REQUESTED ACTION

This request is for an administrative subdivision to divide a
lot containing an existing duplex into two lots with a zero lot
line. The applicants are also requesting variances on lot
width and size for both lots they are proposing to create.
Only the City Council reviews the administrative subdivision
request, therefore, the Planning Commission only reviewed the
variance request. There is a site plan attached to this memo
showing the duplex and garages as well as the dimensions of the
proposed lots.

LEGAL DESCRIPTION
Lot 2, Block 3, Burrell's Addition. The legal description used
to develop a list of property owners within a 350 foot radius
of the affected property was correct. However, the public
hearing notice in the Star News incorrectly stated Lot 2, Block
2, Burrell's Addition.
BACKGROUND

Mr. Weicht constructed a duplex and detached garages on this
lot in 1984. Both the dwelling units and the garages were
presumably built with two 1 hour fire walls to accomodate a
future lot line as far as building code.

In 1984, lot standards for an R2 lot were 30 feet in width and
3,500 square feet in size. Current R2 lot standards are 60
feet in width and 6,000 square feet in size.
VARIANCE
Staff refers the City Council to Section 900.40 of the Elk
River Code of Ordinances "Variances", for the five standards to
consider when reviewing this request. Mr. Weicht feels he
meets the five standards with this request. He states as his
hardship, the fact that an existing structure was built with a
subdivision in mind, at a time when his proposed lot sizes
would have met City code. Further, he feels that the need for
these variances are not a consequence of his own actions (City
code changed). Lastly, Mr. Weicht feels that approving the
variance would not detrimentally alter the health, safety, or
welfare of the residents of the City or neighborhood since the
structure is already there.
RECOMMENDATION
The Planning Commission recommended approval of these variances
contingent upon verification that building codes for a zero lot
line structure are met. Staff is also recommending approval of
the administrative subdivision contingent on the Council
approving the variances.
