Overview
The City Council reviewed and approved the preliminary plat for this project on May 1,
2006. During the review process, concerns were raised regarding the 4/40 acre density rule,
with Council directing staff to research possible amendments. Staff is currendy researching
options for consideration, and anticipates information being forwarded to the Council in the
coming months.
The applicant is now requesting Final plat approval of Carverwood Hills. The applicant is
proposing to subdivide 53 acres into 5 residential lots. The property is located on the east
side of Brook Road (County Rd 21) at 213th Ave. alignment. The plat includes four 2.5 acre
lots and one 41 acre lot.
Analysis
It appears that the Final Plat addresses comments and conditions imposed during the
preliminary plat review. Of the 18 conditions originally imposed by the Council on the
property, most of these will be manifested in the development agreement or the
construction drawings.
Landscapina
One of the conditions imposed was the provision of a landscape plan showing 2 overs tory
trees per lot and 4 trees per corner lot. A landscape plan was provided, and shows the
location of 10 "mature" spruce trees throughout the development. Lot 1, block 1 and 2 are
considered a corner lot, and additional trees should be added. The plan is not developed by
a Landscape Architect. It is suggested that a condition be added that additional trees be
added, and that these trees be 2.5 inch Oak, Maple, Linden, or other variety approved by
City Staff.
Natural Resource Inventory
The Natural Resource Inventory does indicate several natural resource areas on the property.

Given the Comprehensive Park Plan, the Parks and Recreation Commission recommend
that park dedication be paid in the form of cash, or $11,760 for 4 lots.
Recommendation
Staff recommends that the City Council approve the Final Plat subject to the following
conditions:
1. A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED OUTLINING THE
TERMS AND CONDITIONS OF THE PLAT APPROVAL AND INSTALLATION OF
IMPROVEMENTS PRIOR TO RELEASING THE PLAT FOR RECORDING.
2. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100%
OF THE COSTS OF PUBLIC IMPROVEMENTS.
3. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM
ACCEPTED BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE
IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY FOR A ONE YEAR
PERIOD.
4. SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE
CITY AT THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING THE PLAT
FOR RECORDING.
5. SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY
ENGINEER BE PAID TO THE CITY PRIOR TO RELEASING THE PLAT FOR
RECORDING.
6. THE NECESSARY DRAINAGE AND UTILITY EASEMENTS BE DEDICATED ON
THE PLAT AS REQUIRED BY THE CITY.
7. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED.
8. ALL APPROPRIATE WETLAND PERMITS MUST BE OBTAINED PRIOR TO
COMMENCING WORK ON THE SITE.

ISSUANCE OF BUILDING PERMITS.
10. ALL GRADING WILL NEED TO BE CERTIFIED PRIOR TO THE ISSUANCE OF
BUILDING PERMITS.
11. STREET LIGHTS SHALL BE INSTALLED AS RECOMMENDED BY ELK RIVER
MUNICIPLAL UTILTIIES.
12. THE LETTER OF CREDIT SHALL COVER WETLAND MITIGATION. DRAINAGE
EASEMENTS SHALL BE IN PLACE OVER THE WETLAND AND THE WETLAND
MITIGATION AREAS.
13. RESTRICTIVE COVENANTS SHALL BE RECORDED ON THE WETLAND AND THE
WETLAND MITIGATION AREAS.
14. A THREE YEAR MONITORING REPORT ON THE WETLAND MITIGATION IS
REQUIRED.

As requested, we have reviewed the proposed final plat of Carverwood Hills Addition as
prepared by Bogart, Pederson & Associates. As you are aware, Carverwood Hills is east of
County Road 121 and north of CSAH 33. It is proposed to be developed based on a 4 lot
per 40 acre concept with provisions for future lots when zoning changes to 2-lh acres.
Therefore, it is proposed to be divided into five buildable lots with a cul-de-sac road off of
County Road 121 (Brook Road). The remaining portions of the property will be platted as
three separate outlots. Outlot A and C can be future buildable lots when the zoning
changes. Outlot B is for future road right-of-way.
Sherburne County has reviewed the proposed access onto County Road 121 and has agreed
to allow a temporary access, requiring that as future development in the area occurs and the
appropriate spacing for access points onto County Road 121 are constructed, this access of
213th Court be cul-de-saced at County Road 121. The plat shows the necessary right-of-way
for a future cul-de-sac. Sherburne County's letter requires that the City of Elk River develop
and administer a binding agreement with the developer to ensure the future closing of 213th
Court. It is likely that by the time the road needs to be closed, the development will be fully
built out and the developer will no longer be available to make the closure. Therefore, the
City should require a deposit of $15,000 to cover the expense of the future closing of 213th
Court.
Carverwood Hills final plat should also be required to pay a sealcoat impact fee of $4,000.
The construction plans are currently being reviewed. Therefore, the final plat mylars should
be reviewed prior to recording to ensure that all necessary drainage and utility easements are
granted on the plat document.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Carverwood Hills

w:H.ERE.AS, application has been made for final plat approval, pursuant to Section
1008.08 (l)(c) of the Elk River City Code of Ordinances, of the property legally described on
attached Exhibit A and hereinafter referred to as "the Property"; and
w:H.ERE.AS, the application for preliminary plat approval has been referred to the
Planning Commission which has given its advice and recommendation to the City Council;
and
w:H.ERE.AS, a preliminary plat of the Property was approved by the City Council on
May 1, 2006; and ,4
w:H.ERE.AS, the proposed final plat is consistent with the preliminary plat as
approved by the City Council; and
w:H.ERE.AS, the proposed final plat complies with each of the conditions set forth
by the City Council in its approval of the preliminary plat of the Property;
NOW, TIffiREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed subdivision is consistent with the Zoning Ordinance and
conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional plans including, but not limited to, the City's
Comprehensive Development Plan.
C. The physical characteristics of the site, including, but not limited to,
topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to
flooding, and drainage are suitable for the type and density of development and uses
contemplated.
D. The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage transportation, erosion control and all other services, facilities and
improvements otherwise required herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the fmal plat as required by law
and shall fIle proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
5. This fmal plat approval shall expire one year from the date of this resolution if the
final plat is not recorded within that time.

EXHIBIT B
Conditions:
1. A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED OUTLINING THE
TERMS AND CONDITIONS OF THE PLAT APPROVAL AND INSTALLATION OF
IMPROVEMENTS PRIOR TO RELEASING THE PLAT FOR RECORDING.
2. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100%
OF THE COSTS OF PUBLIC IMPROVEMENTS.
3. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM
AOCEPTED BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE
IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY FOR A ONE YEAR
PERIOD.
4. SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE
CITY AT THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING THE PLAT
FOR RECORDING.
5. SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY
ENGINEER BE PAID TO THE CITY PRIOR TO RELEASING THE PLAT FOR

6. THE NECESSARY DRAINAGE AND UTILITY EASEMENTS BE DEDICATED ON
THE PLAT AS REQUIRED BY THE CITY.
