REQUESTED ACTION
The applicant is requesting a conditional use permit to
temporarily locate a 12'x60' trailer for a 4-6 month period to
house office personnel during construction of a new facility.

LEGAL DESCRIPTION
All that part of the SE 1/4 of the SW 1/4 and the W 1/2 of the
SE 1/4, Section 28, Township 33, Range 26, Sherburne County,
Minnesota. A complete legal description is available at City

Staff refers the Council to Section 900.42 titled "Conditional
Use Permits," beginning on page 9.118 of the City of Elk River
Code of Ordinances. With the following discussion, staff will
address the seven standards for a conditional use permit
request found in Section 900.42:

i.
To ensure the temporary trailer will not endanger anyone,
staff is recommending it be anchored. This is the same
requirement placed on trailers in a mobile home park.
ii. The temporary trailer will be used as part of Tescom's
industrial operation. Staff feels this request is
consistent with the comprehensive plan.
iii. Staff feels that a trailer located permanently in an
industrial park could impede the normal and orderly
development of surrounding properties and have a negative
effect on property values in this area. Staff does not
feel this is a great concern as this request is for a
temporary trailer. However, a maximum time limit should
be set for this use and the trailer should be allowed only
after building permit application is made for the
permanent structure to ensure it is a temporary use.
iv. The trailer is proposed on the site in such a way that it
should not have a negative effect on the issues raised in
this standard. The proposed location can be identified on
the attached site plan. The trailer will temporarily take
up some parking spaces, however, the trailer is 12 feet
wide and the parking spaces are 18 feet long. This leaves
4 feet for people to exit the trailer without being
directly in the driving lane of the parking lot.
v. Staff feels this request meets this standard.
vi. Staff feels this request meets this standard.
vii. A building permit will be required to locate a trailer on
the Tescom site. Staff believes the trailer will be
required to be handicap accessible, anchored, and have the
appropriate State seal certifying the trailer construction
complies with Minnesota Building Codes.
RECOMMENDATION
The Planning Commission agreed with staff's finding and is
recommending approval of Tescom's request for a conditional use
permit to temporarily locate a 12x60 foot trailer on their
site, with the following stipulations:
1. THE TRAILER BE ALLOWED ON THE TESCOM SITE ONLY AFTER
THE BUILDING PERMIT FOR THE PERMANENT STRUCTURE HAS
BEEN APPLIED FOR AND THE TRAILER BE REMOVED NO LATER
THAN OCTOBER 31, 1993.
