present the feasibility study to the City Council at the April 19, 1993, meeting, which would be the same meeting the preliminary plat for Mrs. Barnier's property would be reviewed. Staff recommends the Council accepts the petition and orders a feasibility study with the stipulation that the developer escrow with the City an amount determined by the City Engineer to be sufficient to cover the cost of the preparation of the feasibility study. RESOLUTION 93 - A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION DECLARING THE ADEQUACY OF THE PETmON FOR IMPROVEMENT AND ORDERING THE PRELIMINARY FEASffiILITY REPORT IN THE MATTER OF THE EXTENSION OF TRUNK SANITARY SEWER AND WATER TO SERVE THE PROPERTY LYING WEST OF CSAH #1 IMPROVEMENT OF 1993 WHEREAS the City has received a petition (the Petition) requesting that the City improve certain property by extending trunk: sanitary sewer and water to the property lying west of CSAH #1 (the improvements); and WHEREAS the City has reviewed the Petition and identified the owner of the real property abutting the streets named in the Petition and determined the Petition has been duly executed by the owners of not less than 35 % in frontage of the real property abutting on the streets named in the Petition as the location of the improvements; . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. The Petition is hereby declared to have been signed by the owners of at least 35 % of the frontage of the real property abutting on the streets named in the petition as the location of the improvement. This declaration is made in conformity to Minnesota Statutes, Section 429.035. 2. This Petition is hereby referred to Maier Stewart & Associates, Inc., who is instructed to provided to the City Council a report advising, in a preliminary way, whether the proposed improvement is feasible and whether the improvement should thus be made as proposed or in connection with some other improvement and the estimated cost of the improvement as recommended.
