SUBJECT: MRS. LESTER BOELTER'S APPEAL OF
THE REFUSE AND GARBAGE APPEAL
BOARD DECISION
Mrs. Lester Boelter, 20733 Elk Lake Road, Elk River, came
before the Refuse & Garbage Appeal Board on August 10, 1992, to
discuss an exemption from mandatory refuse and recycling
service. The reason for the appeal request was financial
hardship and the fact that they have very little refuse.

The Boelter's are on a fixed income and have indicated they can
not handle an added bill. Mrs. Boelter recently explained that
the majority of their income is spent on medical supplies for
Mr. Boelter. The Appeal Board voted in a split decision to
deny the request to remain consistent throughout the City.
There are several people in the City who have a similar
situation and who are required to pay for refuse service. It
is the Appeal Board's feeling that if this request were
approved it would open the opportunity of several additional
requests. The Boelter's were delivered a container and billed
for the service.
Recently Mrs. Boelter contacted the City asking the Appeal
Board to again review their request for exemption. It is
staff's opinion that this request has already been heard by the
Appeal Board, therefore, the next step would be to appeal the
Decision of the Appeal Board to the City Council.
The City must keep in mind that the State Legislature requires
cities with a population over 1,000 people to ensure that
everyone has refuse collection service. The City of Elk River
has designed the biweekly refuse program to try and help the
low volume generator of refuse. Currently, the cost of this
service is $12.36 per month.
