May 12, 1993 File: 230-163-10 Honorable Mayor and City Council City of Elk River P.D.Box 490 13065 Orono Parkway Elk River, MN 55330 RE: CHERRYHILL BLUFFS 2ND ADDffiON FEASffiILITY STUDY Dear Council Members: e Attached is a copy of the feasibility study for the Cherryhill Bluffs 2nd Addition development. This development lies immediately north of the MnDOT maintenance facility adjacent to Trunk Highway 169. Authorization for this feasibility study was given by consensus of the City Council contingent upon the development placing an escrow account in order to keep the project moving forward. The feasibility study technically was not authorized by resolution because at the time it was considered, the preliminary plat had not gotten to the City Council. Therefore, it is appropriate for the City Council to consider the attached draft resolution authorizing the feasibility study. At this time, the final plat is not ready for presentation to the City Council because of the issues of land ownership. As you are aware, the City has negotiated the sale of approximately five acres of land to the developer which are contained within this plat. In addition, a strip of land 66 feet wide is owned by the Minnesota Department of Transportation and was previously used for access onto Trunk Highway 169. The City has requested release of this property such that it can be contained within the plat of Cherryhill Bluffs 2nd Addition. However, at this time, MnDOT has not responded as to the timing of the release of the property. Depending on the timing of the release, it may be necessary to plat the 2nd Addition minus the MnDOT owned property. In the future when this is released, it can be platted as phase 3. The developer has requested that the preparation of plans and specifications move forward at the same time that the final plat is being completed. Attached for the City Council's consideration is a draft resolution authorizing the preparation of plans and specifications. We would recommend that the preparation of plans and specifications be contingent upon the developer placing an appropriately sized escrow with the City prior to any work beginning. e 1959 SLOAN PLACE, SUITE 200. TJM:tp Attachments 163-1209.IJIllY e e RESOLUTION 93 - A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION DECLARING THE ADEQUACY OF THE PETITION FOR IMPROVEMENT AND ORDERING THE PRELIMINARY FEASffiILITY REPORT IN THE MATTER OF THE CHERRYHILL BLUFFS 2ND ADDmON IMPROVEMENT OF 1993 WHEREAS the City has received a petition (the Petition) requesting that the City improve certain property by extending sanitary sewer, water, storm sewer, and streets (the improvements); and WHEREAS the City has reviewed the Petition and identified the owner of the real property abutting the streets named in the Petition and determined the Petition has been duly executed by the owners of not less than 35 % in frontage of the real property abutting on the streets named in the Petition as the location of the improvements; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. The Petition is hereby declared to have been signed by the owners of at least 35 % of the frontage of the real property abutting on the streets named in the petition as the location of the improvement. This declaration is made in conformity to Minnesota Statutes, Section 429.035. 2. This Petition is hereby referred to Maier Stewart & Associates, Inc., who is instructed to provided to the City Council a report advising, in a preliminary way, whether the proposed improvement is feasible and whether the improvement should thus be made as proposed or in connection with some other improvement and the estimated cost of the improvement as recommended. Thackeray, City Clerk RES-1212.may e e e RESOLUTION 93-_ A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION RECEIVING THE FEASffiILITY STUDY AND ORDERING THE IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS IN THE MATTER OF THE CHERRYHILL BLUFFS 2ND ADDmON IMPROVEMENT OF 1993 WHEREAS, the City Council has duly considered the Feasibility Report; and WHEREAS, the Feasibility Report recommends that the proposed improvement is reasible; and WHEREAS, the affected property owners proposed to be assessed for the improvement have waived their right to a public hearing; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. The Cherryhill Bluffs 2nd Addition improvement is hereby ordered as recommended in the Feasibility Report dated May 1993. 2. Maier Stewart & Associates, Inc., is hereby designated as Project Engineer for this improvement. The Project Engineer is directed to prepare plans and specifications for the making of the improvement and the solicitation of competitive bids. Passed and adopted this 17rd day of May, 1993.
