A joint meeting between the Elk River City Counci l and the
Sherburne County Board of Commissioners is scheduled for
MondaYt March 29t 1993t at 7 p.m. The location of this meeting
is the new Elk River City Hall faci lity. We hope to meet in
the large conference room. There is one regular business item
on the agenda (tabled from the 3/15/93 Counci l meeting) before
the joint meeting is scheduled to begin. The main topics of
discussion with the County Board were reviewed in a preliminary
fashion at the 3/22/93 City Counci l meeting.

As the Counci l reviewed on 3/22/93t there is a need for the
City to obtain property in the southeast corner of the

road. The need for this parcel will increase once a plat is
presented for the Lakoduk property. It would be nice to clear
up this situation at this time and identify whether or not the
County wi Ll sell the City the minimum requirement of 1.3 acres
or a larger area of approximately 2.42 acres. The City has
previously indicated that it would be wi lling to pay the fair
market price for this land.
Even if the amount of land to be purchasedt or the price for
this land cannot be determined at this meetingt it is important
for the City to obtain a right of entry from the County in
order to extend uti lities down Fresno Street to provide

entry involves a very small area of property from the County
(approx. 1/4 acrs). It is very important to the City to get
this right of entry finalized within a month so that the
utilities can be extended to these subdivisions in 1993.

The final issue discussed at the 3/22 meeting relates to future
assessments. Depending on future road alignments and the
extension of uti lities, it is anticipated that the fairgrounds
wi II have some future assessments. The amount of these
assessments is unknown at this time. All of the fairground has
been assessed for trunk uti Lities so this is not an issue. The
only issues remaining are lateral uti lity assessments and
street assessments. Future street alignments within a Lakoduk
plat wi ll, in part, determine future County assessments.

The City has recently adopted a resolution requesting the
County to proceed with a County Road 1 improvement project in
Elk River in 1994. This resolution is attached for your
review. It is very important to the City that this project
move forward in 1994 in order to provide better arnj safer
access for Meadowvale School, for the Elk River Industrial
Park, and for future residential development near the golf
co uro",..e.
Another issue that has generated a great deal of discussion by
the City Counci l is Anoka County Road 22 as it enters into the
City of Elk River from Anoka County. Concern has been
expressed about how a Large number of vehicLes in the future
wi Ll make their way in a LogicaL manner to Highway 169. The
City hopes to review this issue during a discussion on its
Master Transportation PLan, but Anoka County Road 22 enters
into the City on a Sherburne County road and this issue wi LL
need both City and County cooperation in order to avoid future

Two major ditches run through the City of Elk River. One is
Ditch 28 on the west side of the City and one is Ditch 10,
mainLy on the east side of Highway 169. County Ditch 28
flooding and repairs that took place in 1991 were discussed at
the Last Joint meeting and there was a decision by the County
Board to take no further action on this ditch. It may be
appropriate for the City Courn:i l to formalLy request that the
County Board firn1 out how much a redetermination of benefit
would cost, and once this amount is analyzed, evaluate whether
or not the redetermination of benefits should take place.

The City is experiencing storm drainage probLems east of its

time it is premature to say too much about this issue other
than we wi LL need to work with the County on the City storm

SOLID_weSIE_ISSUES
As_ilm~_.11QW5, it may be appropriate to discuss soLid waste
issues with the County Board. The City has discussed
consoLidating its Landfi lL reguLation efforts with the County
in terms of using the same Environmental Consultant. Using the
same consuLtant wouLd financially benefit the Landfi LL.
Last year the City was disappointed with its allocation through
the SCORE program. The City received about $4,000 from a
County pool of over $123tOOO. The SCORE program calls for
proposals by the end of Apri l, 1993, arnj it may be appropriate
for the City and County to discuss eligible SCCmE activities.
The Counci L annualLy reviews and approves the City proposal.
Two new programs currently being evaluated by staff include
used oi l coLLection and composting.

Pursuant to due call and notice thereof, the joint meeting of the Elk River
City Council and Sherburne County Board of Commissioners was called to order
by Chairperson Klinzing.
DISCUSSION ON FAIRGROUND ASSESSMENTS
Chairperson Klinzing requested that the City present an overview of the
sewer and water project that is under construction and how the assessments
for these public improvements would affect the County Fairground property.
Pat Klaers, City Administrator, reviewed the information that was presented
at the City Council public improvement public hearing and the information
that was presented to the Sherburne County Board by the City Engineer and
the City Administrator a few months ago. The project calls for the
extension of the trunk sanitary sewer and trunk water lines out to the
eastern edge of the Sherburne county Fairgrounds. At this time, it is
estimated that the assessments for these public improvements to the
benefitted properties will be approximately $3,800 per acre ($1y800 per acre
for sanitary sewer and $2,000 per acre for water). Additionally, the City
Administrator indicated that lateral sewer and water lines are running from
this trunk system to the north to Highway 10. These lines would abut the
southeastern corner of the Fairground properties and consequently some
assessments for lateral benefit may also be placed upon the Fairground
property. The amount of the lateral assessments are estimated to be $22.30
per front foot for lateral sanitary sewer and $17.75 per front foot for
lateral water.
The City Administrator indicated that there are no known deferment options
for the County. The interest rate for the assessments is proposed to be
7.5%. It was indicated that the assessments can be structured for either a
10, 15 or 20 year time payment frame.
Discussion took place regarding the need for the City to obtain property in
the southeast corner of the Fairgrounds in order to extend the Parkway road

system. The City indicated that it would be willing to pay fair market ~
value for this land (about 2 acres at a minimum).
Commissioners questioned whether or not the zoning of the property for the
Fairgrounds affects the assessment amounts. The City Engineer indicated
that zoning is not relevant to the trunk or lateral assessments for sanitary
sewer and water.
Commissioners questioned whether or not the assessments amounts exceed the
benefit to the property. It was noted that it may be in the County's best
interest to obtain appraisal for the Fairgrounds in order to determine
whether or not the assessments exceed the benefit and in order to determine
the fair value of the land that the City needs for the Parkway. A City
appraisal from 1989 indicates that the assessment amounts do not exceed the
benefit.
A general discussion took place regarding the County Fair and options that
the County has for the Fair in future years. Discussion included the
possibility of moving the Fairground and also allowing the Fairgrounds to be
used for other activities throughout the calendar year on a rental basis in
order to generate additional revenues.
County Commissioners indicated their strong desire to have the assessments
to the Fairground reduced.
Councilmember Holmgren presented the concept of the City purchasing all or ~
part of the Fairground property in order to ensure that the Fair remains in ..,
Elk River and in order to obtain control over the parking area adjacent to
the softball complex.
County staff and City staff were directed to further discuss options for the
County as it relates to the proposed assessments to the Fairgrounds and the
need for the City to obtain property from the County for extension of the
Parkway.
DISCUSSION ON DITCH 28
County Coordinator, David Loch, indicated that Ditch 28 is 13.15 miles in
length and has three different "legs" which flow into the Elk River. The
areas of concern are some tiles in Elk River that are crushed or blocked in
various locations which stops the flow of water and causes water to back up
onto residential property. It was indicated that the ditch was installed in
1922 and that the County has responsibility for maintenance of the ditches.
Discussion took place regarding the assessments for ditch work and it was
noted that the costs are passed on to the benefitted property ownerS which
includes the City and County for the streets. A Determination of Benefit
was discussed and it was noted that this process is very costly and also
assessed to the benefitted property owners in the district. It was noted
that it would cost about $30,000 to do a Determination of Benefit and up to
1.5 million dollars to upgrade the ditch system.

Attached for your information is a resolution regarding CSAH 1
in Elk River that was approved by the Elk River City Council on
February 15, 1993. Also attached is a memo from the City
Engineer, Terry Maurer, regarding this project. The City
Council strongly concurs that this a necessary and needed
project in Elk River and supports this project happening in
1994. In this regard, we are pleased that the City Engineer
can hold the billing for this project until funding is
available.

I anticipate that this will be the topic of discussion during
our joint City Council and Sherburne County Board of
Commissioners meeting that is scheduled for March 29, 1993, at
the new Elk River City Hall facility. If it is possible, it
may be appropriate for the County Board to review this issue
prior to the joint meeting. The City looks forward to working
with the County on this very high priority improvement project.

Dear Mr. Klaers:
Last week, we had an opportunity to discuss the upgrade of CSAH 1 further to the north and
west with Russ Matchinsky, Sherburne County Engineer. Mr. Matchinsk.1' agreed that the
road should be improved from the point where the 1991 project terminated past the new school
and industrial park to approximately County Road 32. He indicated his funding sources were
committed for 1993, but he may have funding available in 1994.
He also indicated it may help if the City were willing to front end the costs to design the
project in 1993 for 1994 construction. We understood the County would then reimburse the
City in 1994 when funding was available. Along these lines, Maier Stewart & Associates
would be prepared to enter into an agreement with either the City or the County whereby we
would perform the design work on CSAH 1 in 1993 and hold any billing until early 1994
when funding is available.
We have prepared the attached resolution for t..1e City Council's consideration. The resolution
requests the upgrade of CSAH 1 in 1994 and indicates the City is willing to advance the cost
of the project design in 1993.

FROM THE INTERSECTION WITH COUNTY ROAD 77 TO THE
INTERSECTION WITH COUNTY ROAD 32 FOR 1994
WHEREAS, the City of Elk River is experiencing rapid growth along the CSAR 1 corridor
including the new elementary school, development in the industrial park, and
proposed single family development; and
WHEREAS, the entire area surrounding and adjacent to the CSAH 1 corridor is within the
City of Elk River's urban service area; and
WHEREAS, the volume of traffic on CSAH 1 continues to increase;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:

1. The City requests that Sherburne County consider the upgrade of CSAH 1 to a four lane
facility from the intersection with County Road 77 (proctor A venue) to the intersection
of County Road 32.
2. The City requests that this upgrade be programmed to be constructed in 1994.
3. The City of Elk River is willing to enter into an agreement with the County to perform
the project design in 1993 with reimbursement from the County in 1994 when funding
is available.
