OVERVIEW
Gary and Jean Schleusner are requesting a conditional use
permit to place a temporary trailer on their property while
constructing a new home. The temporary trailer is 70x16 ft in
size and is positioned on the lot meeting all setback
requirements. A well and septic system have been installed
that will be utilized by the Schluesner's while living in the
trailer.

One of the primary issues discussed by the Planning Commission
related to the length of time the trailer could remain on the
property. Staff originally recommended a maximum of 10 months,
however, the City Attorney suggested the maximum 6 months set
forth in the ordinance be adhered to. Therefore, if the
Schleusner's do not complete their house in 6 months, an
extension to the conditional use permit would be required.
Attached to this memo is a report to the Planning Commission
along with back-up information explaining in detail the request.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission unanimously recommended approval of the
conditional use permit with the following conditions:
1. THE TEMPORARY TRAILER BE REMOVED FROM THE SUBJECT
PROPERTY 6 MONTHS FROM THE DATE OF CITY COUNCIL
ACTION OR THE APPLICANT APPLY FOR AN EXTENSION OF THE
CONDITIONAL USE PERMIT IF ADDITIONAL TIME IS NEEDED.
2. ADEQUATE SEPTIC SYSTEM AND WELL BE IN PLACE PRIOR TO
MOVING THE TRAILER ON SITE.
3. THE TRAILER BE POSITIONED ON THE SITE AS ILLUSTRATED
ON THE SUBMITTED SURVEY.

ANALYSIS
The Schleusner's presently reside immediately north of the
affected property. They have recently begun building a new
home on the affected 10 acre parcel and have sold their
existing home. Therefore, they are requesting approval to
place a 70'x16' trailer temporarily on site while they
participate in the supervision and construction of their new
home. The trailer can probably be better described as a mobile
home. As mentioned, its size is 70'x16' and is a three
bedroom, two bath facility. Attached is a layout of the
"trailer" purchased by the Schleusner's.
The ordinance specifically allows temporary trailers during
construction of a home. However, the maximum length of time
the temporary structure can be kept on site is stated as being
6 months. The Schleusner's originally requested a 1 year
period but have reduced that to ten (10) months. As a
condition of this permit, it can be stated the maximum length
of time the trailer may be on-site is ten (10) months.

Prior to moving the temporary trailer on site, an adequate
septic and well will be installed. In addition, other services
such as garbage and mail will be arranged prior to occupying
the trailer. As illustrated on the attached survey, the

trailer location meets required setbacks for a home in the RIa
zoning district.
Attached is a letter from the Schluesner's outlining their
request and addressing criteria for granting a conditional use
permit.
Given the location of this request in a somewhat rural area and
on a wooded lot, the use of the trailer will essentially go
unnoticed. As long as the trailer is in fact used as temporary
residency, there should be no problems with this request in
this location during the construction of their new home.
RECOMMENDATION
Staff believes the application, as presented, meets the seven
conditions found in Section 900.42 of the Elk River City Code
granting a conditional use permit. Therefore, it is
recommended the Planning Commission recommend approval based on
the following stipulations:
1. THE TEMPORARY TRAILER BE REMOVED FROM THE SUBJECT
PROPERTY 10 MONTHS FROM THE DATE OF CITY COUNCIL
ACTION.
2.

WRITTEN RESPONSE FOR
CONDITIONAL USE PERMIT
I am requesting a conditional use permit from the City of Elk
River to be allowed to place a trailer home on the ten acres of
land that I am in the process of building a home on at this time.
The trailer home would be placed on my land as indicated in the
site plan. My family and I built a large home on the five adjacent
acres five years ago, and have since sold that home.
We have
decided to remain in our community and build a new home on our ten
adjacent acres.
My wife and I are building our new home at this site and are
attempting to build it with our own sweat equity and our own cash.
We anticipate being completed with our project in the late spring
or early summer of 1994. We have only one child, Erin Grace, who
turn six years of age on the 4th of July. . We also have two cats
and a large dog, so renting an apartment is not feasible. Also, we
would request to be allowed to put a trailer home on our ten acres
during our building period in order to allow our child to stay in
her neighborhood, attend her same school, and stay in her same
daycare. We have determined this would be the least disruptive
avenue for our family, to be allowed to place a trailer on our
land.
We are requesting one year for our project. From August of
1993 to August of 1994.
Our request will not endanger, injure or detrimentally affect
the use and enjoyment of other property in the immediate vicinity.
We will have our septic in place and well in place, which will
service our new home and our trailer home. Therefore, no danger of
any kind can result to the neighboring properties. Our request also
will not endanger public health, safety, morals, comfort,
convenience or general welfare of the neighborhood or the City. We
plan on only keeping the trailer on the land near our new home
during the short period of time while we are building so we can
remain in our community.
It is our understanding that this request is consistent with
the Comprehensive Plan adopted by Elk River.
Since this is a strictly temporary solution to our needs, and
will last under one year, we believe that our plan will not impede
the normal and orderly development and improvement of the
surrounding vacant property.
Because we will have our .septic in place, our well in place
and our garbage pick up and other services in place at the time the
conditional use permit is granted, our temporary mobile home will
be served adequately by and will not adversely affect the essential
public facilities and services, including streets, police and fire
protection, drainage, refuse disposal, water and sewer systems,
parks and schools.
Our temporary mobile home plan will not create traffic
congestion or interference with traffic on adjacent and neighboring
public thoroughfares.
Our conditional use permit plan of having a temporary mobile

involve uses, activities, processes, materials, equipment and
~ conditions of operation that will be detrimental to any persons, or
property, because of excessive traffic, noise, smoke, fumes, glare,

Our conditional use permit plan will not result in the
destruction, loss or damage of a natural scenic or historic
features of major importance.
I will fully comply with all of the requirements of the
City's Code of Ordinances including any applicable requirements and
standards for the issuance of a license or permit to establish and
operate the proposed use in the City of Elk River.
Because this is purely' temporary and there will be an
expensive home being built during the period of the use permit
which will only add to the value of the homes in the area, we feel
our plan is appropriate and would request that our conditional use
permit be granted.
