LESLIE ANDERSON/PUBLIC HEARING CASE NO. AS 93-02 Mr. and Mrs. Anderson are requesting to subdivide a 17.9 acre parcel into three parcels. Map #1 attached to this memo shows the location of the affected property. ADMINISTRATIVE SUBDIVISION PROCEDURE An administrative subdivision is typically a shortened version of a plat where lots splits result in platted legal descriptions. The City does allow the creation of one additional residential lot resulting in a metes and bounds description. You will note the Andersons are requesting two additional lots with metes and bounds descriptions. . In 1989, a Mr. Robert Bowersox, the previous owner of this parcel, was given approval to subdivide the 17.9 acre parcel in question into a 10 acre parcel and a 7.9 acre parcel. The two parcels are noted on the attached Map #2. The deed from Mr. Bowersox to the Andersons had one legal description for the 17.9 acres in question and, consequently, inadvertently combined the two lots. Staff recommends the Council consider the 17.9 acre parcel as currently two parcels, therefore, the Andersons are requesting to create one additional lot and rearrange two existing lots. This meets the City requirements regarding lots described by metes and bounds. PARK DEDICATION When Mr. paid Park created. additional Bowersox split the 17.9 acre parcel into two lots, he Dedication Fees for one additional lot being Staff recommends that the Andersons pay for one more lot being created from this parcel ($400). COUNTY REVIEW . Staff was unable to obtain comment from the County Engineer's office regarding additional right-of-way along County Road #32 prior to this memo. Staff does anticipate the County requesting 17 feet of additional right-of-way along County Road #32. This can be accomplished by easement which will not affect setbacks or lot size. Driveway permits from the County will also be required to construct houses on the two vacant lots. County Road #32 is a straight road in the location of the lots in question and staff does not anticipate problems with driveway permits being issued. LOT SIZE The property in questions lies within an R-1a zone. The mlnlmum lot size is 2-1/2 acres with 160 foot of frontage. The three lots in question meet these requirements. The existing buildings on the middle lot also meet R-1a setbacks from the newly created lot lines. SUITABLE BUILDING SITES The two vacant parcels in question appear to staff to have adequate ground for building and septic system. Perc tests will be required prior to building permit issuance. RECOMMENDATION . Staff recommends approval of this administrative subdivision request with the following stipulations: 1. The applicants pay $400 in Park Dedication Fees for the one additional lot created. 2. That 17 feet of additional right-of-way along County Road #32 is granted by easement to the County, if so required. 3.
