RE: MISSISSIPPI OAKS FEASIBILITY STUDY

Attached is a copy of the feasibility study for the first phase of the Mississippi Oaks
development. This project lies immediately east of the Heritage Landing project. The first phase
of the development consists of 37 lots adjoining County Road 30 to the north and Heritage
Landing to the west. A portion of the improvements necessary to provide service to this
development are contained within the Heritage Landing project, for which bids will be considered
at Monday evening's meeting. The remainder of the improvements necessary to provide service
are discussed in this feasibility study.
Assuming the developer wishes to waive his right to a public hearing, a draft resolution is
attached for the City Council's consideration. This resolution accepts the feasibility study and
orders the preparation of plans and specifications. As always, we would recommend that the
authorization to prepare plans and specifications be contingent upon the developer placing an
appropriately size escrow account with the City prior to any work beginning.
If you have any questions regarding this issue, I will be in attendance at Monday evening's
meeting.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RECEIVING THE FEASmILITY STUDY AND
ORDERING THE IMPROVEMENT AND
PREPARATION OF PLANS AND SPECIFICATIONS IN
THE MATTER OF THE MISSISSIPPI OAKS PHASE 1 IMPROVEMENT
OF 1993
WHEREAS, the City Council has duly considered the Feasibility Report; and
WHEREAS, the Feasibility Report recommends that the proposed improvement is reasible; and
WHEREAS, the affected property owners proposed to be assessed for the improvement have
waived their right to a public hearing;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1.
The Mississippi Oaks Phase 1 improvement is hereby ordered as recommended in the
Feasibility Report dated May 1993.
2. Maier Stewart & Associates, Inc., is hereby designated as Project Engineer for this
improvement. The Project Engineer is directed to prepare plans and specifications for
the making of the improvement and the solicitation of competitive bids.
