DATE: SUBJECT: FINAL PLAT REVIEW OF MISSISSIPPI OAKS BY IRV MOLDENHAUER/PUBLIC HEARING, CASE NO. P 93-05 The plat of Mississippi Oaks contains 155 single family lots proposed to be accomplished in five phases. The first phase, which will simply be called Mississippi Oaks, contains 37 lots. This is the only phase requesting Council review of final plat at this time. The following is a list of the stipulations placed on the preliminary plat and their status: 1. THAT THERE BE NO CONNECTION OF RIVERVIEW DRIVE TO THE EXISTING RIVERVIEW DRIVE IN PALMER'S ADDITION AT THE PRESENT TIME. e 2. PRELIMINARY PLAT IS VALID FOR ONE YEAR FROM THE DATE OF APPROVAL UNLESS AN EXTENSION IS GRANTED BY THE CITY COUNCIL. This stipulation will affect future phases. 3. LOT SIZES AND WIDTHS ARE APPROPRIATELY ADJUSTED PRIOR TO SUBMITTAL OF FINAL PLAT. This will be done phase by phase. The first phase of Mississippi Oaks appears to be acceptable. 4. THE CITY ENGINEER PREPARES THE PLANS AND SPECS FOR ROAD, SEWER, WATER, AND STORM DRAINAGE. The developer is proposing to have the public improvements for Mississippi Oaks dones as a City project. The next agenda item at this meeting is to accept the feasibility which has been prepared and order the plans and specifications that would be prepared by the City Engineer. 5. PARK DEDICATION - The overall park dedication for all of the phases of Mississippi Oaks included the following: A. TRAIL A 20' WIDE TRAIL MUST BE DEDICATED FROM THE SOUTH END OF THE TRAIL IN HERITAGE LANDING TO THE EXISTING RIGHT-OF-WAY OF RIVERVIEW DRIVE AND TO THE DISCONNECTED RIVERVIEW DRIVE IN THE PLAT WAS TO BE DEDICATED. FROM THERE, 70 FEET OF RIGHT-OF-WAY IS REQUIRED TO BRING A TRAIL NORTH THROUGH THE PLAT TO COUNTY ROAD 30. ALSO, A 20' WIDE TRAIL IS TO BE DEDICATED FROM RIVERVIEW DRIVE TO THE EAST PLAT LINE.. C. e this trail from the trial in Heritage Landing to Riverview Drive in Palmer's Addition is dedicated to the City during this first phase. This way the first leg of the trail system from this area to Orono Park can be accomplished prior to all the phases of Mississippi Oaks being completed. PARK A ONE ACRE PARK IS TO BE DEDICATED IN FUTURE PHASES. THE LOCATION OF THIS PARK IS SUPPOSED TO BE DETERMINED BY THE DEVELOPER PRIOR TO FINAL PLAT APPROVAL OF THE FIRST PHASE. As of the date of this memo, the location of this one acre park has not been identified by the developer. Staff anticipates this being accomplished prior to the Council meeting so the Council can determine the adequacy of the location. This park is not to be located adjacent to County Road 30. PARK DEDICATION FEES THE 37 LOTS IN THE FIRST PHASE OF MISSISSIPPI OAKS MUST PAY PARK DEDICATION FEE AT A RATE OF $400.00 PER LOT FOR A TOTAL OF $14,400 FOR THE 36 ADDITIONAL LOTS CREATED. Credit should be given each original parcel Mississippi Oaks starts with, therefore, one lot credit was give to this first phase. The $400.00 per lot will be reduced by whatever percentage the acreage of a trail from Heritage Landing to Riverview Drive is of the total acreage of the first phase, if the Council chooses to require this part of the trail during this first phase. D. PARK AND RECREATION COMMISSION RECOMMENDATION The Park and Recreation Commission met on May 5, 1993, and re-emphasized their original recommendation that was modified by the City Council in hopes to alter the Council's requirement on park dedication. This recommendation is another agenda item at this meeting. 6. SPECIFIC TREE PROTECTION CONDITIONS ARE PLACED ON FINAL PLAT APPROVAL OF EACH PHASE. This condition is not needed for the first phase. 7. ROAD NAMES ARE ADJUSTED TO MEET THE CITY'S GRID SYSTEM. Road names in the first addition are accurate. 8. e LOT LINES ARE ADJUSTED BETWEEN CUL-DE-SACS, IF NECESSARY, TO PROVIDE FOR LOOPING OF WATER LINES. Apparently, the looping of water lines from this first phase through additional phases is not a problem, however, the City Engineer should review this with the Council at the meeting. e e e Final Plat, Mississippi Oaks May 12, 1993 Page 3 9. A DEVELOPMENT PLAN IS APPROVED BY STAFF PRIOR TO FINAL PLAT APPROVAL. This has not been accomplished. The development plan would identify items such as lowest floor elevation, garage elevation, lot drainage, etc. The development plan may limit how the lots in the first phase are built on, however, staff does not believe it would eliminate any lots in the first phase. Staff is comfortable with the development plan being approved by staff prior to recording the plat. 10. THAT THE FOLLOWING PERMITS ARE OBTAINED: DEPARTMENT OF HEALTH FOR THE EXTENSION OF WATER; MPCA FOR THE EXTENSION OF SEWER; NPDES FOR GRADING; DNR FOR DEWATERING; AND ARMY CORPS OF ENGINEERS FOR THE SEDIMENTATION POND, IF NECESSARY. A DNR permit will not be required for the sedimentation pond. 11. THAT 17' OF ADDITIONAL COUNTY ALONG COUNTY ROAD this. RIGHT-OF-WAY IS DEDICATED TO THE 30. The final plat reflects 12. PROVISIONS ARE MADE TO ACCOMMODATE THE EXTENSION OF URBAN SERVICES TO THE EXCEPTION SHOWN IN THE NORTHWEST CORNER OF THE PLAT. Sewer and water would be brought to this property along the right-of-way of County Road 30. 13. A DEVELOPERS AGREEMENT IS ENTERED INTO REFLECTING THE STIPULATIONS OF APPROVAL. 14. A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST OF THE IMPROVEMENTS IS PROVIDED BY THE DEVELOPER PRIOR TO RECORDING THE PLAT. 15. THE COMPLETION DATE FOR THE IMPROVEMENTS IN THE PLAT IS ONE YEAR FROM THE DATE OF FINAL PLAT APPROVAL. 16. THE DEVELOPER MUST REIMBURSE THE CITY FOR THE ESTIMATED COST OF REVIEWING THE PLAT PRIOR TO FINAL PLAT REVIEW. Staff will let the Council know the status of this stipulation at Monday night's meeting. 17. THAT THIS PLAT IS CONTINGENT UPON A CONDITIONAL USE PERMIT FOR THE SEDIMENTATION POND. THE DEVELOPER PAY THE NEW WATER AVAILABILITY CHARGE OF $300 PER LOT FOR THE 37 LOTS CREATED PRIOR TO RECORDING THE PLAT. 4.
