However, tabulations of the construction bids and a recommendation will be available at the City Council meeting on Monday, May 17. As you are aware, a public hearing for the street and storm drainage improvements on Fresno Street is also scheduled for Monday evening's meeting. It is necessary to complete the public hearing prior to considering the award of any bids. Therefore, if for some reason the public hearing is not concluded at Monday evening's meeting, the City Council will not be able to consider the award of the Heritage Landing bids. These include the internal street and utility improvements for Heritage Landing, site grading for Heritage Landing, utilities, street and storm drainage improvements along Fresno through Orono Lake ill Addition, and street utility and drainage improvements through a portion of Mississippi Oaks. An analysis of the Heritage Landing Feasibility Study relative to LaTour Construction's low bid indicates that the construction cost is approximately 10% less than the estimate contained in the Feasibility Study. Prior to considering this draft resolution, the City Council must conclude the public hearing for the Fresno Street improvements and pass the resolution ordering those improvements. RESOLUTION 93 - A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT IN THE MATTER OF THE HERITAGE LANDING AND FRESNO STREET IMPROVEMENT OF 1993 WHEREAS pursuant to Resolution 93-18, competitive bids were solicited and received for the Heritage Landing and Fresno Street improvement as set forth in the bid tabulation attached hereto and incorporated herein by this reference; and WHEREAS the City Council has considered the amount of the bids and the responsibility of the bidders and determined that LaTour Construction is the lowest responsible bidder; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. The Mayor and City Administrator are authorized and directed to execute, on behalf of the City, such contract with LaTour Construction as is approved by the City Attorney for the completion of the Heritage Landing and Fresno Street improvement according to the approved plans and specifications designated in Resolution 93-18. 2. The City Administrator is authorized and directed to forthwith return to all bidders the deposits made with their bids upon execution of the contract above specified.
