FEASffiILITY STUDY
Dear Council Members
Attached is a copy of the feasibility study for the extension of trunk sanitary sewer and water to the area
west of County Road 1. This area includes the proposed plat of Meadowvale Heights.

The feasibility study proposes lateral sanitary sewer and water assessments against a parcel of Nord
property east of County Road 1, trunk sanitary sewer and water and lateral water assessments against
the Meadowvale Heights development, and trunk sanitary sewer and water assessments against the Nord
property immediately north of the Meadowvale Heights plat. However, the assessments against the Nord
property north of the Meadowvale Heights are recommended to be deferred with no interest because the
water system cannot serve this area without an additional well and tower.
The developer of the Meadowvale Heights project is anxious to proceed with these improvements and
has indicated a willingness to waive his rights to a public hearing. To eliminate the need for a public
hearing also requires the Nords to waive their rights. In addition, the project requires the acquisition
of a utility easement from the Nords. Staff would recommend negotiating a deferral of the Nord lateral
assessments in exchange for the necessary easements. If the City Council agrees with this approach,
staff would recommend the City Council consider the attached resolution authorizing preparation of plans
and specifications. If an acceptable agreement cannot be reached with the Nords, a public hearing can
be held at a later date.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ORDERING THE IMPROVEMENT AND
PREPARATION OF PLANS AND SPECIFICATIONS IN
THE MATIER OF THE TRUNK SANITARY SEWER AND
WATER IMPROVEMENT FOR THE AREA WEST OF COUNTY ROAD 1
OF 1993
WHEREAS, the City Council has duly considered the Feasibility Report;
WHEREAS, the property owners proposed to be assessed for the improvements have waived
their rights to a public hearing;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1.
The trunk sanitary sewer and water for the area west of County Road 1 improvement is
hereby ordered as recommended in the Feasibility Report dated April 15, 1993.
2. Maier Stewart & Associates, Inc., is hereby designated as Project Engineer for this
improvement. The Project Engineer is directed to prepare plans and specifications for
the making of the improvement and the solicitation of competitive bids.
