SUBJECT: RESOLUTION OF SUMMARY PUBLICATION
OF MASSAGE ORDINANCE
Attached is a resolution authorizing the publication of a
summary of the Therapeutic Massage ordinance. The ordinance
will become effective upon publication of the official
summary. A complete copy of the ordinance is available for
public inspection in the City Clerk's Office and at the Elk
River Public Library.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION APPROVING NOTICE OF PUBLICATION OF OFFICIAL
SUMMARY OF ORDINANCE NO. 93-__ AN ORDINANCE OF THE CITY OF
ELK RIVER, MINNESOTA, REPEALING SECTION 704, OF THE CITY
CODE, SAUNAS AND MASSAGE ESTABLISHMENTS, AND ENACTING A NEW
SECTION 704 IN LIEU THEREOF RELATING TO THE SAME SUBJECT
ENTITLED THERAPEUTIC MASSAGE AND SAUNA ESTABLISHMENTS.

WHEREAS, The City Council of the City of Elk River has adopted
an ordinance pursuant to which Section 704 of the City
of Elk River Code of Ordinances, Saunas and Massage
Establishments, has been repealed and a new section
704 adopted in lieu thereof, entitled Therapeutic
Massage and Sauna Establishments; and
WHEREAS, The following is a surmnary of new Section 704 as
adopted in Ordinance No. 93-__:
1. The Ordinance sets forth a statement of purpose
to prohibit massage businesses and services to
the public except those licensed as Therapeutic
Massage Establishments and Massage Therapists
pursuant to the new section.
The Ordinance adopts new definitions of
Therapeutic Massage, Therapeutic Massage
Establishment, On-Site Therapeutic Massage, Sauna
and Massage Therapist.

3. The Ordinance requires a license for a
Therapeutic Massage Establishment or Sauna open
to the public. The Ordinance provides for
license application requirements, provisions for
renewals and exceptions to the business license
requirements for licensed health care facilities,
medical clinics or hospitals, chiropractors,
osteopaths, podiatrists, physical therapists, and
beauty parlors or barbershops.
4. The Ordinance provides for restrictions and
regulations in the operation of Therapeutic
Massage Establishments.
5. The Ordinance sets forth requirements for the
issuance of licenses, including insurance
requirements.
6.
The Ordinance provides for individual Massage
Therapists to be licensed and sets forth
application and educational and training
requirements for the issuance of such licenses.

7. The Ordinance establishes penal provisions for
violations.
WHEREAS, A printed copy of the Ordinance is available for
inspection by any person in the office of the City
Clerk at City Hall or at the Elk River Public Library.
NOW, THEREFORE, BE IT RESOLVED, that this Official Summary of
Ordinance 93-__ shall be published in lieu of
publication of the entire ordinance, as provided by
Minnesota law.
