TO: MAYOR & CITY COUNCIL FROM: STEVE ROHLF, B & Z ADMINISTRATOR se DATE: OCTOBER 12,1993 SUBJECT: FENCE ISSUEIP ATENAUDE At a recent meeting, the City Council directed City Attorney Peter Beck to pursue the enforcement of the City's fence ordinance regarding a fence erected by Dave Patenaude of 19275 Lander Street NW, Elk River, Minnesota. The Council directed the City Attorney to take legal action, if necessary, to resolve this issue. Mr. Beck and I met with Mr. Patenaude at his home on October 6, 1993. It appears that the issue of Mr. Patenaude's fence will be resolved satisfactorily without court action which is a benefit to both Mr. Patenaude and the City. Attached to this memo is a letter dated October 12, 1993, from City staff to Mr. Patenaude outlining the discussion that took place during our meeting with him. e e P.O. Elk River, MN 55330 Dear Mr. Patenaude: I appreciate your cooperation during a meeting at your home with City attorney Peter Beck and myself on October 6, 1993. The following was discussed: A 4-ft. high chain link fence would be erected on your neighbor's side of the existing fence. The existing fence posts would be used for this chain link fence with posts being added, if necessary. e The new chain link fence would be attached to the existing wire every 6-ft. at a maximum. You agreed to start this work prior to November 1, 1993, and have it completed by November 30, 1993. You understand that you cannot go on your neighbor's property to do this construction. If you do this work as outlined above, both the City attorney and myself agree that you would be in compliance with the City's fence ordinance' and the City' would not pursue the issue any further. Once the chain link fence is in place, the ribbons on the existing fence could also be removed.
