JOINT MEETING OF THE ELK RIVER CITY COUNCIL AND THE SHERBURNE COUNTY BOARD OF COMMISSIONERS HELD AT THE ELK RIVER CITY HALL - CONFERENCE ROOM A MONDAY, MARCH 29, 1993 Councilmembers Present: Mayor Duitsman, Councilmembers Holmgren, Dietz, Farber and Scheel County Commissioners Present: Chairperson Schumacher, Engstrom, Johnson, Smith and Friedl City Staff Present: Pat Klaers, City Administrator; Steve Rohlf, Building and Zoning Administrator; Mark Graham, City Engineering Firm County Staff Present: Kathy Heaney, County Attorney's Office; Tom Hayes, County Attorney; Dave Loch, County Coordinator Also Present: Representatives of the Sherburne County Fairboard 1. Call Meeting To Order Pursuant to due call and notice thereof, the joint meeting of the Elk River City Council and Sherburne County Board of Commissioners was called to order at 7:00 p.m. by Mayor Duitsman. 2. Consider 3/29/93 City Council Agenda COUNCILMEMBER FARBER MOVED TO APPROVE THE 3/29/93 CITY COUNCIL AGENDA. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. 3. Administrative Subdivision/Gwen Petersen/Public Hearing (Continued) Building and Zoning Administrator, Steve Rohlf, updated the City Council on the status of this request. Steve indicated that this issue was continued from the March 15, 1993, meeting so that perc test and soil boring data could be obtained and evaluated. Steve reviewed his 3/22/93 memo on this administrative subdivision request. Steve indicated that this is not a buyer beware situation and that there are building construction limitations on this site. Steve outlined the three City requirements that will be imposed on the property owner when a house is constructed on this site. COUNCILMEMBER SCHEEL MOVED TO APPROVE THE ADMINISTRATIVE SUBDIVISION REQUEST FOR GWEN PETERSEN WITH THE FOLLOWING STIPULATIONS: 1. SEPTIC SYSTEM BE REQUIRED TO BE A MOUND SYSTEM AND THE LOWEST FLOOR (CRAWL SPACE OR BASEMENT FLOOR) IS ONE FOOT ABOVE MOTTLED SOIL. FURTHER, THAT IS IS THE APPLICANT'S RESPONSIBILITY TO ENSURE THE ONE FOOT FROM MOTTLING IS ACCOMPLISHED. . . . Joint Meeting of Elk River City Council/County Board Monday, March 29, 1993 Page 2 2. THE APPLICANT PAY $400.00 IN PARK DEDICATION FEES PRIOR TO THE RECORDING OF THIS ADMINISTRATIVE SUBDIVISION. 3. SIXTY FEET OF RIGHT-OF-WAY MEASURED FROM THE CENTER LINE OF THE COUNTY ROAD IS GRANTED TO ANOKA COUNTY. ANOKA COUNTY WILL PROVIDE THE EASEMENT DOCUMENTS. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. 4. Joint City Council and Sherburne County Board of Commissioners Meeting Mayor Duitsman thanked discuss issues of mutual attendance took place. the County Board for coming to this meeting to concern and introductions of everyone in Mayor Duitsman and Chairperson Schumacher led a discussion on the topics that were discussed at the last joint meeting held on 6/25/92 and what activities have taken place since that meeting. A 10/17/92 West Sherburne Tribune article was distributed which outlined the County Board discussion on the options available related to the fairgrounds assessments, expansion, and/or relocation. 4.1. Discussion on City and County Fairground Issues Mayor Duitsman requested Mark Graham to provide some background on the City's need for road right-of-way in the southeast corner of the fairground property. Mark distributed two maps which showed the general location of Orono Parkway and the two options that are being evaluated for right-of-way from the County for this parkway to continue to the west. Mark indicated that it is the intent of the City to have the parkway intersect with a north/south street between Highway 10 and County Road 30 in the vicinity of Joplin Street. Orono Parkway on the south and Joplin Street on the west would, at this time, be proposed to abut County property. Utilities would also be extended when the parkway construction takes place. General discussion took place regarding the road alignment and the need to save trees on the Lakoduk property as a wooded area is immediately south of the fairgrounds in the location where the road needs to be extended. It was the general consensus of the Fairboard and the County Board that the City should request and obtain as little property from the County as necessary for this road extension. A general discussion took place between the County Board and the County Fairboard regarding the existing parking lot, expansion of the fairgrounds to the west, access to the County fairgrounds from the south, and the Commission that has been established to study this situation. The major focus of this discussion was whether or not the County should sell the City the parking lot immediately west of the softball fields and retain use of this parking area during the County Fair (and other County functions) and then also obtain additional land on the west side of the fairgrounds in exchange for selling the City this fairground parking lot. Discussion also took place regarding future assessments to the County for street, storm sewer, lateral water . . . Joint Meeting of Elk River City Council/County Board Monday, March 29, 1993 Page 3 and lateral sewer improvements. The City Administrator noted that it is uncertain as to the amount of future assessments to the County fairgrounds due to the uncertainty of the road locations, but that it was believed that assessments would be levied against the fairgrounds in the future. In this regard, the fairgrounds would be treated no differently than any other property in the City. Mayor Duitsman indicated that the City would be interested in pursuing the purchase of the road right-of-way land and the parking lot west of the softball fields. In exchange, the City would obtain land during the development process west of the fairgrounds and sell this land to the County. Mark Graham indicated that due to the construction season and timing of improvements south of County Road 30, it was important for the City to obtain a right of entry in this southeast corner at this time. Discussion took place regarding the timing of these public improvements and the County stressed that all work must be completed by July 1 in order to prepare for the July 22-26 County Fair. COMMISSIONER ENGSTROM MOVED TO PROVIDE THE CITY WITH A RIGHT OF ENTRY ACROSS THE COUNTY FAIRGROUND PROPERTY IN ORDER FOR THE CITY TO ACCESS FRESNO STREET WITH MUNICIPAL UTILITIES PROVIDED THAT ALL WORK AND RESTORATION IS COMPLETED BY JULY 1, 1993. COMMISSIONER FRIEDL SECONDED THE MOTION. THE MOTION CARRIED 5-0. COUNCILMEMBER HOLMGREN MOVED TO HAVE THE CITY STAFF WORK WITH THE COUNTY STAFF AND REPORT BACK TO THE CITY COUNCIL AND COUNTY BOARD IN ABOUT THREE MONTHS ON THE ISSUES DISCUSSED AT THIS MEETING INCLUDING ROAD ACCESS AND ALIGNMENT; FUTURE IMPROVEMENTS TO BE ASSESSED AGAINST THE FAIRGROUND PROPERTY; IMPROVEMENTS TO THE PARKING LOT WEST OF THE SOFTBALL FIELDS; AND THE POSSIBLE PURCHASE OF THIS PARKING LOT BY THE CITY IN EXCHANGE FOR LAND WEST OF THE FAIRGROUNDS. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. 4.2. Transportation Issues The City request for County improvements to CSAH 11 in Elk River were reviewed by the County Board and the City Council. This request is outlined in City Resolution 93-4, and in a letter to the City Administrator from the City Engineer dated 2/5/93. The City indicated its strong desire to have this road improved to four-lane status from where the public, improvement project ended in 1991. The four-lane improvements along Proctor Avenue and County Road 1 ended near the daycare facility before Meadowvale School. These improvements on this road are desired based on the school location, the industrial park location; and future residential development in the area. It was indicated that the City Engineer has discussed this with the County Engineer and that the County Engineer was in favor of this project taking place. There was general support by the County for this project, but the County Board indicated it would want to review this improvement project with the new County Engineer once that individual is hired. A brief planning discussion took place in Sherburne County regarding the need and in the City of for Elk long range River for . . . Joint Meeting of Elk River City Council/County Board Monday, March 29, 1993 Page 4 transportation routes entering into the City and County on the eastern boundary of the City at Anoka County Road 22. This Anoka County road meets Sherburne County Road 13 in Elk River and over the next twenty years, significantly more vehicles are anticipated on this road. Concerns discussed included how to move these people to Highway 169 in an orderly manner. 4.3. County Ditch System Chairperson Schumacher briefly discussed with the City Council drainage problems in the County and concerns regarding County Ditch 28. Discussion took place regarding residential development in this vicinity which the County believes has added to the drainage problems and maintenance of this County ditch. Mayor Duitsman discussed County Ditch 10 and the reconstruction of Highway 101. Mayor Duitsman indicated that the City and the County need to plan for the future and provide drainage around or through this intersection when construction takes place. Chairperson Schumacher discussed the County Board member Klinzing is year. This legislature relates to County jurisdiction. special legislation that former introducing at the Legislature this urban ditches being removed from 4.4. Solid Waste Issues Due to the lateness of the evening and the meetings of both the City Council and the County Board on Tuesday, no solid waste issues were discussed. 5. Other Business/Staff Updates No items were discussed at this time. 6. Adjournment There being no further business, MAYOR DUITSMAN MOVED TO ADJOURN THE MEETING. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0.
