The applicant is requesting their 80 acres be subdivided into 2
(two) parcels; a 10 acre parcel and a 70 acre parcel.

LEGAL DESCRIPTION
N 1/2 of the SE 1/4 of Section 12, Township 33, Range 26,
Sherburne County, Minnesota.
BACKGROUND
The applicant is requesting an administrative subdivision to
divide an 80 acre parcel into 2 parcels (a 10 acre parcel and a
70 acre parcel). The affected property is located just west of
County Road 70, which is maintained by Anoka County. Both lots
would have frontage on County Road 70.
DIMENSIONAL REGULATIONS

The affected property is located in the Al zoning district
where the minimum lot size is 10 acres with 300 feet of
frontage on a public road. Both proposed parcels would meet
the size requirements. The applicant is proposing to build a
house on the 10 acre parcel and subdivide the remaining 70
acres sometime in the future.

~ BUILDABLE LOT
The Elk River City Code does state that at least 1 continuous
acre of ground must be 4 feet above the high water table to
consider the parcel buildable. It appears from staff's
inspections the 10 acre parcel is relatively flat, possibly
requiring fill being brought in to meet the 4 foot standard.
Soil borings and perc test will be required at the time of
building permit application to show the proper location for the
home and septic system. Due to snow conditions and winter
weather in general, it was difficult to determine the exact
relationship of the high water table with the 10 acre parcel.
Because the site is somewhat marginal, it is staff's opinion
that soil borings and perc tests be conducted to verify a
buildable site before the administrative subdivision is
recorded at Sherburne County. This will ensure the City is not
creating an unbuildable lot. Perc tests and soil borings are
required when a building permit is pulled with the City,
therefore, this request would not cost the applicant any
additional money.

The 70 acre parcel also appears to be flat with a large area of
wetland near the center. The western portion of the property
does slope to high ground, therefore, a buildable site should
not be a problem in this area. The applicant also owns a 40
acre parcel immediately to the west of this site and plans to
develop this parcel along with the 70 acre parcel sometime in
the future. The applicant has been made aware of City
subdivision ordinances and State wetland laws regarding filling
and draining of wetlands.
ACCESS
Because this property abuts Anoka County Road 70, a
review permit will be needed from Anoka County
driveways. I have contacted the Anoka County
Department and it is their policy to require 17
additional right-of-way for road expansion purposes.

DRAINAGE
Drainage is not a concern due to the large size of the parcels
and the large amount of green space.
LEGAL DESCRIPTION
Staff is requesting the applicant provide the City with legal
descriptions of the 2 new parcels.
PARK DEDICATION
~ The applicant will be required to pay $400.00 in park
dedication fees for the additional parcel created prior to
recording the administrative subdivision..

~ RECOMMENDATION
Staff is recommending approval of the administrative
subdivision request by Gwen Peterson as the proposed
subdivision meets the requirements of the City ordinance.
Staff is also recommending the following stipulations be added
to that approval:
1. THE APPLICANT OBTAIN DRIVEWAY PERMITS FROM ANOKA
COUNTY IF NEW DRIVEWAYS ARE CONSTRUCTED ON EITHER
PARCEL AND DEDICATE 17 FEET OF ADDITIONAL
RIGHT-OF-WAY TO ANOKA COUNTY FOR ROAD IMPROVEMENT
PROJECTS.
2. THE APPLICANT PAY $400.00 IN PARK DEDICATION FEES
PRIOR TO THE RECORDING OF THIS ADMINISTRATIVE
SUBDIVISION.
3. THE APPLICANT WILL TAKE SOIL BORINGS AND PERC TESTS
TO VERIFY A PROPER LOCATION FOR THE HOME AND SEPTIC
SYSTEM PRIOR TO RECORDING THIS SPLIT.
