TO: FROM: MAYOR & CITY COUNCIL PHIL HALS, STREET/PARK SUP~ DATE: APRIL 28, 1993 SUBJECT: RIGHT OF WAY EXCHANGE 221ST AVENUE In 1992, I was contacted by Richard Bury, owner of a gravel pit on 221st Avenue. Mr. Bury's property lies on the north and south side of 221st Avenue, from Quinn Street east for 1/4 mile. Mr. Bury is planning to install a permanent truck scale for his operation and it would be to his advantage if the City would relocate 221st Avenue north of its present location and eliminate four curves and some very limited sight distances. Mr. Bury will exchange the property for the new road alignment at no cost to the City, and if the City will do the construction in 1993, Mr. Bury has offered to furnish the Class 5 road base at no charge. . I believe that this is a win-win situation that allows the City to correct a major right-of-way issue on an MSA route, take advantage of an offer for free material, and accommodate a property owner. I strongly recommend that the Council authorize Maier Stewart to prepare the right-of-way documents and authorize me to solicit quotes for contractors to build the road grade. . P.O. Elk River, Minnesota 55330 Dear Phil, As per our conversation at our meeting on April 1, 1993, I am happy to confirm our offer of furnishing the gravel needed for the gravel surface on the alignment change for 221st Avenue N.W. . Once these plans have been decided on, it is quite important to us, in our planning, that they proceed as soon as possible. Therefore, it is with this offer that we hope to encourage the City of Elk River to accomplish the realignment of 221st Avenue during the 1993 construction season. On behalf of myself as o'vner, and Midwest Asphalt as pit lessee, we hereby offer to furnish the gravel necessary (up to 1,000 tons) for the base surfacing on the realignment construction of 221st Avenue N.W. provided this work is accomplished prior to April 1, 1994. Gravel Base meeting MHD spec Class 5 will be furnished cost free to Elk River F.O.B. your or your Contractor's trucks at our stockpiles adjacent to the roadway construction, Mon. - Fri. between the working hours of h:30 - 4:30 P.M.
